Related Tasks Preparation of Pleadings to initiate a civil suit Ismail Kidava comes to your office alleging that a certain man identified as Ahmed Bushiri approached his show room where he is selling used motor vehicles imported from Japan. Ahmed Bushiri told him that he was looking for Nissan Navara 4x4 to buy. Kidava replied yes and proceeded to the show him two of them one manufactured in 2010 and the other 2008. Ahmed asked for the price of each vehicle and was given. He said the prices were too high and asked for a discount of almost half of the price of which | told him the only discount | can offer was 1.5M for each vehicle. He was furious and told me that | was too selfish for selling vehicles beyond prices. lasked him to leave he resisted and vowed to teach me a lesson. Three days later, while opening his office he was approached by a police officer identified himself as from police station. | asked what was he looking for, he said he was there to arrest me and asked me to accompany him to the station or else he would use force to make me comply. | closed my office and follow him to the police station. When reached there, | was taken to custody and in the following day I recorded a statement showing that Ahmed Bushiri complained that | received TSHS. 35,000,000 from him for importing Nissan Navara but vanished with it. | was shocked with that information because | never did any business with that man. | tried to tell the police ———— | Beamscanner if Ihave anything to say, | will say it in court. Next day | was arraigned on court and charged with an offence of obtaining by false pretense. | pleaded not guilty. On hearing, prosecution called 0 consequently discharged, Having narrated hist story he produced a copy of the business license and ruli the court showing exactly what he narrated to you. ‘When you asked him what happened to his business after his arrest he replied, business had to be closed from the time he was arrested and remained closed ‘when he was discharged. When you asked why closure Ahmed said, he applied bail without success and he did not have anyone to look after it until his release, He asked you to use your legal know how to take necessary action against Al Bushiri so that people like him may learn to respect other people's liberty. ‘Task Two: Preparation of Pleadings to Answer a Plaint Make assumption, Kidava instituted a case against Bushir. A plaint together ‘summons to fle defence were served to Bushir On receipt of it, he approache your law firm and stated what really happened between him and Kidava. goes as follows: Indeed Ahmed Bushiri gave Ali Kidava Tshs. 35,000,000 for the latter to sale th the bank account of Kidava which was shared by Kidava to Bushiri and Gelivered bank deposit slip.
