(i) Relating to framing of Rules'

concernedauthoritiesandthematterisinthepipeline.

(ii) Accommodation and infrastructure for the Committee.

As intimated, the matter is under consideration and in pipeline and further


development will be intimated to the Committee soon thereafter.

(iii)lssuance of necessary directions to all concerned with respect to insertion of


the status of fee fixed by the Committee in the respective proposals of the
Private Medical and Dental Colleges while mentioning their respective fee
structures before the BCECE Board

As intimated by the representative Member Secretary, the Department has


issued letter No.sa.sa.-ollshi.shu.04/201.6-622 (1) dated 18.09.2024 to the
Dental Colleges, but it appears not covering the resolution taken. Accordingly, it is

assured by him to comply and properly issue directions in accordance with the

resolution in its true letter and spirit and intimate the Committee soon thereafter.

(iv)The action taken with respect to RDJM Medical College & Hospital, Turki,
Muzaffarpur in the light of letter No.Sa.Sa.-llVividh-L3/2017-262 (1) dated
L5.O5.2O24 and letter No. 524 (Ka) dated 09th September,2024.

As intimated by the representative Member Secretary and Mr. Santhosh

Kumar Kraleti, representing NMC, the matter is under consideration by the


concerned authorities and actions are expected to be taken very soon.
Accordingly, the Committee will be made aware.

Agenda No.04:-

To monitor the progress of earlier resolution taken vide Agenda No.06 in the
previous meeting dated 22.O8.2024

Kraleti, representing NMC, the matter is under consideration and due action may

be taken very soon. Accordingly, the Committee will be made aware,


(ii) As intimated by the representative Member Secretary, the process for filing

L.P.A. against the order dated 18.07.2024 passed, in CWJC No.11213 of 2023,by
the Hon'ble Court has already been initiated.

Agenda No.05

To consider and discuss the report of the Working Group with respect to the letter
No.JMI/RDJMMCH/FFC /9212024-25 dated 23.08.2024 received on 27.O8.2O24 after
order dated t8.07.2024 of the Hon'ble High Court, Patna passed in CWJC No.11213
of 2023 and pass necessary orders after hearing the authorities of the college and re-
fix the fee for Under Graduate course for the balch 2O2L-26.

After hearing the authorities of the college and on due consideration, the Committee
passed 138 pages reasoned order which be kept with the file after communicating
to all concerned under the signature of Dr. Ranjeet Kumar Sinha, O.S.D., the operative
portion of which is as follows:-

After overall consideration of the materials available,


comments of the working group relating to income and expenditure, etc.,
and overall submissions made by the authorities of the college the
committee since failed to find any reason to change the opinion already
arrived at hence, under compelling circumstances, the fee for under

Graduate Degree course per annum considering inflation at the rate of


5.83% is fixed by the Committee at Rs.7.98 Lacs including Rs,1.04 Lacs as

development fee for the batch 2021-26, excluding hostel, mess charges and

transport to non-resident in hostel. However, it is made clear that the

college cannot realize the amount in the above heads more than what they

have already mentioned in their prop'osal vide annexure- f reproduced in


para t2 of this order submitted before the Committee.

Since the college has already taken admission and realized fee from the

A', students as mentioned in paragraph No.13 above of the order which is in

F:- ,>'c' excess of the amount fixed. Accordingly, the difference amount is to be

refunded tothe students bythe college directly in their bank accounts with

compound interest @ t8% from the date of realization till the date of actual

payment.

The Committee directs that the institution shall not charge either directly

or indirectly any other amount over and above the amount fixed as fee and
if any other amount ls charged under any other head or guise that is

donations, fee by any other name the same would amount to charging of

capitation fee. Any deviation of this order of the committee will invite
serious consequences.

Asenda No.06:-

To consider and discuss the report of the Working Group with respect to the proposal
submitted by RDJM Medical College & Hospital Turki, Muzaffarpur for Under
Graduate course for the batch 2024-29 and after hearing the authorities of the
college pass necessary orders.

After hearing the authorities of the college and on due consideration, the Committee
passed 30 pages reasoned order which be kept with the file after communicating to

all concerned under the signature of Dr. Ranjeet Kumar Sinha, O.S.D., the operative
portion of which is as follows:-

After overall consideration of the materials available, comments of the working


group relating to income and expenditure, etc., and overall submissions made by

the authorities of the college, including the revised proposal submitted yesterday
which under heading Tuition Fee including Development Fee comes nearing the
finding of the Committee already arrived at hence, under compelling
circumstances, the fee for Under Graduate Degree course per annum considering

inflation at the rate of 5.66% is fixed by the Committee at Rs.9.96 Lac including
development fee for the batch 2024-29, excluding hostel and mess charges.
However,itismadeclearthatthecollegecannotrealizetheamountintheabove
headsmorethanwhattheyhavealreadymentionedintheiroriginalproposalvide
Annexure-Freproducedinpara03ofthisordersubmittedbeforetheCommittee.
Theamountunderabovetwoheadsmentionedintherevisedproposalistobe
strictlY ignored.

TheCommitteedirectsthattheinstitutionshallnotchargeeitherdirectlyor
indirectlyanyotheramountoverandabovetheamountfixedasfeeandifany
