RE: “FALLING”

In consideration of the payment of £[1] (the receipt and sufficiency of which is hereby acknowledged)
and for other good and valuable consideration, you hereby grant to TPL FALLING LIMITED (company
registration number 15581098) (“Producer” which expression shall include its successors, assigns
and licensees) the right to photograph, record, reproduce and use your likeness (“Likeness”) for and
in connection with the production of the motion-picture currently entitled “FALLING (“Film” which
expression shall include all material filmed, recorded or produced in connection therewith) and in
connection with producing, advertising, publicising, exhibiting and exploiting the Film and/or any
subsidiary or ancillary rights relating thereto and any production into which footage of the Film is
licensed, in whole or in part, in any manner whatsoever, in any and all media, devices, processes and
technology now known or hereafter devised, including without limitation by all forms of motion picture,
television series and video, in any language, throughout the universe for the full period of copyright
and all extensions and renewals thereof and thereafter (insofar as is or may become possible) in
perpetuity.

You hereby release Producer from any claim of any kind or nature whatsoever arising from or in
connection with the use of your Likeness in the Film and its advertising, promotion and exhibition and
any production into which footage of the Film is licensed, including, but not limited to, those based
upon defamation (including libel and slander), invasion of privacy, right of publicity, confidentiality,
copyright or any other personal and/or property rights (including without limitation any provision of law
known as moral rights or “droit moral” or any similar rights whether now existing or hereafter conferred
under the laws of any jurisdiction) (“Claims”) and agree that you will not now or in the future assert or
maintain any such Claims against Producer. You hereby acknowledge that Producer shall have the
right but not the obligation to utilise your Likeness in the Film or in advertising, publicising, exhibiting,
or exploiting the same, in whole or in part. You acknowledge that Producer is proceeding with the
production, distribution, and exploitation of the Film in reliance upon and induced by this Agreement.
You hereby represent that you have the authority to grant Producer the permission and rights herein
granted, and that no one else’s permission is required with respect to the rights herein granted. You
hereby indemnify and hold Producer fully indemnified from and against all actions, proceedings, costs,
claims, damages and demands howsoever arising in respect of any actual or alleged breach or non-
performance by you of any of your undertakings, warranties or obligations herein, or your negligence
or wilful misconduct.

You hereby give any and all consents which may be required under the Copyright Designs and
Patents Act 1988 (or any amendment or variation or modification thereof) to enable the Producer to
make the fullest use of the rights hereby assigned or granted.

You hereby acknowledge that your Likeness may contain your personal data and in such
circumstances Producer shall use and otherwise process this personal data for purposes connected
with this Agreement and in accordance with its legitimate interests in producing the Production,
Producer shall, from time to time, need to make some of your personal data available to legal and
regulatory authorities, future employers and potential purchasers of the Producer (or any of its assets
or business), affiliates, group companies, professional advisors and other parties which provide
products or services to the Producer. If such recipient is located, or has relevant operations located, in
a jurisdiction where data protection and privacy regulations do not offer the same level of protection as
within the European Union or the UK (such as the United States of America), Producer shall take
reasonable steps to ensure the security and confidentiality of your personal data. You have certain
rights in respect of your personal data (access, objection, rectification, erasure, restriction and

portability) and that further information about these rights and Producer’s processing of personal data
generally can be obtained upon request from the Producer.

You acknowledge that the sums payable hereunder are a complete buy-out of all rights and you shall
not be entitled to any further sums whatsoever by reason of the exploitation of the Film or other
exploitation permitted hereunder.

You agree that in the event of any default of any of the terms of this Agreement by the Producer your
only remedy will be an action at law for damages, if any, actually suffered by you. In no event shall you
be entitled to rescind this Agreement or receive injunctive or other relief, or enjoin or restrain the
distribution, exhibition, advertising or other exploitation of the Film or of any permissions or rights
granted and assigned under this Agreement.

The Producer shall be entitled to assign this Agreement in whole or in part to any third party and to
assign, license and deal with your services hereunder and in the event of any such assignment,
license or dealing you undertake to fulfil your obligations pursuant thereto.

This Agreement shall be construed in accordance with and governed by the laws of England and
Wales and you agree to irrevocably submit to the non-exclusive jurisdiction of the English courts.

Please sign the duplicate of this Agreement in the space provided for below to signify your agreement
to and acceptance of the above terms.
