Consulting Services for the Construction Supervision of Contract Package 1, Contract Package 2,
and Contract Package 3, under Stage 2 of the Laguna Lakeshore Road Network (LLRN) Project
– Phase I
I. BACKGROUND INFORMATION

A. Introduction

1. The Government of Philippines (the Government) has applied for loan from the Asian
Development Bank (ADB) towards the cost of the infrastructure development of the
Laguna Lakeshore Road Network (LLRN) Project – Phase I.

2. The Laguna Lakeshore Road Network (LLRN) Project has been included in the priority
list, where its feasibility study has been completed under the Infrastructure Preparation
and Innovation Facility (IPIF) in 2020. This IPIF projects involves comprehensive project
identification and planning stage, Pre-Feasibility Study and Feasibility Study with the
overarching intent to provide a safer and faster alternative to the motorists traveling
south / north to vitalize the economies for the surrounding areas and the following
impacts and benefits: (a) reduce transportation constraints on the existing road; (b)
induce economic development in the area and nearby provinces and promote the
achievement of the development objectives being pursued in the area; and (c) provide
safer, convenient and faster travel to motorist from north and south of the project area
to various tourist business destinations in Laguna, Rizal, Quezon and Batangas.

3. The full road network will be comprised of viaduct and embankment hybrid scheme with
an approximate length of 37.5 kilometers with seven (7) interchanges (Lower Bicutan,
Sucat, Alabang, Tunasan, San Pedro/Biñan, Cabuyao, and Calamba) with a total of 6.87
km of slip roads and 4.76 km of Manila South Road (MSR) connecting roads.

4. The Detailed Engineering Design (DED) was undertaken under the IPIF additional
financing (ADB Loan No. 3886-PHI) in December 2021. It includes the DED of the four
(4) Contract Packages from Lower Bicutan to Calamba and MSR connecting roads and
the Feasibility Study of Laguna Lakeshore Road Network (LLRN) Project – Phase II
(Eastern Side). The DED also conducted studies on environment through the
Environmental Management Plan (EMP) and social safeguards through the Resettlement
Plan (RP), preparation of bidding documents, and carrying out due diligences necessary
to support the government and ADB in project processing and procurement.

5. The DPWH will represent the Government as the Executing Agency (EA) of the Project.
The Roads Management Cluster II (Multilateral) of the Unified Project Management Office
(RMC II - UPMO) of the EA will be the Implementing Agency (IA) responsible for
implementing the Project. The Consultant will be selected based on the Quality and
Cost Based Selection (QCBS) method following the ADB Procurement Policy 2017 and
Procurement Regulations for ADB Borrowers 2017 which can be found at the following
website:

6. During the services, the Construction Supervision Consultant (the Consultant) will embed
selected personnel from the DPWH to receive training, and experience construction

supervision and other relevant activities for capacity-building purposes. For all project
activities, the Consultant will report and coordinate to DPWH through the Roads
Management Cluster II (Multilateral), Unified Project Management Office (RMC II –
UPMO).

7. The Terms of Reference (TOR) includes the objective of the project, scope of work,
responsibilities, and deliverables of the Consultant. It is estimated that a minimum of
377 person-months of international and 1,946 person-months of national
consultants’ services will be required for the Construction Supervision team for this
assignment. The location of the assignment shall be Laguna and Metro Manila,
Philippines, and nearby areas in the country as needed. The assignment is expected to
commence in Fourth Quarter of 2024 and be completed in approximately Thirty-six
(36) months for the Construction Supervision and twelve (12) months Defects
Liability Period (DLP) for the three (3) Contract Packages namely:

Contract Package 1: Alabang-San Pedro/Biñan Section, Stage 2


Contract Package 2: San Pedro/Biñan-Cabuyao Section, Stage 2 and
Contract Package 3: Cabuyao-Calamba Section, Stage 2.

B. Background
8. The Project is one of the DPWH flagship projects which is deemed responsive to the
Government's thrusts and strategies as laid out in the 2017-2022 Philippine Development
Plan (PDP) Chapter 19: Accelerating Infrastructure Development, specifically on
enhancing transport sector efficiency through improved connectivity, and ensuring that
infrastructure projects are designed with appropriate safety standards and are improved
to ensure sustainability. The project is also consistent with the National Transport Policy,
specifically in improving access and support to agro-industry and trade to ensure the
efficient and unimpeded flow of people, goods, and services, and in promoting inclusive
growth in the areas outside of the country's key cities. The north-south transport corridor
in the project area, consisting mainly of the South Luzon Expressway (SLEX) and the
Manila South Road are heavily congested, the proposed road will provide a safer and
faster alternative to the road users travelling the north-south transport corridor of the
western shoreline of the lake. The Project is to build a permanent linkage between the
Cities along the western coastline of the Laguna Lake, and the impact would be expanded
to the broader regional boundaries of Metro Manila and Calabarzon.

9. Significant levels of congestion exist along the national highway from Manila to Los Baños
in Laguna Province. This is leading to long journey times which impacts on workers,
residents and tourists traveling between the two areas, businesses in Manila and the
provinces around Lake Laguna, and tourism destinations in Laguna, Rizal, Quezon, and
Batangas. The construction of LLRN would ease the pressure on the network, creating a
direct route between Laguna and Manila. It would lead to a reduction in congestion and
improve the network performance. Travel times will also improve significantly following
the implementation of the proposed scheme.

10. Contract Package 1 involves the construction of the following components:


• Mainline (Alabang – San Pedro/Biñan) – 7.629 km
Embankment – 1.720 km; and
Viaduct/Bridge - 5.909 km.

Roundabout - 0.289 km.

• Manila South Road (MSR) Connecting Road (Tunasan) – 0.581 km

11. Contract Package 2 involves the construction of the following components:


• Mainline (San Pedro/Biñan – Cabuyao) – 12.232 km
Embankment – 7.507 km; and
Viaduct/Bridge - 4.725 km.

• Interchange (San Pedro/Biñan) - 2.946 km


Slip Road - 0.650 km;
Ramps - 2.006 km; and
Roundabout - 0.289 km.

• Manila South Road (MSR) Connecting Road (Tunasan) – 0.581 km

12. Contract Package 3 involves the construction of the following components:


• Mainline (Cabuyao - Calamba) – 9.698 km
Embankment – 6.17 km; and
Viaduct/Bridge – 3.528 km.

• Interchange (Cabuyao and Calamba) - 3.912 km


Slip Road - 3.038 km; and
Ramps/Roundabout – 0.578 km.

• Manila South Road (MSR) Connecting Road (Cabuyao) – 2.975 km

13. The LLRN Project will transform the journey times, reliability and connectivity between
Metro Manila and Laguna province, by providing a new piece of infrastructure that will
benefit workers, residents and tourists traveling between the two places, as well as local
businesses, and tourism destinations. The implementation of LLRN will lead to overall
time savings across all vehicle modes travelling from Laguna to Manila by its completion
in year 2027.

14. The LLRN Project will serve population growth by increasing Metro Manila’s road network
capacity, making it easier for people to move around. One of the key drivers of future
economic growth in Metro Manila and Laguna region will be infrastructure investment.
Metro Manila’s strong population growth is resulting in more development being pushed
out into the urban fringe. As distances between business, housing and the city become
larger due to urban sprawl, the role of transport infrastructure becomes ever more
important. A key challenge will be ensuring access to employment for this rapidly growing

population; increased transport capacity to support this growth will be critical to


supporting economic development and social wellbeing.

II. OBJECTIVES AND SCOPE OF SERVICES

15. The Consultancy Services involves the Construction Supervision of the three (3)
Contract Packages: CP1, CP2 and CP3 of the Laguna Lakeshore Road Network
(LLRN) Project – Phase I with the components listed above.

16. The primary objectives of the Consulting Services are to:

a. Construction Supervision – function as the Engineer in supervising the civil works


contracts under Stage 2 (CP1, CP2 and CP3) in accordance with the Conditions of
Contract, FIDIC 2017 Red Book, and advise the Employer on all matters concerning
implementation of the contract including but not limited to quality control, work
progress, and dispute resolution;
b. Interface Management – oversee the communication, coordination, and execution
of physical and contractual interfaces between each contract packages which shall
be undertaken by different contractors. Further, they should also be responsible for
handling the organizational interfaces internally for parties directly involved in the
project implementation and externally for stakeholders to be affected and benefitted
by the project such as local government units, utility companies, etc.
c. Capacity Building – provide an on-the-job training and capacity building training
to the DPWH staff, locally or internationally, following the guidelines on
implementation, civil works, construction supervision, environmental management
plan (EMP), resettlement plan (RP), gender and development and others.
d. Engineering and Management Support – assist the DPWH in ensuring that the
project adheres to approved design specifications, construction documents, and
progresses as planned while meeting the highest standards of quality and compliance
as outlined in the contract. This includes ensuring compliance with right-of-way
requirements per ADB guidelines and Philippine laws, providing support to DPWH for
budget preparation, and overseeing project implementation to align with approved
contract documents and loan agreements.
e. Post-Construction Supervision – assist the Employer during the project’s Defects
Liability Period (DLP) of 12 months and in the finalization of construction-related
documents, project accounts and closing-out activities. The Consultant shall retain
only necessary personnel during this period.
f. Biodiversity Action Plan Implementation - assist the DPWH implement the
Biodiversity Action Plan (BAP) that requires improvement in the biodiversity baseline
and impact assessment, and design of associated mitigation and compensation
measures.

III. SCOPE OF WORKS FOR CONSTRUCTION SUPERVISION

17. The main civil works will be executed under the Conditions of Contract for Construction
for Building and Engineering Works Designed by the Employer, Red Book Second Edition
2017, prepared by the Federation Internationale des Ingenieurs-Conseil, or FIDIC (FIDIC
Red Book Second Edition 2017). The scope of the consulting services to be carried out
during construction shall include but not necessarily limited to the following:

17.1 The Consultant shall always act as adviser to the DPWH on matters pertaining to
the efficient implementation of the project and shall at all times support and

safeguard DPWH legitimate interests in any dealings. Represent the interest of


the Government vis-à-vis the Contractor in any matter related to the construction
contract and the proper execution.

17.2 The Consultant shall function as the Engineer for the Construction Packages. The
Employer will confirm this appointment in writing and the Consultant member of
staff authorized to act on behalf of the Engineer under the Contract (including
appointing Engineer’s Representatives with the approval of the Employer). The
Engineer and Engineer’s Representatives shall at all times act in accordance with
the provisions of Clause 3 of the General and Particular Conditions of Contract -
Law Governing Contract.

17.3 The services to be rendered by the Consultant shall be undertaken in the


Philippines. Should there be a need for the experts/personnel to do their assigned
work outside the country, clearance from DPWH should be secured.

17.4 The Resident Engineer shall report directly to the Team Leader and shall closely
coordinate with the Counterpart Project Engineer of the RMC II- UPMO, DPWH,
assigned to the project.

17.5 The Resident Engineer will provide on time to DPWH Counterpart Project Engineer
requests for clarification on issues/guidelines, which will be issued as the work
progresses for those monitoring the field performances of the Consultant.

III-1: ACTIVITIES PRIOR TO START OF CONSTRUCTION

18. The following activities need to be started prior to construction of each civil works contract
package:

A. Review of Existing Documents, Detailed Engineering Design and Construction


Documents

18.1 Review of all contract documents of each contract package such as approved
plans/drawings, technical specifications, construction contract, construction
methodology, and other documents to ensure its executability. Should there be
discrepancies, conflict, or ambiguity in the Plans, Specifications, and pertinent
documents, the consultant shall inform the employer and advise the corresponding
efficient corrective measures that need to be taken to ensure the executability of
the works.

18.2 Review the Contractor’s methods of work and work schedule revision for both
temporary and permanent structures, including a critical path diagram for
implementation of the contract and any plans or programs that the Contractor is
obliged to submit, as well as proper allocation of responsibilities of the Contractor’s
workforce.

18.3 Prior to the commencement of works, approving of the contractors’ construction


plans including traffic management and traffic control arrangements, proposed
public and private haul and access routes, together with the contractors’

arrangements for maintenance and reinstatement of the same, borrow locations,


working areas, materials stockpile areas, materials mixing, and processing areas,
etc.

18.4 Review, comment, and accept the contractors’ quality assurance plans and
procedures; assist the contractors with establishing on-site and laboratory-based
quality control, testing, and reporting procedures for all construction,
workmanship, and materials; supervise the contractors in the implementation of
the quality assurance plans.

18.5 Prior to the establishment of contractors’ facilities and commencement of civil


works, the site selection should be approved by the Consultant and submit for
review the draft Construction Environmental Management Plans (CEMP) to be
prepared by each contractor to ensure that these documents are consistent with
the conditions of the Environmental Compliance Certificate (ECC) and the provision
of the EMP included in the Environmental Impact Assessment (EIA) cleared by ADB.
The CEMPs will be shared with ADB for review before these are approved by the
Consultant. The Consultant will prepare a Biodiversity Mitigation and Compensation
Feasibility Study to identify, assess, and prioritize required biodiversity mitigation
based on the Biodiversity Action Plan (BAP).

B. Preparation of Different Project Systems for Construction

18.6 Maintain organized project construction records, correspondences, reports, and


other necessary files. These documents shall then be stored in an efficient and
user-friendly computerized document management system that the Project
Management Consultant will develop and maintain throughout the project duration.

18.7 Develop a construction risk register that captures and records all potential risks
associated with the project and its associated monitoring and risk resolution plan.

18.8 Organize a material testing laboratory based on the provisions in the construction
contract and arrange the material testing requirements of those tests that would
be conducted in-house and/or by private testing facilities.

18.9 Develop a comprehensive system of inspection checking and recording to ensure


compliance of all works with the specifications.

18.10 Develop interim and final measurement and payment systems; establishing a
monitoring system for costs to date, and costs to completion; providing a system
for the preparation of interim and final payment certificates; and establish claims
monitoring, evaluation, and reporting system.

18.11 Select and implement a Building Information Modelling (BIM) software that
supports the integration of progress videos and photographs directly into the BIM
model.

18.12 Submit a 2-4 pager bi-monthly project update every 10th and 25th day of the month
in A4 size paper, and a format acceptable to the employer, to be signed by the
Engineer.

18.13 Oversee the coordination meetings with DPWH, ADB, and other relevant
stakeholders, including the preparation of reports, presentations, visual media and
minutes of meetings.

18.14 Develop and establish a website communication hub for the project as platform
of project information, grievance from various stakeholders, etc.

C. Conduct of Pre-Construction Activities and Meetings

18.15 Conduct a pre-construction meeting with the Contractor and all project
stakeholders to clarify issues such as environmental and social issues and other
concerns.

18.16 Assist the Employer in their implementation of right-of-way acquisition and


resettlement activities, including demolition of existing facilities, fish cages and fish
pens, relocation of utilities, identification of indirectly affected persons, and other
activities, until its resolution

18.17 To commence the performance monitoring activity, the Consultant shall conduct
socio-economic and baseline surveys that are required to ensure that the project’s
impacts can be effectively identified and monitored. The Consultant shall assemble
appropriate data including data obtained during Feasibility Study and Detailed
Engineering Design, and from other relevant studies undertaken within the project
area. Specifically, the Consultant will:

a. Ensure that monitoring and evaluation specialists liaise with all other technical
staff to develop and implement a comprehensive and effective monitoring and
evaluation program;
b. Establish systems for recording data and statistics for such monitoring;
c. Design surveys and identify the collection of other required data needed for
the monitoring and evaluation program, drawing on for example traffic and
travel surveys, household socioeconomic sample surveys, participatory rapid
appraisals, social and environmental impact assessments and indicators, and
secondary data from government sources. Where relevant, indicators shall be
disaggregated by gender and socioeconomic status;
d. Produce baseline and subsequent reports; and
e. Evaluate the benefits of the project at completion in accordance with a
schedule and terms of reference to be mutually agreed by the Employer and
ADB prior to project completion

18.18 Assist DPWH in updating the RP or in the preparation of addendum to the RP for
the project with contract package wise disaggregated data, for any additional
impact during civil works and in ensuring that full compensation and assistance is
paid to affected persons prior to civil works. Specific activities include:

a. Assist DPWH in the effective functioning of the Resettlement Implementation


Committees (RIC);
b. Assist DPWH in ensuring the effective functioning of the Grievance and
Redress Mechanism (GRM);

c. Assist in the validation of the list of Affected Persons (APs), affected assets,
and APs who are Indigenous Persons (IPs) or Indigenous Cultural
Communities (ICCs), if any;
d. Assist DPWH in carrying out public information campaign, consultations, and
disclosure of social safeguards planning and monitoring documents;
e. Assist DPWH in the payment of compensation to Affected People (AP);
f. If relocation is necessary, assist DPWH, National Housing Authority (NHA)
and Local Government Units (LGUs) in ensuring development of resettlement
sites with civic amenities and integration of relocated persons with host
population;
g. Assist DPWH, Technical Education and Skills Development Authority (TESDA)
and other relevant government agencies in implementing the
livelihood/income restoration activities;
h. Assist DPWH in maintaining a record of all public meetings/consultations,
complaints and grievances received, and actions taken to address complains
and grievances; and,
i. Assist DPWH in implementing the corrective actions when there is
noncompliance or gaps to social safeguards compliances.

18.19 The Consultant shall implement the approved monitoring and evaluation program
using ‘before’ and ‘after’ studies and other forms of survey and analysis, giving
regard to the project’s anticipated effect on economic and social development as
indicated in the Design and Monitoring Framework for the Project including (a) per
capita income in the project provinces, (b) the volume and type of freight and
number of passengers using the road network in the project area, (c) passenger
and freight vehicle operating costs on the project road and on the project area
road network between key locations, (d) tariffs for freight and passenger
movement between selected locations that indicate the impact of the project on
target groups in the community, (e) the quantity and type of traffic on roads that
form the network within which the project road will be constructed, (f) the origin
and destination of vehicles and traffic at selected locations within the project area,
and (g) the effectiveness of capacity building programs for DPWH staff associated
with the Project.

18.20 Coordinate with DPWH in capacity building activities listed below, but not limited
to:

a. Strengthening knowledge and awareness of DPWH’s key units and those


involved in land acquisition and RP implementation, on provisions in the RP
including ADB SPS (2009)1 ;
b. Requirements and procedures for social safeguards planning;
c. Updating as well as understanding use of the detailed measurement survey
instruments;
d. Conduct of meaningful consultations;
e. Orientation and finalization of detailed plans for livelihood restoration, plan for
compensation disbursement and its required document, and required
documents for grievance handling; and,
f. Monitoring of RP and reporting.

g. Technology Transfer on construction methodology, road safety audit and other


new technologies introduced in the project.

18.21 Pursuant to ADB’s Public Communication Policy (PCP) 2011 and ADB Safeguard
Policy Statement (SPS) 2009, the Facility Administration Manual (FAM) contains a
Stakeholder Communication Strategy (SCS) which aims to increase access to
information about the project, and to improve communication and information
sharing with project-affected people and other concerned stakeholders (including
women and vulnerable groups) throughout the course of the project. A national
communications consultant is expected to provide overall strategic communication
guidance to the project, and:

• Support implementation of the SCS and information sharing;

• Supervise a local communication resource person in implementing SCS activities;

• Actively work with designated Consultant team and government staff in


effectively carrying out the activities set forth in the SCS; and

• Reports directly to the Team Leader of the Consultant, and will work closely with
DPWH point person, ADB designated project staff, ADB’s Principal Operations
Communications Specialist (Southeast Asia Department), Communication
Specialist. The overall framework and direction will be provided by the Team
Leader. The Consultant is expected to perform independently and take initiative
in informing or consulting with the team leader on problem areas and major
constraints.

18.22 Under the supervision of the Communication Specialist, and in coordination with
DPWH and designated ADB Staff, the local resource person will support
implementation of the SCS and information sharing, including:

a. Regular Information Sharing: Ensure a regular flow of information about the


project to affected persons and other key stakeholders at the community level
and through other communication channels, consistent with the methods set
forth in SCS. Ensure project information materials reach target recipients and
are culturally appropriate and in language(s) understandable to the affected
people and other stakeholders. Help ensure mechanisms are put in place to
provide effective notification of construction impacts. Gather information (facts,
quotes, photos) for project communication channels. Ensure the project
Facebook (or any appropriate social media) and Website are regularly updated.
Incorporate the Project’s Grievance Redress Mechanism as part of the project
website. Generate content for all information channels as needed. Support
communication components of road safety awareness;

b. Strengthen and maintain communication network: work to strengthen and


maintain a network of community contacts trusted by different stakeholder
groups to foster dialogue and information sharing;

c. Support for Consultations and Dialogue: Support consultations and/or


interactions between project staff and other stakeholders, pursuant to the

activities set forth in the SCS. Join consultations conducted by the


implementation consultants and DPWH to help ensure questions and concerns
identified during these interactions are meaningfully addressed. Facilitate
relationship-building between communities and the project team. Maintain
regular contact with these stakeholders. Provide communications support for
other project activities (safeguard, grievance, etc.) as needed. Ensure
stakeholder concerns are identified, logged and that key stakeholders
understand how their inputs are being shared and responded to; and,

d. Prepare/ Update Project Information Booklet (PIB): Prepare/ update project


information materials, in coordination with designated ADB and government
staff, to ensure they are culturally appropriate and understood by target
recipients.

18.23 Ensure that full compensation and assistance have been provided to Project
Affected Persons (PAPs) prior to allowing civil works on encumbered sections.
Copies of letters to the contractor handing over sections for civil works, certifying
that all compensation and assistance is paid to affected families in that section
should be submitted along with the monthly, quarterly and semi-annual reports.

18.24 Before start of civil works, the Consultant shall ensure in operationalizing the
grievance redress mechanism (GRM) based on the EIA/RP, to receive and facilitate
resolution of the concerns, complaints, and grievances of the affected people about
the project’s environmental performance, land acquisition, compensation, and
assistance, and make public the existence of this GRM through public awareness
campaigns, assist in the review and addressing environmental, involuntary and
other project related grievances of the affected persons and other stakeholders in
relation to the project, or any of the service providers, or any person responsible
for carrying out any aspect of the project, and assist DPWH in proactively and
constructively respond to such grievances.

IV. ACTIVITIES DURING CONSTRUCTION

A. Civil Works Construction and Organization

19.1 Undertake pre-construction survey jointly with the contractor and the DPWH
representatives. Validate and verify centerline alignment, structure location surveys,
vertical control benchmarks and possible changes in the scope of works considering the
actual field condition. Supervise the preparation of As-Staked Plans/Drawings, Quantities
and other documents, and recommend for the approval of the required modifications or
changes in the design, drawings and quantities due to actual (as-staked) field conditions
and review the said documents, per DPWH Department Order 15 series of 2016
“Guidelines on the Processing and Approval of “As-Staked” Plan” (as amended from time
to time), prior to the approval of the appropriate authorities of DPWH.

19.2 The Employer, through the Consultant, shall furnish for the use of the Contractor all
necessary ground and topographic controls for the establishment of alignment and grades
including work area limits for quarries, haul roads etc.

19.3 The Consultant shall review the Contractor’s construction plan, project control points and
specification.

19.4 The Consultant shall witness and check the Calibration of the Contractor's Plant and
Equipment.

19.5 The Consultant shall review and approve all reports and documents needed to be
submitted by the Contractor prior to start of construction as stated in the executed Contract
Package Contract.

19.6 Organize the supervision of the works with proper allocation of the responsibilities to the
individual inspector and supervise their works in order to ensure that it is effectively
executed.

19.7 The Consultant shall monitor the compliance of the Contractor with the DPWH
Department Order No. 130, Series of 2016 on “Guidelines for the Implementation of the
Provisions of R.A. NO. 6685 and R.A. 9710 or the Magna Carta of Women.

19.8 Inspect and evaluate Contractor’s installations such as housing, shops, warehouses and
other accommodations to ensure compliance with the terms and conditions of the contract.

19.9 Conduct of preliminary inventory of facilities, equipment and other project items in
accordance with Department Order No. 7, series of 2006, Guidelines in the Purchase, Use
and Transfer/Turn-over of Nonexpendable Properties for the Implementation of Local and
Foreign Assisted Projects (or the superseding Department Order thereafter), together with
RMC II-UPMO and concerned DPWH Offices.

19.10 The Consultant shall ensure that the Contractor is maintaining enough equipment until its
completion. The Consultant shall assess the adequacy of all inputs such as materials and
labor provided by the Contractor and his methods of works in relation to the required rate
of progress, and when required, takes appropriate action in order to expedite the progress.

B. Quality Assurance and Materials Control

19.11 In coordination with the DPWH Project Team Leader and Project Engineer, the Consultant
shall inspect fabrication plants locally and abroad, quarries and borrow pits and crushing
plants to ensure adherence to specification.

19.12 Maintain and authorize a representative at the project sites at all times to supervise the
contractor’s work and to issue instruction/s as required. Give notice to the Contractors,
through the DPWH of any defects and deficiencies and recommend appropriate actions.

19.13 Assure the receipt of and maintain records of all warrants required under the terms of
contract documents for materials incorporated in the project. All materials incorporated in
the project and their sources will also be approved.

19.14 Provide timely assistance and direction to the Contractors in all matters related to the
interpretation of the contract documents, quality control testing, and other matters relating
to contract compliance and progress of the project.

19.15 Supervise the operation by the Contractors of the materials testing laboratory, witness the
performance by the Contractors of all sampling, and laboratory testing of materials and
products needed to ensure that the quality as required by the plans and specifications is
obtained and verify the accuracy of the testing results. Maintain proper and complete
records of all tests performed. Inspect works and check materials including testing of
materials in accordance with DPWH standard specification requirements. The verification
of the quality control results of the Contractor shall be undertaken with random quality
assurance tests. A summary of the results of the Contractors’ quality control as well as the
result of the Consultant’s quality assurance control shall form a separate chapter in the
monthly implementation progress reports. The Contractor shall make available their quality
control testing facilities for the required acceptance control tests.

19.16 The Consultant shall accept or reject construction materials intended for use in the project
upon the recommendation of the Materials Engineer based on test results and ensure that
all necessary preparations and procedures have been undertaken in accordance with the
Approval Plans and Specifications before the issuance and approval of the work request.

19.17 Ensure Compliance with the required road International Roughness Index (IRI) for
pavement.

19.18 The quality of materials and quantity of works shall be checked, accepted and approved.
Make certification and recommendation to the DPWH on the Contractor’s monthly claim.

C. Drawings and Project Implementation

19.19 Review and approve all Contractors’ construction/installation methodology, working


drawings, shop drawings, erection drawings, launching plans, and drawings for temporary
works.

19.20 The Consultant shall recommend and revise for approval of the Contractor’s Work Schedule
or revision thereto that the contractor is obliged to furnish for the Engineer’s approval.

19.21 Prepare additional standard drawings as necessary and furnish them to the Contractor on
a timely basis.

19.22 Assess the adequacy of all inputs such as materials and labor provided by the Contractors
and methods of works in relation to the required rate of progress. When required, take
appropriate action in order to expedite progress. Keep and regularly update a list of the
Contractors’ equipment and its condition to ensure compliance with the list of equipment,
which the Contractors provided in his bid.

19.23 The Consultant at all times shall prepare inspection report of all parts of the work of the
information furnished by the Contractor on detailed inspection of the quality of materials
and workmanship, and also prepare monitoring report on the progress of the work at all
times. Should the project incur negative slippage at its early stage, the Consultant shall
require the Contractor in writing to take the necessary measures to catch up with the
approved construction schedule. Should the project incur a negative slippage of five
percent (5%) or more, the Department Order No. 193, Series of 2016 (as amended from

time to time) – “Administrative Actions on Contracts with Negative Slippage.”, and


Department Order No. 90 Series of 2020 (as amended from time to time) – “Guidelines
and Procedures in Terminating Contracts due to the fault of Contractor” shall apply. The
Consultant shall prepare a Daily Work Accomplishment record to effectively monitor the
progress of construction based on the weekly schedule and frequencies of special work.

19.24 Review the effectiveness of the catch-up plans submitted by the Contractor for negative
slippages greater than 5% but not more than 15%. Ensure that the plan of actions
stipulated in the catch-up plans are implemented accordingly.

19.25 Propose and present to the DPWH for approval of any change in the plans, as a result of
any change in site condition due to weather and natural calamities, which may be deemed
necessary for the completion of works including information or any effect the changes may
have on the contract amount and the time of completion of the project, and prepare orders
including altering plans and specifications and other details in accordance with DPWH
existing issuances/policies. Inform DPWH of any problem or potential problems which may
arise relating to the construction contract and make recommendations to DPWH for
possible solutions.

19.26 The Consultant shall refer to: Department Order No. 39, Series of 2024 - Approval of Works
Suspension Order, Work Resumption Order, and Contract Time Extension for Civil Works
Projects; and Department Order No. 11 Series of 2021 – Implementation of Document
Tracking System (DoTS) for Civil Works Projects or its latest amendment whichever is
applicable.

19.27 Organize monthly coordination meetings or whenever required to discuss and resolve
issues and/or problems encountered during the execution of the works and other
relevant/related concerns.

19.28 Inform immediately the DPWH through RMC II-UPMO of the problems or potential
problems that might arise in connection with the prosecution of the contract and
recommend possible solutions.

D. Claims and Audits

19.29 Compute quantities of approved and accepted works and materials and check, certify, and
make recommendations to the DPWH on the Contractor’s monthly claim which is
mandatory, and final payment.

19.30 Assume responsibility for the certification (quality and quantities) of completed works for
each contract.

19.31 Organize and facilitate the conduct of participatory audit for the inspection of works
accomplished prior to payment.

19.32 Review, validate/confirm and facilitate the monthly billings of the Contractors for the works
accomplished for the period covered and submit to DPWH not later than every 5th day of
the succeeding month with complete attachment per DoTS Checklist for processing of
claims.

19.33 Prepare monthly billings of Consultant’s completed services to be submitted to RMC II-
UPMO every end of the month.

19.34 Evaluate claims and disputes that may be brought to the Engineer’s attention by any
concerned party in project implementation.

19.35 Assist in evaluating claims and disputes that may be brought to the Employer’s attention
by any concerned party in project implementation

19.36 Proper coordination with concerned agencies (government and private) maintained by the
engineer.

19.37 All reasonable measures shall be made use of the Engineer to avoid unduly delay, thus
ensuring realization of the project objectives.

19.38 Determine the amount to be added to or to be deducted from payments to the Contractor
for any additional/omitted works, as the case maybe.

19.39 Arrange the execution of works related to the provisional sums in the contract and
determine the value of such works within the scope of the said contract. The Consultant
shall recommend the use of provisional sum subject to the approval of the Employer.

19.40 Secure a complete copy (hard and soft copy) of approved Contractor’s and Consultant’s
billings and shall always be ready to show during audits. The complete set of documents
will be turned over to RMCII-UPMO upon project completion.

19.41 Prepare ledger for each project to properly record and account all the claims of the
Contractor and Consultant.

19.42 Coordinate with the Contractor for monthly disbursement projection to be submitted every
25th of the month.

E. Traffic and Road Safety

19.43 Conduct traffic impact study and review the traffic management and safety schemes
prepared by the Contractors. The Consultant shall see to it that an efficient traffic
management and safety plan for the project is prepared, approved by the concerned
agency(ies) prior to construction, observed, and implemented accordingly during the
construction period. Inspect the safety aspects of construction works and traffic
management and methods to ensure that very reasonable measures have been taken to
protect life and property.

19.44 The Consultant shall ensure that road safety measures including road safety audits are
implemented during and after project implementation and related information is posted
on the project website promptly.

F. Change Orders and Completion of Construction

19.45 Perform all other items of work not specifically mentioned, but which are necessary and
essential to successfully supervise and control the construction activities in accordance
with the plans and specifications and terms of contract.

19.46 Recommend and certify any liquidated damages to be imposed to the Contractors
whenever appropriate due to his failure to complete the project at the approved contract
time.

19.47 Prepare a “punch list” of defective and outstanding works and inspect and provide
assistance to DPWH during the assessment of the works at substantial completion as well
as during the final acceptance of the completed works.

19.48 Before issuance of Certificate of Completion/ Taking-Over Certificate, the Consultant shall
carry-out the necessary inspection, specify and supervise any remedial works to be carried
out on any repair of defect or outstanding works and when completed, issue certificate of
rectification, together with photographs (before, during and after) and recommend to the
DPWH through RMC II UPMO for issuance of Certificate of Completion/Taking-Over
Certificate of the Project.

19.49 Review Contractor’s request for Certificate of Completion/ Certificate of Taking-Over


Certificate and recommend such issuance.

19.50 Review, evaluate/examine and make recommendations to the DPWH any request/claims
of Contractors for time suspension/extension, extra compensation of works or expenses
and other similar items in accordance with applicable clause(s) of FIDIC General Conditions
of Contract, 2017.

19.51 The Consultant shall review quantities accomplished by the Contractor scheduled for
payment and ensure that “As-Built Quantities” are prepared as the work progresses and
finalized.

19.52 Supervise, review, and recommend for approval the “As-Built” drawings prepared and
submitted by the Contractors in accordance with Department Order no 127 Series of 2023.
The Consultant shall ensure that complete “As-Built” Plan/Drawings are submitted within
two (2) months after project completion by the Contractors.

19.53 Evaluate and recommend all requests for change orders, variation orders and time
extensions of the Contractor to the Employer.

G. Environmental and Social Safeguards Monitoring

19.54 Ensure that the projects are constructed and monitored in strict conformity with all
applicable environmental laws and regulations, policies, procedures and guidelines of the
Philippines, ADB’s SPS 2009, agreed in the EIA cleared by the ADB, and environmental
mitigation, monitoring, and adaptive measures detailed in the EMP and its BAP. In case
of any discrepancy between the Philippines law and regulations and the SPS, the SPS
shall prevail. Conduct additional habitat surveys as detailed in the BAP.

19.55 Ensure Contractors maintain records and reports on employment in civil works and core
labor standard compliance with employee data separated by sex, age, minority standards
and residency.

19.56 Shall assist DPWH in the operationalization of the Department of Environment and Natural
Resources – Environmental Management Bureau (DENR-EMB) requirement on the Third
Party Auditor/Multi-Partite Monitoring Team (MMT) (if applicable) for the environmental
monitoring which include air, noise, water, biodiversity, sediment sampling, etc. and
regular meetings which shall be funded under the Environmental Monitoring Fund (EMF)
and part of the Environmental Guarantee Fund (EGF)2.

19.57 Assist DPWH in ensuring that social safeguards monitoring system is in place and ensure
preparation of Semi-Annual Social Monitoring Report (SMR) for submission to ADB in a
timely manner:

a. Assist DPWH in defining the roles and responsibilities of project management


unit staff and coordination agencies (i.e., NCIP, NHA, and local governments)
in respect of land acquisition and RP implementation, and in reporting. This
includes data collection, data analysis, verification, and preparation,
submission, review and endorsement of SMRs;
b. Assist DPWH in establishing procedures and methods for data collection and
analysis;
c. Identify requirements for capacity building for monitoring, as well as budgetary
requirements for capacity building shared by the DPWH-Regional Office and
District Engineering Offices and RMC-II, UPMO;
d. Collect and compile data on progress of land acquisition, payment of
compensation and assistance, relocation, and income restoration activities.
Prepare and submit quarterly monitoring reports (QMR) to DPWH and SMR for
submission to ADB.; and

19.58 Establish database and management information system for easy access of data and
information for use by the External Monitoring Agent/Agency (EMA), and for preparing
the QMR and SMR under the scope of the Consultant.

19.59 Consolidate the results of monthly monitoring into semi-annual environmental monitoring
reports in 10 copies and electronic file to be submitted to DPWH and ADB in a timely
manner.

19.60 Update, in a form and manner satisfactory to DPWH and ADB, the EIA, if any
unanticipated environmental risk and impacts arise, if there are any changes to project
design that would cause environmental risk or impacts not within the scope of the EIA
and submit such updated EIA to DPWH and ADB for review, clearance and public
disclosure on ADB website prior to the implementation of such changes.

19.61 Prepare a new environmental assessment report in compliance with the SPS in the event
there are additional components that are expected to result in adverse environmental
impacts. Such a report shall be submitted to DPWH and ADB for review, clearance, and

public disclosure on ADB’s website prior to the implementation of the additional

19.62 Based on the results of environmental monitoring, identify environmental corrective


actions and prepare a time-bound corrective action plan, as necessary, for submission to
and review by DPWH and ADB.

19.63 Ensure the compliance of the Contractors and the Project on the Climate Change
Adaptation and Mitigation Plan prepared during the DED Stage

19.64 Assist DPWH in ensuring that RP are implemented by the proponent office.

19.65 Assist DPWH in ensuring that GRM is functioning and that procedures are known to the
APs;

19.66 Ensure that social safeguards monitoring is periodically conducted and reports prepared,
reviewed, disclosed, and submitted to ADB.

19.67 Should unanticipated involuntary resettlement impacts come to light during construction,
ensure the conduct of a social impact assessment and update the social safeguards
planning documents or prepare an addendum to the RP covering all applicable
requirements specified in the RP.

H. Stakeholder Engagement

19.68 Develop and implement an overall project communications strategy/ plan in collaboration
with DPWH and Consultant. The communication plan will include stakeholder
mapping/identification and engagement techniques.

19.69 Engage and communicate with various stakeholders, including government agencies,
contractors, and local communities in a manner and form appropriate.

19.70 Facilitate regular meetings and workshops to keep stakeholders informed and address
their concerns.

19.71 The Consultant shall facilitate monthly (or as needed) public meetings in conjunction with
DPWH and concerned local government units (LGUs) to address public concerns.

19.72 The Consultant shall perform Project Information/Dissemination services but not limited
to the following services and instruments, in coordination with the RMC II - UPMO and
Stakeholders Relations Service (SRS) of DPWH, in compliance with the policies, and
instructions of the DPWH:

(i) Project leaflet and poster-electronic and paper-based materials will be


published to disseminate the project objectives and the planned outcomes,
status and other relevant information;

(ii) Articles to be published in national newspaper, journal, magazines, etc.;


and,

(iii) Other forms of project information/dissemination regarding the project.

I. Monitoring and Evaluation

19.73 Shortly after project start-up but not beyond the first year of implementation, the
Consultant shall submit to DPWH a confirmed, updated Project Framework and baseline
data on the performance indicators. Adjustments from the ICC-approved Project
Framework shall reflect changes in actual/current project conditions, including those in
the broader environment within which the project is situated. Any such deviation shall be
explained clearly.

19.74 The Consultant shall monitor and update the construction Risk register, including
implementation/ effectiveness of mitigations and any required corrective actions

19.75 The Consultant shall monitor viaduct substructure construction to confirm that adequate
pile capacity has been achieved and determine appropriate remedial action where pile
capacity is not adequate.

19.76 The Consultant shall analyze embankment consolidation and determine remedial action
to ensure that residual consolidation after embankment/roadway completion is tolerable.

19.77 The Consultant shall develop agreed procedures and criteria for the acceptance of work
at the interfaces between CPs by all parties.

19.78 An annual Results Monitoring and Evaluation (RME) report on the project in 14 copies
with electronic file shall be prepared and submitted to DPWH not later than 30 days at
the end of each year of the project implementation.

19.79 The Consultant shall supervise and monitor the preparation of the construction and
implementation of the environmental and safety measures. Monitor the excavation/
dredging, foundations/ substructures, and superstructures.

19.80 Conduct regular site inspections and prepare daily inspection reports.

19.81 Regularly monitor physical and financial progress in contrast with the Contract to ensure
that the timeline is being duly complied and observed by the Contractor, and take
appropriate action to expedite the progress if deemed necessary. Prepare relevant charts,
diagrams, visual representations for regular coordination meetings.

19.82 Carry out adequate supervision and monitoring of the construction works carried out by
Contractor to ensure timely compliance with the environmental mitigation and monitoring
measures and other conditions set forth in the EMP, to minimize any adverse
environmental impacts arising from the construction and operation of the project.

J. Contract and Loan Management

19.83 Prepare a Contract Management Plan (CMP) for each civil works contract. As a minimum,
the CMP shall involve:

a. Tracking and monitoring the construction activities and their costs, time, and quality;
b. Contractor development to collaboratively improve performance and promote
opportunities for ongoing innovation;
c. Being clear on roles and responsibilities of both employer and contractors;
d. Managing relationships with the contractors and key stakeholders;
e. Managing payments;
f. Being proactive throughout the contract to anticipate problems and issues before they
arise;
g. Ensuring that integrity is observed and upheld throughout the implementation phase
of the contracts; and
h. Managing problems and issues quickly, effectively, fairly, and transparently.

19.84 The CMP should include (a) risk management plan (e.g., risk assessment, risk allocation,
and mitigation plan); (b) contract management strategy (e.g., calibration of resources for
contract administration, identification of key performance indicators, etc.), (c)
communication management, (d) performance management (e.g., monitoring the work
progress and implementation of safeguard management plans); (e) quality management;
(f) contract variations/ claim/ dispute management; (g) contract documents and records
management, and (h) post-closure contract review and reporting of the review finding to
ADB.

19.85 Monitor contract compliance and resolve any contractual disputes that may arise.

19.86 Monitor the compliance of the project based on the loan covenants and
update the project design and monitoring framework as indicated in the FAM.

19.87 In case of implementation period and/or loan validity extension during the
implementation of civil works, prepare necessary documents for the request of
implementation period and/or loan validity extension to NEDA and ADB.

19.88 Prepare necessary documents, reports and/or presentations during ADB Review Mission
throughout the duration of the contract.

V. ACTIVITIES DURING POST-CONSTRUCTION

20. The Consultant shall undertake or be responsible for the following activities post-
construction:

20.1 Conduct of final inventory of facilities, equipment and other project items for turn-
over to appropriate DPWH Offices in accordance with Department Order No. 07,
series of 2006, together with RMC II-UPMO and concerned DPWH Offices.

20.2 Assist the RMC II-UPMO in finalizing the construction-related project accounts,
preparation of other required documents and provide recommendations on any
outstanding claims of the Contractors.

20.3 Make available consultant’s services during the Defects Notification Period (DNP) and
DLP should any problem or other concerns occur during the mandatory one (1) year

DLP on the completed project, the Consultants shall assist the RMC II-UPMO in
resolving said problems/concerns. Supervise and ensure that the Contractors repair
any defects in a proper and timely manner and recommend issuance of the Certificate
of Acceptance.

20.4 Review the “As-Built” Plans prepared and submitted by the Contractor in accordance
with Department Order no 127 Series of 2023, and ensure that the DPWH has been
provided with one (1) full size (A-2 Size) of plans on reproducible stale base materials
(Mylar) and Electronic copy (e-copy) prior to the completion of the post-construction
services, showing final details of 20m cross-section interval of the project as
completed and blue print copy of revised plans indicating changes made thru color
coding, together with all data, records, field books, etc. properly indexed and
catalogued.

20.5 Prepare and submit to RMC II-UPMO fifteen (15) copies and electronic file of the
Project Completion Report/Final Report/Annual Reports after completion of each
contract package (include but not limited to background description/scope,
construction phase, disbursement, accomplishments, activities problems
encountered during construction and actions taken, change orders/variations, time
extension, photographs (before, during and after), Gender Action Plan (GAP) actions
implementation and include qualitative and quantitative data, stories from
beneficiaries including women, conclusion and recommendations, lessons learned
and other substantive matters having an effect on the amount, cost and progress of
the work. Beneficiary related data collected and reported on should be disaggregated
by sex, age and minority status. The Report shall be prepared and submitted in a
manner acceptable and satisfactory to DPWH and ADB.

20.6 Prepare a Project Completion Environmental Monitoring Report after completion of


construction, detailing the status of EMP implementation, outstanding environmental
issues, and time-bound corrective action plan, as necessary.

20.7 The Consultant shall facilitate the consolidation and compilation of all necessary
documents like Field Book, Weather Chart, Construction Progress Report, Summary
of Laboratory Test and Test Reports and other as required of the construction to be
submitted to RMC II-UPMO.

20.8 Assist RMC II-UPMO in the final inventory and turn-over of facilities, equipment and
other project items to appropriate DPWH Offices.

VI. PROJECT ACCOUNTING

21 The objective of the accounting assignment is to ensure that ADB, on an annual basis, is
provided with reliable, comprehensive, and timely information in the form of audited Annual
Project Financial Statements (APFS) in English.

21.1 The Consultant shall ensure that Annual Project Financial Statements, as required
under the loan, are prepared and signed by the Implementing Unit, which will be
then transmitted to the Commission on Audit in a timely manner.

21.2 The project accountant will be under the direct supervision of the team leader and
will be responsible for the following:

a. operating the financial accounting system of the project;


b. ensuring that expenditures submitted to ADB are eligible for financing and all

c. if required, manage banking transactions related to the project and preparing
monthly bank reconciliation statements and reporting;
d. preparing project financial reports and project financial statements; and
e. preparing inputs for the internal and external audits e.g., providing the auditor
with access to all available data, information, legal documents, correspondence
and any other information considered necessary by the auditor.
f. Providing assistance to the Employer in the preparation of all financial
documents required by ADB

ADB is not the only financier is used in accordance with the conditions of the
relevant financing agreement, with due attention to economy and efficiency,
and only for the purposes for which the financing was provided, as detailed in

accordance with the relevant financing agreements, with due attention to
economy and efficiency, and only for the purposes for which they were
provided;
c. monitoring and ensuring that goods, works, and services financed shall be
procured in accordance with the relevant financing agreements including
specific provisions of the ADB Procurement Policies and Procedures and
relevant laws of the Borrower.
d. ensuring that funds disbursed are utilized for the purpose defined in the
relevant financing agreement.

21.3 The content of the project financial statements is expected to include, as a


minimum:

a. A summary of all sources of funds, as well as expenditures against a


classification system that is responsive to the project’s objectives both for the
current fiscal year and cumulative to date, showing ADB funds and counterpart
funds and funding from other sources separately;
b. A summary of expenditures shown under the main project components and by
main categories of expenditures, both for the current fiscal year and
accumulated to date;

reconciliation of the amounts shown as “received by the project from the ADB”
with those shown as being disbursed by ADB; (ii) Statement of Expenditures
(SOE) procedure listing individual SOE withdrawal applications by specific
reference number and amount, and (iii) Statement of Sources and Uses of
Funds
e. The accounting policies adopted and explanatory notes.

21.4 The annual project financial statements follow the format stated in PAI 5.07
(revised in June 2024) and should be submitted 30 days after the end of the fiscal
year within the period agreed with the auditor in the audit terms of reference.

VII. GENDER ASSESSMENT AND ACTION PLAN

22. The Consultant will undertake or be responsible for the following activities related to the
Gender Assessment and Action Plan, to wit:

22.1 The Consultant will engage one (1) international Gender Equality and Social Inclusion
Specialist and three (3) national Gender and Development (GAD) Specialists (GAP
Implementation Consultants) on a full-time basis for each contract package with main
responsibilities to support the Consultant and the DPWH in the implementation,
monitoring, evaluation and reporting of the GESIAP/Gender Action Plan (GAP)

22.2 The specialists will coordinate with responsible parties/other consultants to ensure
timeliness of and success in GAP implementation.

22.3 In addition, the general tasks of the Gender Specialists will include the following:

a. Orient the IA and partner agencies on the GAP targets and activities, partner’s roles
and responsibilities, and expected deliverables.
b. Conduct regular field visits to support and monitor GAP implementation, collect data
reflecting progress on GAP targets and indicators, prepare GAP progress reports (in
table and narrative format), and maintain relevant records and sex-disaggregated
data;
c. Ensure inclusion of the GAP implementation status in the periodic progress reports for
submission and at least quarterly to ADB. Use the GAP monitoring template from ADB
Gender Tip Sheet no. 4 on GAP monitoring and reporting;
d. Initiate and consult with the IA and ADB on adjustments and/or amendments to the
GAP, if necessary;
e. Provide support for ADB review mission teams to ensure that GAP implementation is
being adequately assessed and reported on;
f. Act as the main focal point/contact for all gender related activities between the project
UPMO-RMC II, the ADB country office, Non-Government Organizations and other
consultants;
g. Ensure that gender indicators of the GAP and those included in the DMF are
incorporated into the project’s performance monitoring system and are duly reported
on in the periodic and annual project progress reports;

h. Collect qualitative information for project implementation reports and write human
interest stories or feature articles in relation to the project’s contribution to gender
equality and women’s empowerment;
i. Assist the IA in preparing the Project Completion Report (PCR) by drafting the Gender
Appendix and by providing gender inputs to the main text and relevant sections and
appendices of the PCR.

22.4 Specific tasks related to GAP Implementation include but are not limited to:

a. Review all civil works bidding documents and contracts and monitor contractors’
compliance on maintaining records and submission of reports on employment in civil
works and on labor standards compliance and employee data disaggregated by sex,
age, ethnicity, disability, and residency;

b. Monitor gender targets in relation to construction activities and participation of female


staff in trainings;

c. Work closely with other Consultant to ensure awareness raising program on sexual
harassment, Sexually Transmitted Diseases (STDs), Human Immunodeficiency Virus
– Acquired Immunodeficiency Syndrome (HIV-AIDS), and human trafficking
prevention as well as the road safety campaign are both gender sensitive (review
communication materials and messages) and reach out to the beneficiaries, including
through specific targeting of women beneficiaries and community members where
relevant. Provide support and technical advice to the Consultant in this respect;

d. Liaise with community women’s groups and local government unit to ensure
employment (unskilled, road safety facilitator, climate change activities) and
community consultations/meetings (e.g. for road physical and safety design) related
targets for women are met.

e. Document and consolidate reports and women’s participation in project activities and
benefits;

f. Coordinate and cooperate with the social safeguard team on introducing project
strategies that facilitate women’s equal access and benefits to the compensation
payment allowance paid for affected properties, particularly common properties co-
owned by male and female spouses or siblings;

g. Prepare, facilitate and support the gender training and follow up mentoring (if needed)
for IA staff and DPWH technical staff (on DPWH policies and use of Toolkit on making
Road Infrastructure Projects Gender Responsive) in collaboration with the DPWH GAD
Committee.

h. The Consultant shall comply with the guidelines and procedures of D.O. No. 48, s2011,
Guidelines for Mainstreaming Gender Equality Actions in Road Infrastructure Projects,
and implement the project in accordance with ADB’s Policy on Gender and
Development (1998). It will be ensured that women shall have equal access to project
implementation and benefits including the opportunities to participate in project
planning and implementation.

not limited to regular monitoring and reporting on those specific actions and targets.
HIV/AIDS and STDs prevention and anti-trafficking information for workers and
communities; employment related gender targets for unskilled labor, collection of
disaggregated data.

VIII. FACILITIES/EQUIPMENT/VEHICLES TO BE PROVIDED BY THE CONSULTANTS

22. The Consultant shall provide and maintain a project office in Metro Manila, preferably near
the project site in consultation with the DPWH-LLRN Project Team, to locate the Consultant
core staff, and several members of the DPWH-LLRN Project Team, for the execution of the
services and to facilitate coordination with the DPWH, other Government offices and
departments, to oversee the implementation of all contract packages and to manage and
coordinate interactions between different contractors, ensuring all packages align
smoothly.

23. Other Consultant staff, together with the field personnel of the DPWH-LLRN Team shall
occupy the Facilities for the Engineers at the project site for each contract package to be
constructed by the contractor.

24. The project office shall be fully furnished with office furniture, equipment (e.g.,
communications, computers, software/programs, printers, etc.), and teleconferencing
facilities, including spaces for workstations and conferences to accommodate at least 40
persons.

25. As a minimum, both the project office and facilities for the engineer shall always be staffed
by a senior representative of the Consultant’s organization authorized to make high-level
decisions on behalf of the Consultant relative to this project.

26. In addition, unless otherwise agreed with DPWH, the Consultant shall provide full-time
non-key personnel. These individuals will be assisting the DPWH-LLRN Project Team in
communicating key technical (bridge, highway), managerial (project management advisor,
communication specialist), and contractual issues (contract specialist) (to be charged
under the Provisional Sum). The evaluation of said personnel will be done by the DPWH
LLRN Project Team prior to their mobilization.

27. The Consultant shall provide 12 land vehicles (purchase) and speed boat/s (in rental) up
to the completion of the project (excluding fuel and toll fees but will be included in the
Provisional Sum).

28. The Consultant shall provide additional staff to the Right-of-Way Acquisition Team such as
ROW and Land Acquisition Expert (4), ROW Negotiator (12), and ROW and Land
Acquisition Technical Assistant (16) who will assist in facilitating the ROW process and
procedures for both land and lake acquisition (fish cages, fish pens, etc.), liaise with other
concerned agencies/offices, particularly the Laguna Lake Development Authority (LLDA),
to fast-track the gathering of the necessary legal documents by the PAPs, and support in
the consultation, information, and education campaign. This activity shall be charged

IX. MISCELLANEOUS

29. Capacity Development Training Program (CDTP): The Consultant shall provide the
necessary training program and/or observation tour on projects where new planning,
project management, and construction methods in the country and in abroad that can be
used in the LLRN Project and other future DPWH Projects. Such technologies/approaches
will enhance DPWH officials/engineers with state-of-the-art knowledge and skills in the
fields of project planning, management, and construction. The CDTP shall be charged
under the Provisional Sum.

30. Provisional Sum:

identified risks and includes details about each risk, such as its description, potential
impact, probability, mitigation strategies, and the status of any actions taken to address
the risk, to be submitted annually (in electronic and hard copy).

34. Road Safety Audit Report: The Consultant shall prepare detailed findings of the road
safety audit including recommendations, to be submitted 100 days after commencement
of services (pre-construction audit), and at least two (2) months after project completion
(post-construction audit).

XI. PERSONNEL AND EVALUATION

35. The Consultant’s staff shown in the Table below are the minimum requirements that will
be part of evaluation. The Consultant is responsible for providing experts as they deemed
necessary to complete the requirements of the project. The Consultant shall be composed

38. International Key Experts rated Below Average or non-complying shall be replaced during

39. Non-key experts to be nominated by the Consultant should have the appropriate
educational degree and licenses (if needed) and number of years on professional and
relevant experience. The DPWH has the right to reject any nomination prior to mobilization.

40. The proposed key expert replacements must have appropriate educational degree and
licenses and years of relevant experiences in their field of expertise, as stated in the table
above, that are EQUAL/BETTER than the original nominee. For the proposed non-key
replacements, they should have obtained appropriate educational degree and licenses (if

original nominee. The replacements are subject for approval by DPWH.
