Despite wait and repeated calls since morning, accused persons


have not appeared.
Perusal of record shows that the matter pertains to the year 2018.
On 03.02.2021, appearance was entered on behalf of the accused persons.
However, till date accused persons have not appeared physically before the court
despite being aware of the proceedings. Further accused persons have not
sought bail till date nor furnished any bail bonds. On the LDOH, it was specifically
clarified that the accused persons have to appear in person since matter is at the
stage of framing of notice.
Despite back accused persons have not appeared.
In these circumstances, since accused persons are deliberately
concealing presence despite being aware of the pending proceedings, I deem it
fit to issue NBWs against the accused persons to be executed through Joint CP
concerned.
Ahlmad is directed to mention the address furnished by the accused
persons themselves on the non bailable warrants i.e. Accused No. 5/Venu
Gopal Dhoot : Auto Cars Compound, Adalat Road, Aurangabad, Maharastra
and Mobile no. 9076547409 and qua accused no. 3 Sanjay : Flat no. 101,
Heritage Complex, Kothi, Station Road, Ahmednagar, Maharastra 414001
and phone number 8329076334.
Joint CP concerned is directed to ensure that multiple
attempts are made for the execution of the warrants. Further, Joint CP concerned
is directed to ensure that the statement of two independent witnesses is recorded
at the time of execution of process and copy of their ID card is also be taken.
Joint CP concerned is at liberty to take the assistance of local SHO for the
execution of the warrants and DD entry of the local PS qua the raids
conducted for the execution of the warrants be filed with the report in case
of non execution of warrants.
Copy of this order alongwith the warants be given dasti to Naib
Court ASI Rohtash for service of Joint CP Concerned.
List for report on Joint CP concerned on 21.10.2024.
