Further to your Quotation and subsequent discussions with you, we are pleased to award you the
above-mentioned work on the following terms and conditions.

Terms and Conditions:-

A. General Conditions:
1. Type of Contract:

The Contract shall be on item rate basis on labour, including all tools, curing pipe & equipment’s
required
For completing the job within the agreed timeframe, with superior workmanship and as per
Standard Engineering Practices.

2. Owner supplied material:

Cement, Gujrat River sand, Tiles, tiles adhesive, White cement, shall be supplied by the Owner
free of cost at ground level of plot. All other materials required to complete the work shall be
brought by the contractor.
All material supplied by Owner’s shall be indented by the Contractor considering the lead
time
Required by the Owner. It shall be the Contractor’s responsibility to see that materials should not
be piled up at site. It is expected that the Contractor shall indent only for necessary materials and
there shall be nominal stock of Owner-supplied material at site. The material requirement shall
be carefully worked out in consultation with the Site-In-Charge and ordered to ensure that there
is no surplus / unused material left at the time of completion of the project.

It shall be the Contractors responsibility to ensure the safety of the material supplied by
the Owner and 100% deduction for value of the material shall be made from payments to
Contractor in case of pilferage, damage or loss of materials due to any other reasons. The
Contractor shall report to the Engineer for defects for replacement and in general do everything
necessary for receiving only the correct materials as per specifications. The Contractor shall on
no account remove any materials from the site.
Should the Contractor misuse or cause to be misused, any Owner supplied materials, due
to
abnormal or excessive wastage (as determined by the Engineer), pilferage, improper
storage,damage, deterioration, contamination, unauthorized or unaccounted consumption, or any
other reason, then such materials of same specification, make, brand etc., be replaced by the
Contractor at Contractor’s cost or it will be debited at purchase price or prevailing market price
whichever is higher. On completion of works or at different stages of work any balance or
unused material supplied by Owner shall be returned to Owner in usable condition.

2.1 Cement:
Cement for use in water proofing work shall be supplied by owner free of cost.
Contractor shall returned 100% empty cement bags to the Owner failing which Rs. 2.00/Bag will
be debited to the contractors account. Contractor shall return the unused balance cement bags to
the owner. Same reconcile with each RA bills

3. Scope of Work, Methodology and Mode of Measurement:


The scope of work comprises of Flooring & Tiling works at (Labour) for “PEARL GARDEN”
WING 3A, Residential Buildings at vasai (W), as detailed in as per Architect’s approved design
& drawings. All the tools / tackles / equipment’s / machineries required to complete the work
will be at Contractors cost. Contractor will carry out the work in workmen like manner as per
Architect’s approved designs / drawings / specifications and instructions of Site-In-Charge or his
representative in stages, if required, to suit the site conditions and in co-operation with other
agencies working on site. All the work shall be carried out as per your specification attached as
under. The work shall be carried out without hampering / disturbing the progress of other
ongoing works in the Buildings. If any damage is done to any of the building elements during the
work, appropriate costs will be recovered from the contractor’s bills.

Mode of measurement: Quantities mentioned in the enclosed Bill of Quantities are


Approximate. All payments shall be made as per actual work done at site and measured jointly
with our Site-In-Charge.

4. Subcontract:-
The Contractor will not sublet or subcontract this job in any manner.

5. Payment Terms: -
Based on work progress payments shall be made against R.A. Bills. All the R.A. Bills must be
submitted along with site certificates and measurement sheets certified by our site engineers.
Payment shall be made within 21 days after submission of bill at site. Final bill should be
submitted within 30 days of final completion of work. Retention: 5% of the bill amount will be
retained from each of your R.A. bills,

6. Co-ordination with other Contractors:


The Contractor shall co-ordinate with all other agencies on site (like electrical, lift, door &
window, plumbing Contractor, civil etc.). Co-ordination works indicates that Contractor has to
inform the Owner’s site representative or other agencies appointed by Owner to complete their
work prior to waterproofing works to avoid patch work at site.

7. Cleaning: -
Regular cleaning of the site including shifting of debris generated during his scope of work shall
be done by the contractor to maintain good working conditions failing which the Owner reserves
the right to get it done from the other agency and debit the expenses incurred against the job to
the contractor which will be deducted from Contractor’s RA bill. Debris generated due to
waterproofing work shall be stacked at ground level at a designated place as instructed by site in
charge within plot boundary.

8. Safety: -
a. Labourer’s safety and insurance is contractor’s responsibility.
b. Contractor should take adequate precautions for safety at site by providing safety belts,
helmets, sunglasses etc for workers at site. All temporary / permanent electrical connections
should be checked before work. If any accident occurs due to the negligence of the above

mentioned safety norms the contractor will solely be responsible for the same and compensation
if any will only be payable by contractor.
c. The Owner shall provide space if available for contractor’s materials, tools etc. Making the
Space lockable and secure is contractor’s responsibility.

9. Water and Electricity:


Water & Electric supply at one point shall be supplied by the owner free of cost at Ground level
Or floor level as per feasibility at site. Further distribution shall be done by Contractor at their
Own cost. Curing pipe brought by the Contractor.

Contract Terms & Condition:-


1) That the quotation is on Item rate basis, rates are mentioned in the work order.
2) The contractor shall not stop the work without permission and information except natural
calamities if any on any accounts and if the contractor stop the work except for the reason
stated above. Then in such events the owner shall have absolute right and authority to appoint
new contractor as per their own sweet will and include vents the bill shall be stated mutually
by both the parties.
3) Wearing of helmet is compulsory while working on site if anyone found without wearing
helmet the contractor will have to pay fine for that.
4) Once the work finished at the end of the day contractor should give daily report to Site
incharge.
5) The labour contractor shall prohibit all the labours from consuming liquor, cigarette, Gutkha
etc while working on site.
6) The contractor should have to warn his labours that they don’t bring their children’s at work.
Labours children not allowed on site if any accident incident happens then its contractor’s
responsibility.
7) The labour contractor shall ensure that he has taken insurance of all the labours assigned at
work.
8) The labour contractor must furnish a copy of labour license and labour insurance copy with
the builder and must submit the same at builders office
9) The contractor must submit RA bills attached with detailed measurement sheet of completed
work.
10) The Contractor shall decide the number of workmen required for the completion of the job.
He will review his work as to the number of workmen required from time to time i.e.
decrease or increase the workforce of his job with site in charge coordination .
11) The Contractor shall be responsible for damage or loss to the owner caused due to the
negligence of the workmen employed by him and shall compensate or reimburse the owner
adequately for such loss which shall be assessed and determined by the Owner.

12) The Developer will have right to deduct TDS and any other taxations as applicable from time
to time.
13) All the work carried out by the contractor shall be approved by the Engineer and/or
consultant appointed by the developer. If any work is not upto the mark of the Engineer
and/or consultant then the contractor shall rectify the such work to the full satisfaction of the
Engineer and/or consultant of the developer, without demanding additional charges or
without raising additional bill for the same.
14) The work order/contract is liable to be terminated for the bad workmanship, non-adherence to
procedures, plans and specifications and changes in completion schedule causing delays other
than the changes granted by developers.
15) Termination of the work order /contract by the owner for any reason as mentioned above will
be done by giving 15days notice to contractor.
16) After Termination the work shall be awarded to another contractor of choice of developer to
complete the pending work without taking prior consent from contractor.
The Contractor shall covenant with the specific terms laid down by the Said
Developer which are as under :-
a) No extra items will be entertained. No Advance will be paid to the Contractor.
b) Contractor will have to give one experienced staff on full time basis under the site
Engineer for collection of wastage material and must keep the site clean on Saturday of
every Week.
c) The Developer will give one main electrical point in each floor; the Contractor has to
carry over the same at the required place at his own expenses.
d) The Said Developer will provide space for labour huts with common drinking water
arrangement Huts to be provided by the Contractor, Electrical main supply at outside the
huts provided by the said Developer at night time only.
e) Contractor shall clean or shift debris daily basis, keep area neat and clean.
f) Contractor shall follow the work procedure as per the attached sheet.
g) Repairing of any work due to bad workmanship, Material cost will be debited to
contractor & no labour charges shall be given to the contrfactor.
h) Contractor shall submit reconciliation of each material supplied by owner with each bills
certification done jointly by site in charge.

Payment Schedule
 As per work completion entire building in 5 Part of running invoice to be submitted with
joint measurement with building engineer.
