FACTUAL BACKGROUND
The Employee shall render her services to the Employer for a total of 48 (forty-
eight) hours per week, Monday to Saturday, inclusive. The working day shall
commence at 07h00 and terminate at 16h00, with no fixed meal intervals, and
the Employee is expected to remain available during all working hours. Rest
periods shall not be guaranteed and may be granted at the discretion of the
Employer, having regard to operational needs.
The Employee shall be entitled to annual leave calculated at a rate of 1.17 days
for each month of completed service, to a total of 14 (fourteen) working days
per annual leave cycle. The Employer shall determine the timing of such leave
based on business requirements. Any unused leave shall lapse at the end of
the annual leave cycle unless the Employer, at its discretion, agrees to its
carryover.
Clause 8: Overtime
The Employee acknowledges and agrees that the operational needs of the
Employer may from time to time necessitate the performance of overtime
work. The Employee agrees to work overtime as and when required by the
Employer. Overtime work shall be remunerated at the Employee’s ordinary
hourly rate, irrespective of whether such overtime is worked on
weekdays, weekends, or public holidays.
Where the Employer forms the view, reasonably and in good faith, that the
Employee has committed an act of serious misconduct, the Employer may
summarily terminate this contract without notice or payment in lieu of
notice. Serious misconduct shall include, but not be limited to, violence
or threats in the workplace, wilful damage to property, and
insubordination. The Employer shall be entitled, but not obliged, to
convene a disciplinary hearing prior to the exercise of this right.
The Employer reserves the right to monitor the performance and conduct
of the Employee on a continuous basis. Where the Employee’s
performance is deemed unsatisfactory, the Employer may implement a
performance improvement plan. Failure to show satisfactory progress may
result in disciplinary action, including termination of employment on
grounds of poor performance, at the discretion of the Employer.
