GENERAL REQUIREMENTS

1. SCOPE

The scope as indicated in the General Description of Project is intended to be a general


guide according to which the offer is to be made. The Contractor, while complying with the
Employer’s Requirements shall ensure completeness of scope, even if it is not explicitly
spelt out in the General Description of Project. Any deviation from the Employer’s
Requirements shall be highlighted; however, it does not relieve the Contractor from the
responsibility to provide safe and working plant.

These requirements shall be read and applied, where relevant, with the General and
Particular Conditions of Contract appended herewith and in accordance with the particular
requirements of the Schedules of the Employer’s Requirements.

This Contract also provides for all parts of the Work to be completed in every respect for
commercial operation to the requirements of the Engineer.

Notwithstanding that any particular details, accessories, fittings, sundries etc., required for the
complete installation and satisfactory operation of the plant are not specifically mention in this
Specification, such details are deemed to be included in the Contract Price.

Attention is drawn to the fact that drawings and other documents issued with this tender are
only indicative and may not reflect the actual installations. It is the Contractor’s responsibility
to be familiar with actual site installations and verify the correctness and completeness of
the drawings and documents.

2. GENERAL DESCRIPTION OF PROJECT

The equipment to be supplied under this Contract form part of the Tenaga Nasional Berhad
Transmission System Improvement for Peninsular Malaysia.

The following works shall form part of the contract;

The Works in this Tender is for the supply, erect and testing including all related insurances,
training, placing into commercial operation within the Time for Completion as stated in the
Appendix to Tender and remedy any defects or damage within the Defects Notification
Period, as specified in, but not limited to the scope of work as described in Tender.

Detailed requirement is stated in schedule of requirements i.e Schedule H and Drawings in


Employer’s Requirements.

3. MANDATORY REQUIREMENTS OF OFFERED PLANT

3.1 It is mandatory for any of the following items of Plant and Material, if applicable to
this Contract to be procured from local manufacturers: -

a) 33kV and 11kV Indoor Switchgears (AIS),
b) 33kV and 11kV Indoor Switchgears (GIS),
c) 33/11kV Power Transformers,
d) 33/0.415kV and 11/0.415kV Earthing and Local Transformers,
e) 33kV and 11kV Neutral Earthing Resistors,
f) Multicore, control and LV auxiliary cables,
g) LVAC,
h) Panels for Control, Protection Relay, RTCC (Remote Tap Changer Control),
Fibre Optic Patching, LCC (Local Control Cubicle) for GIS and marshalling
kiosks,
i) 132kV, 33kV and 11kV XLPE Power Cables,
j) Underground pilot cable, optical approach cable, optical fibre cable and
earthing cable,
k) Screen earthing link box for 132kV, 33kV and 11kV,
l) OPGW, ACSR and AAAC conductors,
m) Overhead line fittings, and
n) Steel structures for substations, overhead line towers and underground
cables.

3.2 The contractor shall maximize the usage of locally manufactured goods. The
following items of Plant and Material are available locally and preference is to be
given to local manufacturers: -

(a) 275kV GIS,


(b) 132kV GIS,
(c) 132kV AIS Circuit Breaker & Disconnector,
(d) 132/33kV Power Transformer
(e) 132kV XLPE Cable Joints and Terminations,
(f) ADSS Optical Cable (Aluminium Dielectric Self Supporting)

4. MANDATORY REQUIREMENTS OF JOINT VENTURE PARTNERSHIP

4.1 All partners of the joint venture shall be from locally incorporated companies only.

4.2 The leading partner of the joint venture firm shall be nominated as the executing
partner and the nomination shall be formalized through a Power of Attorney, which
shall be lodged at the High Court of Malaya and to be submitted to the Employer.

4.3 The Power of Attorney shall detail the executing partner’s authority to incur liabilities
and to receive instructions for and on behalf of any and all the partners of the joint
venture. He shall also be authorized to receive payment and to execute the Contract
in its entirety. A statement of all partners’ joint and several responsibilities and
liabilities for the performance and all obligations of the Contract shall be included in
the nomination.

5. MANDATORY REQUIREMENTS OF CONSULTANT AND SUB-
CONTRACTOR

5.1 The Employer has appointed a consultant to do the submissions to the relevant local
authority to obtain approval for development order for the project prior to contract
award. Any further extension of the validity period or amendments to the approved
Development Order, shall be under the responsibility the contractor as per the Local
Authority’s requirement.

5.2 Upon contract award, the Contractor shall be required to employ local, qualified and
approved civil engineering Consultant firm to execute the design, submission of
plans for approval from relevant authorities and to supervise the complete civil works
for substation project. The requirements for the appointment of the Civil Engineering
Consultant Firm are as follows: -
a. Valid registration with the Board of Engineers, Malaysia (BEM).
b. Valid registration with the Ministry of Finance, Malaysia (MOF).
c. Valid registration with Tenaga Nasional Berhad (TNB).
d. The civil engineering consultant firm shall not have more than five (5) contracts
as a civil works consultant for the construction of substations in Grid projects,
Tenaga Nasional Berhad, with any main contractors or Tenaga Nasional Berhad
or the combination of both, in which the Civil Works are currently in progress and
not yet completed.

5.3 The Contractor shall propose to the Engineer, minimum three (3) Civil Work
Consultants for substation projects, in order of preference, after the contract kick-off
meeting. The Engineer will approve one (1) Consultant based on the above
requirements for the contract. The contractor shall be responsible for the performance
of the Consultant and the Works.

5.4 The cost of civil engineering consultancy shall be deemed included in the Contract
Price. The Contractor shall not be entitled to any claim in cost for complying with this
clause.

5.5 If the Contractor opts to sub-contract the substation civil works (not inclusive of
preliminaries works), they shall propose to the Engineer, minimum three (3) sub-
contractors for civil works. The requirements for the appointment of the sub-
contractor for civil works are as follows: -
a. Valid registration with Bahagian Pembangunan Kontraktor dan Usahawan
(BPKU) of Bumiputra Status
b. Valid registration with Construction Industry Development Board (CIDB) in the
required Grade according to the value of civil works.
The Engineer will approve the appointment of sub-contractor for civil works.

5.6 If the Contractor decides to do the civil works themselves, they shall present proof
that they have the capacity, resources and capabilities of executing the works for the
approval from the Engineer.

5.7 Any nominated sub-contractor during tender shall deemed to be acceptable unless
propose otherwise by the contractor for Engineer’s approval.

5.8 The Contractor also shall propose to the Engineer plant erector for all types of works
i.e substation, overhead line and underground cable. The plant erector shall at least
have a valid registration with Construction Industry Development Board (CIDB).

6. LABOUR AND MANPOWER

6.1 This Clause shall be read together with Clauses 4 and 6 of the General Conditions
and Particular Conditions of Contract. In addition, the following Sub-Clauses are also
applicable to the employees of the Contractor and Sub-contractors.

6.2 The Contractor shall possess adequate administrative, technical and site staff to
complete the project in accordance with the specifications and contractual terms and
conditions throughout the duration of the Contract. In particular, the Contractor shall
maintain the personnel under full time employment by the company as declared in
Schedule of Project Team and Organisation comprising of Project Manager, Site
Engineer, Safety and Health Officer (SHO), Site Supervisor (Electrical and Civil) and
Site Safety Supervisor.

6.3 The Project Manager shall not have more than two active projects to manage
concurrently. Active project is defined as a project where physical progress has
started, until commencement of Site Acceptance Test (SAT).

6.4 The Contractor shall provide adequate number of experience & competent erection /
stringing teams and machineries & tools and shall be available for the execution of
the project.

These teams and machineries & tools shall consists of: -


(i) At least one (1) tower erection teams, with minimum 8 personnel per team.
(ii) At least one (1) stringing teams, with minimum 15 personnel per team.
(iii) Machineries & Tools – at least one (1) Pullers and one (1) Tensioners.

6.5 It is preferred for the Contractor to employ Bumiputera professionals, skilled and
unskilled workmen in the execution of the Contract.

6.6 Changes in key personnel during the execution of the Contract shall be promptly
notified to the Engineer as provided under General Conditions of Contract.

6.7 In the event where the work is unavoidable, or necessary for the protection of life or
property or for the safety of the Works, the Contractor may be instructed to work
during rest day or after normal working hours. The work program shall take into
account these constraints, and extension of time (EOT) will not be considered for
such occasions. The costs of all the works shall be deemed included in the
Contract Price.

6.8 The Contractor shall make all arrangements necessary with regards to
accommodation for his staff or labour, either foreign or locally recruited, during site
construction works. The Contractor shall not build any temporary or permanent living
quarters for worker’s accommodation within the work site.

7. WORKS WITHIN HIGH VOLTAGE ZONE

7.1 The requirements of Competent Person(s) are as following:


a) The Contractor shall nominate individual(s) holding valid Certificate(s) of
Competency issued under the Electricity Regulation 1994, of the Electricity
Supply Act 1990 (Act 447), who shall be the immediate charge for the
construction and installation/erection works within High Voltage Zone(s),
b) Certified copy of the Certificate stating the type of competency and limitations, if
any, to be submitted for verification by the Employer’s Personnel,
c) All works by Contractor, Contractor’s Representative, Contractor’s Personnel
and Sub-Contractors in a High Voltage Zone shall be carried out under a
Permit-To-Work (PTW) issued to the named competent person(s), and
d) The competent person(s) is required to be present for the whole duration of
the above works.

7.2 High Voltage Zone(s) is defined as: -


(i) an outdoor or indoor enclosure containing accessible High Voltage
Apparatus or
(ii) A pole which supports High Voltage circuits or
(iii) Above the anti-climbing device on a steel tower, structure or pole supporting
High Voltage circuits.

8. EXCHANGE RATE AND CURRENCY

Any increase of foreign exchange rates during contractual period shall not be the
subject of price increase in the Contract Price.

9. INCOME TAX ACT

9.1 The Contractor shall adhere to the latest Malaysian Income Tax Act. The Contractor
is responsible to make payments for any applicable tax and withholding tax in
accordance with the Act to the Inland Revenue Board (IRB).

10. INSURANCE

10.1 The Contractor shall effect the following insurance policies as detailed in the General
and Particular Conditions of Contract:
(a) Marine Open Cover (MOC) (for all modes of conveyance, including cover for
incidental / intermediate offsite storage),
(b) CEAR – Construction and Erection All Risk,
(c) WCI - Workmen Compensation Insurance

10.2 For Marine Open Cover, the premium rates shall be as per the latest guideline from
Insurance Management Department.

10.3 It is mandatory that the Contractor use the services of insurer(s) appointed by
Insurance Management Department (IMD), Finance Division of TNB for all related
insurances and all modes of conveyance. The Contractor shall liaise directly with
IMD for procurement and payment of these facilities as follows: -
(a) Transportation of goods from supplier or manufacturer to project site.
(b) Temporary storage of goods at third party store for less than 3 months and
valued less than RM10 million shall be notified to the insurer.

10.4 Project Insurance is CEAR and WCI insurances for the Works inclusive of Free
Issued Plant and Materials. The CEAR shall also cover ‘Principal
Existing/Surrounding Property (PEP/PSP) which is 15% of the Contract Price
stated in the Agreement. The insurance shall be valid throughout the
construction work period and any extension of time until the issuance of
performance certificate.

10.5 Any variation in the insurance premiums after the award of contract shall not be
imposed on the Employer.

10.6 If the goods need to be stored offsite for a period of more than 3 months or if the
goods are worth RM10 million or more, the Contractor shall inform the Engineer, so
that suitable insurance policy shall be effected.

11. SHIPPING AND DOCUMENTATION

11.1 The Contractor has to ensure all shipping documents shall be consigned under TNB.

11.2 The shipping marks for all consignments shall be as follows: -

11.3 It is mandatory that the Contractor use the services of TNB’s panel of Multimodal
Transport Operators (MTO) for any shipment of equipment under the scope of this
contract. Failing which, the Employer has the right to withhold payment for the
transportation portion of the invoice submitted. The use of TNB’s panel MTO
services shall in no way relieve or diminish the responsibilities and obligations of the
Contractor under the provision of the Contract.

11.4 The Contractor shall liaise directly with Freight Management Unit, Integrated
Material & Services Management Department (IMSM), Procurement & Supply Chain
Division of TNB for the list of operators and any matter related to freight, Custom
clearance and import duties/Sales Tax.

12. TAXES AND DUTIES

12.1 All material price for this contract shall be based on Delivered at Place (DAP)
INCOTERMS 2020.

12.2 Price Structure of the contract shall be as follows:

(A) MATERIAL COST

(a) Foreign - Nett price of imported finished product/Plant delivered directly to


project site/store without having to undergo fabrication/ assembly
by local manufacturer. Nett price shall include all costs involving
freight, marine insurance, inland transportation inclusive related
insurances and any incidental charges. The Contract Price shall
exclude all import duties, excise duty, duties or fees imposed by
any Competent Authority on equipment or plant (including
spares) imported into Malaysia. In summary, all taxes and duties
levied on finish product (including but not limited to Materials,
equipment, Plant and spare parts) to be incorporated into the
Works under this Contract, if any, shall be solely borne by the
Employer.
Any increase in taxes at the country of origin shall not be the
subject of price increase in the Contract.

(b) Local - Nett price of locally manufactured/assembled finished Plant and


Material delivered directly to project site/store. Nett price shall also
include all costs of freight, marine insurance, inland transportation
inclusive of related insurances imported duties, taxes and any
incidental charges of all imported parts. Any Sales Tax paid by
tenderer to a local manufacturer should be regarded as part of
material cost in the calculation of tender price and shall not be
charged separately as ‘Sales Tax’ in the tender price.

(B) ERECTION - Cost of installation, and related testing and commissioning works,
and remedying of all defects during Defects Notification Period
after the issuance of Taking Over Certificate.

(C) GRAND TOTAL

(A) Material Cost (a +b) + (B) Erection = Tender Price. This is the amount
to be entered in the Letter of Tender.

12.3 The Contractor shall note that all unit prices quoted shall be firm throughout the
duration of the Contract and any claim for Cost Price Adjustment (CPA) shall not be
acceptable.

12.4 The Contractor shall assist the Employer to obtain exemptions of the relevant duties
and taxes in relation to importation of equipment or Plant (including spares) and
locally manufactured equipment and Plant (including spares) which are to be
incorporated into the Works including completing and filing all necessary
documentation for tax exemption applications. The application shall be completed
four (4) months prior to the arrival of equipment at the port of arrival (for imported
equipment) or project site (for local equipment).

12.5 The Contractor is also required to tag or label the Works with the reference number
and date of the tax exemption approval obtained from the Competent Authority. The
equipments shall have a marking plate of non-corrodible material upon which shall
be engraved with the following:

1. Primary Equipments:-
Material : 1. Aluminum tag with stainless steel chain (Outdoor)
2. Plastic tag riveted to equipment. Black letters on yellow
background. (Indoor)

2. Control Relay Panel:-


Material : Plastic tag riveted to equipment. Black letters on yellow
background. (Indoor)

3. Overhead Lines:-
Material: Aluminum Tag with Stainless Steel Chain
Location of tag: Starting tower (Minimum 2 no.)

12.6 The Contractor is advised to familiarise himself with the Customs Regulations
regarding the importation of Plant and Material into the country especially those that
are available locally.

12.7 The supplier/vendor must forward the relevant shipping documents such as
commercial invoice, packing list, bill of lading and airway bill at least 7 days before the
cargo departs from the port of loading to the Supply Chain Control Tower (SCCT) to
avoid delays during the customs clearance process as well as high port penalty
charges.

12.6 Sales Tax can be included also because when a product is imported using DAP, it
involves two cost of element which are Import Duty and Sales Tax imposed on the
product which is bought. TNB is responsible to pay to the Malaysian Customs
Department.

13. MANDATORY TYPE TESTS AND SPECIAL TESTS

13.1 It is mandatory that all equipment to have been successfully type tested in
accordance with the standards, as stipulated in the Employer’s Requirements, and
the type test report will remain valid in accordance with Specification in Employer’s
Requirement (Technical Specification) as long as there is no significant change in
the design as allowed by the standard. Only type test report from TNB’s approved
laboratories or manufacturer’s laboratories accredited to ISO/IEC17025 are
acceptable.

13.2 For tests to be conducted after contract award, the Contractor shall submit for the
Engineer’s approval, the proposed laboratory, the equipment to be tested and the list
of tests to be conducted. Information on the proposed laboratory is to be provided,
including the related accreditation body and its scope of accreditation.

13.3 The Contractor shall complete all the outstanding tests in line with the approved
Work Program to meet the required completion date. Failure to fulfill this condition
shall result in the rejection of the Plant and Material. The Contractor shall then be
required to offer an acceptable type of Plant and Material that have passed all the
type and special tests without any time and cost implications to the Employer.

14. CONFORMANCE TO SPECIFICATION AND SCHEDULE

14.1 It is the responsibility of the Contractor to ensure that all equipment offered fully
complies with the technical requirements stated in the specifications and schedules.

14.2 Any exemption from compliance to the technical requirements is not allowed.
Nevertheless, if due to particular reasons an exemption is to be considered, it is the
responsibility of the Contractor to declare if there is any deviation in term of design,
material technical specification, manufacturer process or country of origin, to the
Engineer.

14.3 The Contractor shall get a written consent from the Engineer prior to manufacturing
if there is any deviation from the specification or Schedule.

15. NOMINATED SUB-CONTRACTOR FOR TESTING

15.1 The whole scope of Test on Completion as described in Substation Product

Substation) is under the Contractor’s responsibility. But the Employer intends to
nominate a testing company (Tester) as a Subcontractor to undertake the scope of
testing as detailed out below: -

15.3 The Employer shall nominate a Tester prior to the SCA process. The Contractor shall
not employ the same testing company to perform the tests under the Contractor’s
scope.

15.4 The Contractor shall ensure that all OEM tests and inspections under the Contractor’s
scope are duly performed and make a declaration that all Plants under the contract are
ready for testing before the Tester commences testing. The period(s) for testing works
shall be incorporated in the time program for the Contract.

15.5 The appointment of the Tester shall not in any way exclude the responsibility and
obligations of the Contractor towards the Employer. The Contractor shall defend and
indemnify the Employer from and against any and all actions, loss, damage, liability,
penalty, cost and expenses and payment obligations (including without limitation
reasonable legal fees), save to the extent that such loss, damage and liability is
caused by the error, default, negligence or omission on the part of the Employer.

15.6 The Contractor is required to cost in the Contract only the portion of testing that is
assigned to be under the Contractor’s scope and responsibility. The items meant for
this cost are coded TEST in the Schedule of Prices.

15.7 The cost of managing, coordinating and supervising the testing works executed by
the Tester, shall be included in the contract. The items meant for this cost are coded
TEST/SUPV in Schedule of Price. The testing scope assigned to the Tester is
described in Schedule L (Testing Requirements) and is only meant to facilitate the
Contractor to do the costing for the supervision. It shall not be construed as the final
and approved list of tests to be carried out under the contract.

15.8 The Employer shall pay directly to the Tester for the works assigned to him under
this Contract.

15.9 If the Contractor fails in his deliverables, causing distress or cessation of works for
the Tester, claims can be made against the Contractor for the Tester’s mobilization
and demobilization.

15.10 If the Contractor for this Contract is also registered with TNB as a testing company,
the Employer shall nominate a different company as the Tester.

16. PENALTIES FOR NON-PERFORMANCE AND FATAL ACCIDENT

16.1 Action shall be taken according to the terms and conditions of contract on non-
performing Contractor or fatal accidents caused by lack of care by the Contractor.

16.2 The Contractor shall be subjected to further penalties as follows: -

i) Suspension from participating in TNB’s future procurement exercise for a period


1 to 3 years. (subjected to approval committee). Penalty period depends on the
committee approval.
ii) For second offence, de-registered and banned from participating in any of TNB’s
future procurement exercise. For companies that have been de-registered, the
directors and majority shareholders shall also be blacklisted. During the
suspension period, vendors are banned from participating in any TNB’s future
tender/direct negotiation. The penalty period for the second offence starts after
the suspension period for the first offence has ended

17. PENALTIES FOR TRIPPING

17.1 The Contractor shall exercise the degree of care and skill ordinarily exercised by a
duly qualified contractor performing the same or similar works.

17.2 With regards to the works to be performed by the Contractor pursuant to the terms of
this Contract, the Contractor shall be liable to TNB, for any acts or omissions due to
willful misconduct or gross negligence of the Contractor and its subcontractor in
performing the services on the part of the Contractor, where such said acts or
omissions of the Contractor shall cause damage or loss to TNB.

17.3 In particular, for any tripping incident that is caused by the negligence or breach of
any technical requirements by the Contractor, the Contractor shall be penalised as
follows:

17.4 The number of tripping incidences will be accumulated for all contracts being
executed by the Contractor.

18. WITNESSING OF FACTORY ACCEPTANCE TEST (FAT)

18.1 Witnessing of FAT by the Employer’s Personnel or it’s Representatives shall be as


per Switchgear Specification Substation Product Testing and Inspection in the
Employer’s Requirement (Technical Specification – Substation).

18.2 The cost of witnessing of the FAT by the Employer’s Personnel or Representatives
shall be borne by the Employer.

19. PERFORMANCE SECURITY (PS)

19.1 The contractor is required to submit Performance Security within 56 days from the
date of Letter of Acceptance.

19.2 The Employer reserves the right to penalize the Contractor based on the terms and
conditions of the contract and/or suspend or withhold any payment due if a valid
Performance Security is not received within the stipulated time.

19.3 The Performance Security shall be valid throughout the time for completion until six
(6) months after the end of the Defect Notification Period and shall be as per the
format for Performance Security as attached in this tender. Failure to use such
format gives the right to the Employer to reject the Performance Security submitted.

19.4 In the event of any Variation or Extension of the Time for Completion is effected on
the Contract, the value or/and validity of the Performance Security shall be adjusted
accordingly.

20. ASSESSMENT OF TRANSFORMER LOSSES

20.1 The current values used to evaluate the cost of losses of the transformer and power
required for operation of cooling equipment based on the capitalized cost per kW of
no-load losses are as stated in the TNB Technical Specification
(Transformer/Shunt Reactor General Specification).

21. TNB ACCEPTED RELAY LIST

21.1 TNB Accepted Relay List enclosed in the tender document shall serve as reference
for tendering purposes only. The successful Tenderer shall supply relays based on
the TNB Accepted Relay List prevailing at the time of contract award and the
models to be supplied shall be declared at the contract kick-off meeting.

22. PROJECT SAFETY REQUIREMENT (PSAFE)

22.1 The contractor shall comply with the legal and other requirement pertaining to
Occupational Safety, Health & Environment in Malaysia, the latest Health, Safety,
and Environment Requirement for Contractors and Safety Compliance Audit
Guideline (SAFCA) as stated in contract document.

22.2 The contractor shall fill up the Schedule of Price for PSAFE item in BQ according to
the table of the contract cost for PSAFE as follows:

Liquidated Damages as mentioned in Schedule of Payment for PSAFE will be
imposed through the following options: -
i. Progress Payment;
ii. If progress payment is insufficient, Legal Action option will be taken.

22.4 The Contractor is reminded to comply with the applicable law of the country as per
clause 1.13 of General Condition of Contract.

In this respect, the Contractor shall comply to Section 29 of the Occupational Safety
and Health (OSH) Act 1994 that requires Safety and Health Officer (SHO) to be
employed by the Contractor. Nevertheless, SHO is compulsory for all type of project
irrespective of contract value. The Contractor shall also appoint a Site Safety
Supervisor (SSS) according to Regulation 25 of the Factories and Machinery
(Building Operations and Works of Engineering Construction) (Safety) Regulations
1986 (BOWEC) for the safety supervision on construction activities within the site.
The SHO and / or SSS shall be certified by Department of Safety and Health
(DOSH) and the certification shall remain valid throughout the entire contract period.

22.5 The Contractor is also reminded to comply with the Regulation 13 of the
Occupational Safety and Health (Classification, Labelling and Safety Data
Sheet of Hazardous Chemicals) Regulations 2013 and to ensures that: -

1) A supplier shall furnish a Safety Data Sheet (SDS) to a chemical recipient for
each hazardous chemical (or a mixture thereof) supplied.

2) A Safety Data Sheet shall contain the information relating to a hazardous


chemical supplied and chemical mixture referred to in sub regulation (1)
according to the following headings and order:
(a) identification of the hazardous chemical and of the supplier;
(b) hazard identification;
(c) composition and information of the ingredients of the hazardous
chemical;
(d) first-aid measures;
(e) fire-fighting measures;
(f) accidental release measures;
(g) handling and storage;
(h) exposure controls and personal protection;
(i) physical and chemical properties;
(j) stability and reactivity;
(k) toxicological information;
(l) ecological information;
(m) disposal information;
(n) transportation information;
(o) regulatory information; and
(p) other information.

3) The Safety Data Sheet information should be in the national language and
English language

4) The Safety Data Sheet information must be the latest version, i.e. not more
than five years from the date of preparation.

5) The supplier shall furnish the revised Safety Data Sheet under sub-regulation
(4) to the chemical recipient as soon as practicable after such revision.

22.6 TNB Life-Saving Rules (LSR)

Tenaga Nasional Berhad (TNB) applies Life-Saving Rules. These rules are based on
safety standards, which are intended to prevent serious or fatal accidents. Failure to
comply with TNB LSRs shall result to blacklist / termination being imposed to the
contractor’s workers/contract.

TNB LSRs are as follows;


1) isolate, earth and test before touch
2) use fall protection
3) valid permit to work mandatory
4) prohibition working under suspension load
5) obtain authorization before entering confined space
6) no phone while driving
7) wear arc flash suit when switching (not applicable)
8) wear helmet/safety belt. No speeding
9) no drugs/no alcohol

22.7 For any violation against Occupational safety and Health legislation in Malaysia or
non-conformance against TNB HSE Requirement, which might lead to accident, the
following shall be imposed.

First offence i) The individual shall receive a Red Card and,
ii) banned from entering all project site under the
authority of the Engineer for a period of not less than
thirty (30) days and,
iii) the SHO and/or SSS shall be banned from entering all
project site under the authority of the Engineer for a
period of not less than thirty (30) days (only if proved
due diligence is not carried out in mitigating the
offense) and,
iv) the Contractor shall be served with a show cause
letter.
Second offence For any violation(s) under the clause 22.7,
i) the individual shall receive a second Red Card and,
ii) banned from entering all project site under the
authority of the Engineer for a period of not less than
one (1) year and,
iii) the Contractor shall be served with a show cause
letter.

22.8 For any unsafe conditions or unsafe acts other than mentioned in clause 22.7, the
following shall be imposed.

ii) NOI to the Contractor if deemed necessary.
Second offence For any violation(s) under the clause 22.8,
i) the individual shall receive a second Yellow Card and,
ii) banned from entering all project site under the
authority of the Engineer for a period of not less than
three (3) days.
Third offence For any violation(s) under the clause 22.8,
i) the individual shall receive a third Yellow Card and,
ii) banned from entering all project site under the
authority of the Engineer for a period of not less than
thirty (30) days and,
iii) the SHO and/or SSS shall be banned from entering all
project site under the authority of the Engineer for a
period of not less than thirty (30) days (only if proved
due diligence is not carried out in mitigating the
offense) and,
iv) the Contractor shall be served with a show cause
letter.

22.9. Notwithstanding the consequences mentioned in sub-clause 22.7 and 22.8, if the
individual received at least one (1) Red Card and one (1) Yellow Card (in no
particular order), the individual shall be banned from entering all project site under
the authority of the Engineer for a period of not less than six (6) months.

23. DELIVERY OF POWER TRANSFORMERS TO SITE

23.1 The Contractor shall be required to declare to the Engineer the date required for the
delivery of the power transformers to site. The Contractor is responsible to ensure
that the site is ready for delivery and installation of power transformers, which will be
supplied by others.

23.2 Any deviation from the declared date shall be informed immediately to the Engineer.
The Contractor shall be held liable for any additional cost incurred such as storage
and/or transportation due to delay caused by the Contractor.

24. WORK PROGRAM

24.1 The Contractor shall prepare, update and submit the softcopy of Work Program
using Microsoft Project Professional (*mpp format) comprising the original, actual,
and revised work program consolidated into one (1) work program as requested by
the Engineer /Engineer’s representative. The work program must be relevant as
practical as possible.

24.2 The work program reporting requirements guideline shall be as provided by the TNB
project team during the Project Kick Off Meeting (KOM).

24.3 The Contractor must ensure that Baselines are set and S-Curve report is generated
via Microsoft Project Professional as per the guideline and templates provided.
Percentage complete reported in the Project Progress Report must tally with the
Work Program.

25. FIVE YEARS WARRANTY BY ORIGINAL EQUIPMENT MANUFACTURER (OEM)


FOR SUBSTATION

25.1 Original Equipment Manufacturer (OEM) shall furnish product warranty of up to five
(5) years (inclusive of Defect Notification Period) starting from the date of
commissioning. If the Equipment is procured as spares, the warranty shall start from
the commissioning date.

25.2 List of the 132kV Equipment and higher are listed in General Specification of the
Employer’s Requirement.

26. CONSTRUCTION WORK PERMIT (CWP)

26.1 In line with FIDIC Clause 4.1: Contractor’s General Obligation; The Contractor shall
be responsible for the adequacy, stability and safety of all Site operations, of all
methods of construction and of all the Works. The Contractor shall, whenever
required by the Engineer, submit details of the arrangement and methods which
the Contractor proposes to adopt for the execution of the Works.

26.2 In order to increase and enhance safety and health practices of all on-going and
future projects involving overhead line, underground cable and substation in
greenfield and brownfield projects for Grid Development (Construction), TNB Grid
Division is now introducing and imposing a new permit system which is
Construction Work Permit (CWP).

26.3 Details of Construction Work Permit (CWP) are as follows: -

27. TAGGING SYSTEM

ii. Safety vest with printed designation of SHO/ SSS/ GCQP/ RAA/ EO/ TL
for Safety and Health Officer (SHO), Site Safety Supervisor (SSS), Grid
Contractor Qualified Person (GCQP), CWP Receiving Authorized Authority
(RAA), Environmental Officer (EO) and Team Leader (TL).

iii. Tagging sticker for Competent Person and Construction Worker. Tagging
sticker of outdoor waterproof type shall be printed with respective worker’s
photograph and QR code.

Particular QR code shall be able to display the worker’s following details:

a. Photograph
b. Name
c. ID Number (I.C./ Passport)
d. NTSP & CIDB Expiry
e. Competency Certification Expiry Date
f. Record of Red Card & Yellow Card received.

iv. Competent person and construction worker that enters TNB site shall be
identified by SHO/ SSS and tagging sticker shall be displayed on the Safety
Helmet. SHO/ SSS shall check the compliance of Tagging System during
Toolbox Talk.

27.3 The contractor shall be responsible towards the compliance of Tagging System
which consists of Safety Helmet color code, Safety Vest with printed designation and
Tagging Sticker.

28. PROJECT QUALITY ASSURANCE (PQA)

28.1 A Project Quality Assurance (PQA) audit is a scheduled audit exercise carried out to
ensure the integrity of all new installations / plants prior to commissioning /
energising.

28.2 PQA is viewed as a mechanism to asses any new facility prior to handing over to
the Grid Maintenance (GM) department or the Distribution Network Division of TNB.

28.3 All Grid Facilities shall be subjected to PQA before any commissioning or
energization works, and handing over of the asset or plant.

28.4 The PQA process for any new installation / plant shall cover two (2) phases :

1a Civil – Earthworks And Piling

For PQA during the earthworks and piling works stages, inspections will be
carried out, and defects/non conformances found will be recorded and notified
to the relevant Project Director (PD). These NCRs shall be resolved or closed
within the stipulated time and all evidences be recorded.

1b Electrical – Erection

PQA will be conducted upon completion of electrical equipment erection,


passed SCA and completion of OEM test. During the electrical erection stages,
all defects shall be declared in master defect list and all defects shall be
resolved prior to Final PQA.

2a PQA Documentation Check

Prior to site verification tests, the Contractor and TNB shall be required to
attend an audit or inspection of all documentation to ensure its accuracy and
completeness.

2b PQA Site Verification

The objective of the site assessment is to verify safety and reliability of all the
plants including civil works, primary equipment and secondary / protection
scheme before handing over to TNB.

28.5 The contractor shall be responsible to plan the PQA activities to comply with
Contract requirements and timeline to ensure compliance to TNB project
requirements.

28.6 A scoring mechanism will determine the ‘Pass’ or ‘Fail’ result in the PQA activities at
both Phases 1 and 2. At the Phase 1 PQA stage, the contractor must achieve a
score ≥ 85% to proceed to the Phase 2 stage.

28.7 PQA Validity

All installations that have passed the Final PQA (at Phase 2) would have to be
energized within a month (or maximum 30 days) from the PQA date. Any
commissioning or energizing date which past the 30 days validity period would be
subjected to selective retests, at the discretion of TNB prior to energizing.

28.8 Penalties for PQA Failure

With regards to the works as stipulated under the Contractor, the Contractor shall be
liable to TNB, for any delay due to failure in performing the services on the part of
the Contractor, where such said acts or omissions of the Contractor shall cause
damage or loss to TNB.

Any work delay due to repeated PQA failures, the contractor shall not be
eligible for Extension of Time (EoT).

In addition, for the Final PQA (Phase 2), any ‘Fail’ result acquired by the contractor
would be subject to financial penalty as stipulated below :

Note : Where the works are to be commissioned in stages, the proposed financial penalty
will be divided accordingly, i.e.

i. where 2 PQAs to be conducted, penalty to be split based on work staging


(e.g. Stage 1: RM50,000 and Stage 2 : RM50,000).

ii. where 3 PQAs to be conducted, penalty to be split based on work staging


(e.g. Stage 1: RM30,000, Stage 2 : RM30,000 and Stage 3 : RM40,000).

29. SITE COMMUNICATION

29.1 The contractor shall prepare its overall strategy for communication of all matters
relevant to HSE both within the organization at site and external parties. This section
shall be read in conjunction with HSE Requirement for Contractors.

29.2 Daily Toolbox Talk

Contractor shall ensure that daily toolbox talk is conducted at the beginning of each
Works. Toolbox Talk must be conducted at least by SHO/SSS or by designated PIC.
All daily toolbox record must be kept at project site office and accessible by TNB for
review.

The toolbox talk shall address the requirement of HSE rules and procedures
(including MS, JSA, HIRARC, ERP, PTW and policies) related to the Works to be
carried out and as per current Works at site.

The contractor is required to share with workers any incident/ accident/ near miss/
potential incident/ red & yellow card issued/ unsafe act/ unsafe condition from
previous working day during daily toolbox talk.

Toolbox talk shall be adhered as per TNB’s internal instruction.

29.3 Emergency

The contractor shall develop a site emergency response plan for the project. This
plan should identify the potential for incident, accidents and emergency situations.
Emergency Response Plan should address the prevention of occupational safety
and health risk and environmental pollution associated with them. The approved
ERP shall be communicated and understood by all site personnel and to be posted
at prominent location in the site.

The contractor shall identify and assign designated emergency assembly point at
site and communicated with site personnel. Adequate signage shall be provided
throughout the site to direct or guide personnel to the emergency assembly point in
an emergency situation

29.4 Supervision of Overhead Line project

The contractor shall provide loudhailer and binocular for the use of Team Leader
and Watchman to constantly supervise, remind, communicate and monitor linesman
to maintain lanyard and fall arrester 100% tie-off for overhead line projects.
