The work “Improvement of Road Safety and

283 (near Manchinillabavi, Gandhinagar Upparipet
chowrastha ,Reliance Petrol Pump, Chelgal Mango Market) by
permanent measures like Widening of Existing Carriageway 2 lane
paver shoulders to 4 Lane, Road safety provisions from Km 93/000
to 96/037 of NH-63 Nizamabad to Jagdalpur section in the state of
Telangana” was entrusted to M/s. Sree Sai Ram Enterprises,
Hyderabad Vide reference 1st cited with a stipulation period to
complete the work within 12 months period from the date of
agreement and the scheduled date of completion of work as per
Agreement was 23-03-2024.
Vide reference 2nd cited already the Engineer-in-Chief (R&B)
NH CRF & Buildings, Hyderabad granted extension of time up to
30.06.2024 without imposing any liquidated damages.

The agency has completed around 87.089% of work till


16.06.2024 which is within the extended period of agreement time
except widening of Minor Bridge at Km 95/756.

The contractor vide reference 3 rd cited has requested for


grant of Extension of time up to 18.09.2024 and stated that about
87.089% of work was completed within the granted EOT period
and the balance work could not be completed by mentioning the
following reasons as stated below.

1. There is an existing Municipal water pipe lines


passing along the road in Jagtial town limits which are
falling within the proposed widening portion of the
Bridge at Km 95/756 are proposed for shifting as per
request of Municipal Commissioner Jagtial vide letter
No.184/MCJ/E1/2024, DT:- 30.03.2024 the estimate
for shifting and replacing of pipe line was submitted
to highr authorities for an amount of Rs. 60.00 Lakhs
and the same was approved by Regional Officer, NHAI
Hyderabad vide NHAI letter No.
NHAI/RO-HYD/13017/8/RSC/2024/491, DT: -
13.06.2024.
2. The COS for the above is under consideration of
higher authorities and utility shifting work at Km
95/756 will be completed after obtaining the approval
to the COS.

The Deputy Executive Engineer (R&B), NH Sub Division,


Jagtial stated that the reasons submitted by the contractor are
genuine and recommended for sanction of EOT up to 30.09.2024
without imposing any L.Ds.and also requested to approve the
revised Milestone program as submitted by the contractor.

In view of the reasons submitted by the Contractor and also


as recommended by the Deputy Executive Engineer (R&B) NH
Sub- Division, Jagtial it is recommended for sanction of EOT up to
30.09.2024 without any L.Ds .
The letter as submitted by the contractor along with the
revised milestone program and the recommendations from DEE,
NH Sub –Division Jagtial are enclosed for ready reference.

The above work was entrusted to us vide SE (R&B) NH Karimnagar Agreement 1 st cited with a
stipulated time to complete within twelve (12) months from appointed date i.e., before 20.03.2024. The
appointed date was given by the SE (R&B) NH Karimnagar on 21 st Day of March 2023 vide his “letter No.
SE(R&B) NH/KRMR/SAP/NH-63/CHALGAL/2022-23/1037 Date: 21-03-2023”.

Salient features of the Contract Agreement: -

The details of Handing over of the ROW (Right of Way), clearance given for removal of various hindrances
are given under:

a) Handing Over of the Land: Project ROW length 3.037 km was handed over on the appointed date
after a delay of one month from the date of agreement. However, there are various hindrances in
the form of Trees, Municipal & Mission Bhageeratha Water Supply Lines, Electrical Lines etc., The
work got delayed due to delay in providing Tree cutting permission by Forest department.
b) Work front availability free from Hindrances:
1. Work font available is NIL as on Appointed Date as there was Hindrance due to existing 114
No.s of old Trees having girth (diameter) ranging from 2.00 m to 5.00 meters which are very
near to existing two-lane paved shoulders.
2. Shifting of Electrical power lines are also hindrance to the work.
3. The authority Engineer has applied for permission for cutting and uprooting the old trees and
for shifting of Electrical lines to the concerned Departments.
4. The Divisional Forest Officer has accorded the felling permission on 06-05-2023 vide his letter
No. R.C No. 1114/SBA/2023, Copy of letter enclosed. The cutting of trees started. The time
taken for cutting of trees and uprooting them about three (3) months i.e., 06-08-2023.
5. For shifting Electrical lines the NPDCL (Northern Power DistributionCo.Ltd) has accorded
permission subject to payment of Security Deposit of 2.5% (two and half) percent of
estimated cost of shifting of Electrical lines after lapse of 87 days vide their letter dated 16-
06-2023 copy enclosed. The Security Deposit of Rs. 65,122 /- was paid by NHAI through
online on 30-08-2023 copy of payment receipts is enclosed. Shifting of Electrical lines and
relocating commenced and simultaneously widening work was also commenced.

The above details of clearances & hindrances along road side, the Milestones to be achieved as
per Contractor Agreement, delayed by 163 days i.e., up to 30-08-2023.

As the tree cutting was completed by July-2023 and the shifting of Electrical lines started in Sep-
2023, simultaneously the widening work was also commenced. The progress of work achieved as per
Mile Stones is tabulated below.
In view of the above and taking into consideration the non-availability of work front for 163 days,
were determined as Extension of Time required for all Mile Stones. The Extension of Time for completion
of whole work i.e., Mile Stone – IV up to 18th-Sep-2024 is requested.

Hence, keeping the delays in giving hindrance free reach to the contractor as shown in Table-I, to
grant Extension of Time to each of the Mile stones and for the completion of the project as per Clause
19.11 of EPC Agreement as per the above Table-II without imposing Liquidated Damages and without
restriction on Price Adjustment.
In this regard, it is to submit that work font available is NIL as on Appointed Date as there were
Hindrances at site.
a) Approval for clearing Hindrances in 3.037 km was accorded by Forest clearance on 06-05-
2023 for tree cutting.
b) Approval for clearing hindrances in 3.037 was accorded by concluding agreement for shifting
of Electrical lines on 30-08-203
c) Hence as on 30-08-2023, the hindrances like Shifting of Electrical lines and relocating
commenced and simultaneously widening work was also commenced.

In view of the above the Extension of 1st 2nd& 3rd& 4th Mile Stones/Scheduled completion date is
requested up to 10-01-2024, 14-04-2024, 15-06-2024&18-09-2024 respectively, As the Financial Progress
achieved as on 15-06-2024 is 87.089%. The completion of work within available work front of 3.037 is
herewith recommended to 18-09-2024.

I, therefore requested for grant of extension individual Milestones and completion of the project
1. Extension of Time for Milestone-I is requested up to 10-01-2024.
2. EOT for Milestone – II is requested up to 14-04-2024.
3. EOT for Milestone – III is requested up to 15-06-2024.
4. The balance works in this Milestone up to 18-09-2024 needed as the work of Widening of 01
No’s Minor Bridge(At Km 95/756) and Laying of Bituminous Concrete work in completed
bridge approaches need to be completed.

Due to delay in getting hindrance free Road from Trees as well as shifting of Electrical lines etc., it
is requested to grant Extension of Time for the proposed Mile Stones I, II, III&IV as mention in the above
table without imposing liquidated damages and without restriction of Price Adjustment.

In view of the above, it is requested to communicate the approval of Mile stone with respect to
granted extension of time period as above from the Competent Authority at an early date.

43.719% of work was completed within the agreement period and
the balance work could not be completed by mentioning the
following reasons as stated below.

1. There were about 114 large size old trees existing in


proposed widening portion of the road and causes enormous delay
of 06 Months in obtaining cutting and felling permission from
Forest Authorities hence the work got delayed. (Trees cutting
permission copy enclosed).

2. The shifting of electrical lines permission was accorded by


Chief General Manager Operation-1 TSNPDCL Warangal on turnkey
basis and erection of new electrical poles and lines took
considerable time and caused further delay in starting widening on
both sides of the road. (Electrical lines shifting permission letter
copy enclosed).

At present the entire Sub-grade, GSB, WMM and DBM level


works completed in full shape and the balance work i.e., re-
construction and widening of 04 No’s of Minor Bridges are in
progress and Stating the same the contractor has requested for
Extension of time up to 30.06.2024 without levy any Liquidated
Damages to complete the balance work in all respects.

The Deputy Executive Engineer (R&B), NH Sub Division,


Jagtial stated that the reasons submitted by the contractor are
genuine and recommended for sanction of EOT up to 30.06.2024
without imposing any L.Ds.

In view of the reasons submitted by the Contractor and also


as recommended by the Deputy Executive Engineer (R&B) NH
Sub- Division, Jagtial it is recommended for sanction of EOT up to
30.06.2024 without any L.Ds.

recommendations from DEE, NH Sub –Division Jagtial are enclosed
for ready reference.
