In compliance of the aforesaid orders of the Hon'ble High Court the

petitioner was called for personal hearing on 25.04.2025. She has attended the same and
submitted her representation in this office on 25.04.2025 vide which she has requested that she
has completed normal tenure at` her pres6nt place of posting i.e GSSS Hobar, Distt. Chamba,
H.P and she fiuther requested that she may be transferred/adjusted in Distt. Kangra, against
vacancy/ longer stayee by clubbing histher previous stay.
From perusal of record, it has been found that the petitioner is working at
GSSS Hobar, Distt. Chamtia w.e.f. 23.11.2021 wherein the enrollment of students is 151
(Aprx.).AtpresentpostofTGT0VM)arenotlyingvacantintheabovementionedschool.
As per provision contained in comprehensive guidelines Principles -2013
for regulating the transfer of State Government employees, it is specifically mentioned in para
12.1 "All employees during their period of service will serve for at least single tenure in
tribal/difficult/Hard area and remote/rural areas. Transfer to a particular place of choice cannot
be claimed as a matter of right. It will be the discretion of the State Govt., to post/transfer any
employee anywhere in the State, keeping in view of the administrative exigencies/convenience."
Therefore, being a State cadre Government employee, the request of the petitioner is not tenable
and hereby rejected.

Mandi, against vacancy/ longer stayee by clut)bing histher previous stay. The above writ
petition was listed before the Hon'ble High Court, Himachal Pradesh on 07.03.2025 when the
Hon'ble High Court has passed the following orders:-
"4. I;ooking into the nature Of the grievance raised in this writ petition, the

petitioner is permitted to prefer a representation within two weeks from t_oqay. _In _case, such
representation is so 'pref erred, the competent authority shall consider and decide _th_e ::in.e, i.n

communicated to the petitioner.
The writ petition stand disposed Of in the above terms, so peso the pending
miscellaneous application(s), if any. "
In compliance of the aforesaid orders of the Hon'ble High Court the
petitioner was called for personal hearing on 25.04.2025. He has attended the same and

From perusal of record, it has been found that the petitioner is working at
GMS Keoli u/c GSSS Thunag, Distt. Mandi w.e.f. 16.03.2018 wherein the enrollment of
students is 10 (Aprx.). At present post of TGT 0VM) are not lying vacant in the above
mentioned school.

"5. Consequenlty, in view Of the above, this Court without going into the

merits Of the case deems i| fit to dispose Of the present petition with a direction to the
respondents to consider and decide the pending representation Of the petitioner expeditiously,
prefierably within a period Of four weeks. Ordered accordingly. Needless to say, authority
concerned, while affording opportunity Of hearing lo the petitioner shall also tak; note Of tie

Sirmaur, H.P. against vacancy/ against longer stay by clubbing histher previous stay radius of 30 Kms. .
From perusal Of record, it has been found that the petitioner has been working at
GHS Jutrahan u/c GS9S Nadal, Distt. Chamba, H.P. (Hard Area) since 22-11-2019 and has completed
• his normal tenure at present place, of posting. One Smt. Sapna Devi, TGT(NM) is working in GSSS

Nalna Tikker, Distt. Sirmaur, H.P. since 19-02-2022. The petitioner has given willingness for his transfer
to the aforesaid school against longer stay by clubbing histher previous stay within radius of 30``Kms.
Keeping in view of the position stated above, the representation of the petitioner js considered
sympatheticay, and He is hereby transfer GHS Jutrahan u/c GSSS Nadal, Distt. Chamba, H.P to GSSS
Naina Tikker, Distt. Sirmaur H.P. without TTA/JT vice Smt. Sapna Devi, TGT(Niv[) against longer stay
by clubbjng her previous stay within radius of 30 Kms. with TTA/JT of Smt. Sapna Devi, TGT(NM).
The representation of the petitioner is disposed of accordingly.

GMS Baghar u/c GSSS Dhabas, Distt. Shimla, w.e.f. November, 2021 wherein the enrollment
of students is 32 (Aprx.). At present post of TGT (NM) are not lying vacant in the above
mentioned school.
As per,provision contained in comprehensive guidelines Principles -2013
for regulating the transfer of State Government employees, it is specifically mentioned in para

• From perusal of record, it has been found that the petitioner has been working at

GMS Janghi, U/C GMSSS Mehla, Distt. Chamba, H.P. (difficult Area) since 03-01-2022 and has
completed his normal tenure at present place of posting. One Sh. Akshay Kumar, TGTO{M) is
working in GSSS Boda, Distt. Kangra, H.P. since 16-06-2021. The petitioner has given willingness for
his transfer to the aforesaid school against longer stay by clubbing histher previous stay within radius of
30 Kms. Keeping in view of the position stated above, the representation of the petitioner is considered
sympatheticay, and He is hereby transfer from GMS Janghi,.U/C GMSSS Mehla, Distt. Chamba,
H.P. to GSSS Boda, Distt. Kangra, H.P. vice Sh. Akshay Kunar, TGTavM) against longer stay / by
clubbing his previous stay within radius of 30 Kms. with TTA/JT to Sh. Akshay Kumar, TGTO").
