APPLICATION FOR AMENDMENT OF PLAINT


RESPECTED SIR,

The applicant/plaintiff respectfully submits as under:

1. That the plaintiff has instituted the above-captioned suit before this
Honourable Court for recovery of rent amount from the defendant.
2. That in the originally filed plaint, the plaintiff inadvertently
claimed recovery of rent from the year 2009 to 2025, along with
annual 10% increase, whereas the actual claim intended to be made
was for recovery of rent from the year 2020 to 2025 only,
including the agreed 10% annual increment.
3. That the error occurred due to a typographical mistake and
misstatement, and the plaintiff now seeks to confine and clarify his
claim specifically from the year 2020 onwards till 2025, along
with 10% annual increase in rent as per tenancy
agreement/practice.

4. That the proposed amendment is necessary for the proper and
effective adjudication of the matter and to avoid multiplicity of
litigation.
5. That the amendment neither changes the nature of the suit nor
prejudices the rights of the defendant, rather it clarifies and limits
the scope of the claim.
6. That this application is being made in the interest of justice, equity,
and fair play.
PRAYER

 In view of the foregoing, it is respectfully prayed


that this Honourable Court may graciously be
pleased to allow the plaintiff to amend the plaint as
stated above and permit submission of the amended
plaint accordingly.
 Any other relief deemed just and appropriate in the
circumstances may also be granted.
