OBSERVANCE OF TRIAL (CIVIL AND CRIMINAL)
Brief Facts:
1.The appellant, S.J. Hussain, filed a civil suit seeking recovery of ₹3,00,000 that he had
loaned to the respondent, K.L. Sampath Nagaraj, on 10.06.2019. In support of repayment, the
respondent had issued a post-dated cheque.
2.However, the cheque was never presented for clearance. Based on this, the trial court
dismissed the suit, stating that the cause of action was incomplete without cheque
presentation or dishonour.
3.The appellant contended that the cheque was only a collateral mode of payment and that the
legal liability arose from the oral loan transaction, which was independently enforceable.
Trial:
The Hon’ble High Court of Madras, while hearing the appeal, observed that the trial court
had committed a serious legal error by restricting the existence of a cause of action to the
dishonour of the cheque. The Court clarified that the existence of a loan agreement itself
gives rise to a legal cause of action, and the presentation or dishonour of a cheque is not a
precondition to maintain a suit for recovery.
The Court emphasised that cheques are not the origin of liability, but merely a mode of
discharging pre-existing debt. The underlying transaction—the loan given and acknowledged
—was sufficient to institute the suit. By focusing only on the cheque, the trial court had failed
to appreciate the broader contractual context.
Accordingly, the High Court allowed the appeal and directed the trial court to proceed with
the case on merits. This judgment reinforces that substantive justice must prevail over
procedural formalism, especially in civil cases where documentary or oral evidence supports
the existence of liability.
CRIMINAL CASE OBSERVATION
Brief Facts:
1. The petitioner, Jayaram, a Village Administrative Officer (VAO), was convicted by
the trial court under the Prevention of Corruption Act for allegedly accepting a bribe of
₹1,500 to process a patta transfer and land survey.
2. The complaint was based on the testimony of a land applicant who alleged that
Jayaram demanded a bribe and accepted the amount, which was recovered from him during a
trap laid by vigilance officers.
3. Jayaram challenged the conviction, contending that he was not the competent
authority to process the application and that the tainted money was not recovered from his
person in a manner consistent with legal procedure.
Trial:
The Hon’ble High Court of Madras, upon re-examining the evidence, found serious flaws in
the prosecution’s case. It observed that the essential ingredients of demand and acceptance of
illegal gratification had not been established beyond reasonable doubt. The Court emphasised
that under the Prevention of Corruption Act, mere recovery of tainted money, without proof
of demand and voluntary acceptance, is not sufficient for conviction.
The Court also noted discrepancies in the witness testimonies and procedural lapses in the
trap operation. The complainant’s evidence lacked consistency, and the prosecution failed to
establish a clear link between the bribe and the official act. The judgment made reference to
settled precedents, including P. Satyanarayana Murthy v. District Inspector of Police, where
the Supreme Court held that proof of demand is indispensable for conviction under Sections 7
and 13 of the Prevention of Corruption Act.
Based on these findings, the High Court set aside the conviction and acquitted Jayaram. The
judgment serves as a reaffirmation of the principle that criminal convictions must rest on
unimpeachable and legally admissible evidence, and that investigative agencies must strictly
comply with legal safeguards to ensure fair trials.

CIVIL CASE:
A landowner residing in Kanchipuram approached a local advocate regarding a boundary
dispute with his neighbour. The client owned agricultural land that had been in his family for
generations. Recently, the neigh-boring landowner began cultivating beyond the accepted
boundary line, encroaching on the client’s land by approximately half an acre. The client had
old survey maps and patta documents supporting his claim but had never erected a physical
boundary.
Upon raising objections, the neighbour claimed the land in question was part of his property
as per a more recent survey document. Tensions escalated when the neighbour began
constructing a fence, prompting the client to seek legal advice before the situation worsened.
Observations:
●The advocate welcomed the client calmly and allowed him to fully explain the situation,
recognising the emotional strain caused by the land dispute. He ensured a non-judgmental
and confidential atmosphere.
●The advocate carefully examined the client’s documents, including the old patta and
revenue records. He explained the importance of updated land records and recommended
getting a fresh government survey to clarify boundaries.
●He advised the client to immediately send a legal notice to the neighbour to halt
construction until the boundary dispute is resolved and suggested filing a suit for permanent
injunction if the issue persisted.
