AGENCY (TEMESA)

We, the undersigned, declare that:

(a) We have examined and have no reservations to the Tendering Document,


including Addenda No.: AE/006/2022-2023/COP/T/G/01/05 LOT 01 & 02 -
Category 212, 12/04/2023

(b) We offer to supply in conformity with the Tendering Document and in


accordance with the response times specified in the Schedule of Requirements
the following Supplies and Related Services under a framework contract
arrangement SUPPLY OF AIR CONDITIONERS AND SPARE PARTS USING
FRAMEWORK CONTRACT TO TEMESA

(c) We understand that any resulting contract will be a framework contract, with
estimated quantities, and that you will not be bound to purchase any Supplies,
with the exception of any guaranteed minimum value;

(d) The total price of our Tender, excluding any discounts offered in item (d)
below, is: One hundred and seventeen million nine hundred forty four
thousand five hundred and ninety nine Tanzanian shillings
(117,944,599.00 TZS)

(e) The discounts offered and the methodologies for their application are:

Unconditional discounts. If our tender is accepted, the following discounts shall


apply. NIL

Methodology of application of the unconditional discounts. The discounts shall


be applied using the following method: NIL

Conditional discounts. If our tenders for more than one lot are accepted, the
following discounts shall apply. NIL

Methodology of application of the conditional discounts. The discounts shall be


applied using the following method: NIL
(f) Our tender shall be valid for a period of 120 DAYS calendar days from the
date fixed for the tender submission deadline in accordance with the Tendering
Document, and it shall remain binding upon us and may be accepted at any
time before the expiration of that period;

(g) We, including any subcontractors or suppliers for any part of the contract
resulting from this procurement process, are eligible to participate in public
procurement in accordance with ITT Clause 3.1

(h) If our tender is accepted, we commit to obtain a Performance Security in


accordance with the Tendering Document in the amount of 11,794,459.90
TZS i.e Eleven million seven hundred ninety four thousand four
hundred fifty nine Tanzanian shillings and ninety Tanzanian Cents. for
the due performance of the Contract;

(i) We, including any subcontractors or Suppliers for any part of the contract, have
nationals from the following eligible countries TANZANIAN

(j) We undertake to abide by the Code of Ethical Conduct for Tenderers and
Suppliers during the procurement process and the execution of any resulting
contract;

(k) We are not participating, as Tenderers, in more than one tender in this
tendering process, other than alternative tenders in accordance with the
Tendering Document;

(l) We do not have any conflict of interest and have not participated in the
preparation of the original Schedule of Requirements for the Procuring Entity;

(m) We, our affiliates or subsidiaries, including any subcontractors or Suppliers for
any part of the contract, have not been suspended by the Public Procurement
Regulatory Authority in the United Republic of Tanzania from participating in
public procurement;

(n) The following commissions, gratuities, or fees have been paid or are to be paid
with respect to the tendering process or execution of the Contract

(l) We understand that this tender, together with your written acceptance thereof
included in your Letter of Acceptance, shall constitute a binding contract
between us, until a formal contract is prepared and executed;

(m) We understand that you are not bound to accept the lowest tender or any
other tender that you may receive.
