Memorandum in public interest at large for common passage

Residents - Common man of revenue estate at village Sarai Khatela in District


Palwal, whole community is facing major hardship and discrimination, without
common passage, which was unlawfully acquired for NTPC by Government,
breaching public trust and legal human rights, without replacement, left farmers
without common passage. Hardship and discrimination, with general public.

It is humbly submitted, that:

1. I am custodian of the land bearing kila number 4-14/1, measuring 6 kanal


19 marla, situated under the revenue estate of village Khatela Sarai in
District Palwal, on this land Scouts and Guides for Animals and Birds,
along with OIPA: Indian People for Animals, functioning a Gaushala cum
Temple, under Om Parkash Maturchaya: Jeev Kalyan Vatika.
2. Land bearing kila number 4-14/2, measuring 1 kanal 1 marla, situated
under the revenue estate of village Khatela Sarai in District Palwal, is a
part of 2-acre land acquired for NTPC, left without common passage,
which was owned by a group of people, who have 2 acre, 1 kanal and 1
marla land, owned within revenue estate of gram panchayat Khatela, but
acquired for NTPC, only 2 acres, left without common passage 1 kanal
and 1 marla, in-between Gaushala with Hindu temple, and boundary wall
of NTPC.
3. Aam passage for 3 Hindu Temples for worship, Gaushala - Shelter for
animals in distress, along with community people and other farmers, land
owners, within revenue estate of gram panchayat Khatela Sarai, their
common passage – Aam rasta acquired for NTPC unlawfully, confirmed
by the Divisional Commissioner at Gurugram in his remand.

Kindly refer to the Haryana Government, Power Department, Notification dated


December 21, 2006, through which 75 Acre, 1 Kanal and 2 Marla land was
acquired for NTPC, including common passage / aam rasta of many land lords,
and Gram Panchyat, Sarai Khatela received Rs. 17.00 lacs for 6 Kanal, 5 Marla
land of aam rasta / common passage, as awarded for Khasra 171/1.

Whereas, Commissioner of Gurugram Division, admitted these facts, that


Government adopted wrong method, while acquiring common passage without
replacement, beside Gram Panchyat, misuse the compensations received,
against common passage, committed offense against Society, hence:

1. Common passage be granted with compensations for major hardship to


effected parties, restoring their human rights, with penalty to public
servants and proper investigation of utilisation submitted and accepted
with bad intention, adopting corrupt practices, creating heavy loss to the
public funds, which was received by gram panchayat against aam rasta.
2. STOP discrimination, exposing black sheep of the system. Proper
utilisation be checked, and re-audited about amount received by the Gram
Panchyat Sarai Khatela, against land and aam rasta acquirement, for
NTPC. Metal road be constructed, without any delay, in public interest, at
large, restoring their rights. Status report of 45 kanal Gaucharand, use of
this land, removing encroachment.
