Contract of Lease (1)
JENALYN L. CASTRO, of legal age, Filipino, and a resident of 115 Trasierra St., Legaspi Village Makati Philippines,
hereinafter referred to as the LESSOR;
-and -
JESSA MAE SAGARAL and a resident of Camella Homes Villa Kananga, Butuan City Philippines., hereinafter referred to
as the LESSEE.
WITNESSETH:
WHEREAS, the LESSOR is the registered owner of a residential building constructed at West Highlands, Butuan
City.
WHEREAS, the LESSOR hereby leases unto the Lessee and the latter hereby accepts in lease from the former,
subject to the following terms and conditions, to wit:
1. MONTHLY RENTAL: The LESSEE agrees to pay monthly rental to the LESSOR in the amount of P 60,000.00
php payable on or before the 28th of the month. It is understood that the payment of the rental as herein
stipulated shall be made without the necessity of an expressed demand and without delay on any ground
whatsoever. If after the TWO (2) month advance rental is already consumed, LESSEE will immediately vacate
and return to the LESSOR the leased premises without the need of any demand from the LESSOR.
Upon execution of this CONTRACT, LESSEE, shall pay unto the LESSOR an amount of P
180,000.00_, Philippine currency, representing two months advance and one month deposit rental,
respectively, LESSEE, hereby undertakes not to charge future payment of lease against the deposit of two
months. Such deposit shall be returned unto the LESSEE upon expiration of this contract, less whatever unpaid
consumption of light, water and other bills and damages on walls or any part of the unit that may have been
incurred upon the property by reason of LESSEE usage thereof except the normal wear and tear and of those
by fortuitous events. All bills including monthly HOA dues are to be paid by the LESSEE.
2. LEASE PERIOD: This lease shall be for a period of twelve months ( 1 YEAR) , starting June 28, 2025;
renewable for the same period under the same terms or of different terms as the herein parties may come to
agree.
3. IMPROVEMENTS/ALTERATION/ADDITIONS: The LESSEE shall have the right to construct, install, set-up and
introduce anything into the premises partitions, lights, fixtures, furniture and such other effects and
improvements as may the LESSEE may deem proper, but in no case shall the same be made without the prior
knowledge and written consent of the LESSOR and that the improvements made will not deface or can cause
damage to the leased premises. It is agreed that any alteration and improvements to be made will be
shouldered by the LESSEE.
4. REPAIR AND MAINTENANCE AND OBSERVANCE OF SAFETY AND CLEANLINESS: The LESSEE takes
care of the leased premises as a good father of the family by making necessary minor repairs without need of
consent from LESSOR, such as repair and improvements of doors, holes in the walls, windows, electrical
malfunction, and for the repair of other similar problems as the situation may require the LESSEE to do so or
upon the approval of the LESSOR.
5. USE OF THE LEASED PREMISES: It is hereby agreed that the leased premise shall be used by the LESSEE
for residential purposes only, LESSOR reserves the right to inspect the leased premise necessitating their entry
therein, provided that such intent shall be made known to the LESSEE or to any of his/her authorized
representative of anybody in the household of sufficient age and discretion at least twelve (12) hours prior to the
intended inspection.
6. DAMAGES: The LESSEE shall be responsible at all times for all acts done by his/her relatives, agents or
employees and other persons entering the leased premises insofar as the enforcement of the provisions of this
contract is concerned. Any damage or injury to the leased premises due to the fault of the LESSEE, his/her
relatives, agents, employees, and/or servants or other third persons who may have gained access to the leased
premises shall be repaired promptly by the LESSEE at his/her exclusive expense. Only damages caused by
natural calamities or by force majeure unto the leased premises shall not be charged against the LESSEE. The
LESSOR, however, shall not be responsible for any loss or damage which the LESSEE may sustain in the
premises, due to any causes whatsoever.
7. PRE-TERMINATION: In case of pre-termination of this Lease Contract, the LESSEE shall give advance notice
to the LESSOR at least one (1) month prior to the intended date of the pre-termination. It is likewise expressly
agreed that all utility bills incurred by the LESSEE in the leased premises shall be first settled before any pre-
termination of this lease Contract shall be considered valid and effective. Should the LESSEE fail to comply with
such condition, this contract shall be deemed to be in full force and effect and the LESSEE shall continue to be
liable for the monthly rentals stipulated herein. Pre-termination of the lease contract by the LESSEE will also
result in the loss of the two (2) month(s) non-refundable security deposit.
The parties acknowledge that the property is intended for sale, and the Lessor reserves the right to sell the
Premises at any time during the lease term.
In the event that a buyer is secured and a sale is finalized, the Lessor shall provide the Lessee with a
written one (1) month advance notice. The Lessee shall have the right to remain and consume the one-
month notice period before vacating the Premises.
No further rent shall be due for the notice period if it has already been paid in advance. The Lessee agrees to
vacate the property peacefully by the end of the one-month notice period.
8. VIOLATION: Violations by the LESSEE or any provision of this contract especially on the non-payment of any
rentals when due as agreed upon is a ground of ejectment. In case of court suit, LESSEE hereby agrees to
submit himself/herself to the exclusive jurisdiction of the court of Butuan City. Interest, penalties and other
charges are cumulative plus whatever damages incurred thereon. Violation of any of the above terms and
conditions by either party shall cause the rescission of cancellation of this contract and the said premises shall
be vacated peacefully by the LESSEE for the LESSOR.
If said premises be not surrendered at the end of the term, the LESSEE shall likewise be responsible to
the LESSOR shall suffer by reason thereof.
The failure of the LESSOR to insist upon a strict performance of any of the terms, conditions and
covenants hereof shall not be deemed a relinquishment or waiver of any right or remedy that said LESSOR may
have nor shall be construed as a waiver of any subsequent breach or default of the terms and covenants herein
contained, which shall be deemed in full force and effect. No selling of rights be made on the leased premises
by the LESSEE, upon the termination of this lease contract however, LESSEE should return the leased
premises to the LESSOR.
9. BINDING EFFECT: This lease agreement supersedes and renders void any and all undertakings, oral and/or
written, previously entered between the parties covering the property herein leased, and this agreement may not
be modified or altered except by instrument in writing duly signed by the parties hereto.
