The Revised Penal Code Republic Act 3815: Felonies

(1) The revised penal code classifies felonies into two categories: intentional felonies and culpable felonies. are beyond the sphere of penal law. Hence, a criminal
thought or a mere intention, no matter how immoral or
improper it may be, will never constitute a felony.

Thus, even if A entertains the idea of taking the gadget of B, for as


long as he does not commence the commission of the crime directly
by overt act, A is NOT criminally liable.

S 2. An officer entrusted with collection of taxes who voluntarily
fails to issue a receipt as provided by law, is guilty of the crime
under Art 213 P2(b) RPC, Illegal Exaction.

3. Every person owing allegiance to the Phils, without being a


foreigner, and having knowledge of any conspiracy against the
government, who does not disclose and make known the same
to the proper authority, is liable for the crime under Art 116
RPC, Misprision of Treason.
Remember: In both DOLO and CULPA,
VOLUNTARINESS is present
•All the requisites of VOLUNTARINESS (4th element of
felonies) in an intentional felony must be present because
“ a voluntary act is a free, intelligent, and intentional act.”
•Acts executed negligently are also voluntary.

Who are those deemed to have no freedom?

Answer:
1. Those who acts under the compulsion of an irresistible force;
and
2. Those who act under the impulse of an uncontrollable fear of
an equal or greater injury

Who are those exempt from criminal liability
because of the absence of intelligence?
Answer:
1. An imbecile or an insane person, unless the latter has
acted during a lucid interval
2. A child 15 years of age or under at the time of the
commission of the offense
3. Child above 15 years but below 18 years of age unless
he acted with discernment, in which case, he should
be subject to the intervening program provided for
under RA 9344.
