Katarungang Pambarangay: By: Angelo S. Mahinay Enhanced By: Mlgoo Fidel M. Narisma

The dispute involves real property located in different municipalities, so no barangay lupon has authority over the dispute. The proper venue would be in court.

KATARUNGANG

PAMBARANGAY
By: ANGELO S. MAHINAY
Enhanced by: MLGOO FIDEL M. NARISMA
An Offense or Crime can be
committed by:
1. An ACT (Pagbuhat), or
2. An OMISSION (Wala
Pagbuhat pero
Kinahanglang Buhaton)
COMMON TYPES OF CASES:
1)Criminal
2)Civil
3)Administrative
Criminal Case – is an offense
against the State.
Example:
• Theft
• Slight, Less Serious and
Serious Physical Injuries
• Robbery
Civil Cases /actions– are
cases/actions the purpose of
which is the enforcement or
protection of a private right or
redress of a wrong
-usually involve private disputes
between persons or organizations.
CIVIL – ALL
(Morata, et al vs. Go, et al, 125 SCRA 444)

non-payment of indebtedness or rents, failure to

deliver ordered goods or delivering defective ones,
rendering defective service, negligently causing
injuries to another or his property, land disputes, etc.
Administrative Case – is
a case between state authority on the
one side and a person from the other.
Example:
• Gross Negligence
• Neglect of Duty
Quantum of Evidence

Criminal Case – Proof Beyond

Reasonable Doubt

Civil Cases – Preponderance of

Evidence
Quantum of Evidence

Administrative Case
(Substantial Evidence) – It
means such relevant evidence as a
reasonable mind might accept as
adequate to support a conclusion
In what of the following cases
may a person be imprisoned?

1. Administrative Case
2. Civil Case
3.Criminal Case
Does the Court of Law always
give you JUSTICE?
The Sides of a CONTROVERSY:

1. Yours
2. The Other
3. And the TRUTH
No person shall be denied of
Life, Liberty or Property
without due process of law,
nor shall any person be denied
the equal protection of the
laws. (bill of rights, Art. III, Section
1, Philippine Constitution)
Fact or Myth
• The Barangay Officials have inadequate
knowledge of the Katarungang
Pambarangay Law
• The Lupon members cannot distinguish a
criminal from a civil case
• The Punong Barangay is bias and favors a
party
Fact or Myth
• The Punong Barangay does not know the
importance of a COMPLAINT FORM
• People go to the barangay to ask for
Certification to File Action
• People go to the barangay because their
egos were hurt
THE
KATARUNGANG
PAMBARANGAY
LAW
SALIENT FEATURE
Compels the parties to avail
themselves of the conciliation
system as a PREREQUISITE OR A
CONDITION PRECEDENT to
judicial recourse

Compulsory conciliation is
imposed only upon individuals
who actually RESIDE in the same
city or municipality
SALIENT FEATURE
KP is a system for the
amicable settlement of
disputes at the barangay
level

It is never the purpose of the

barangay justice system to
determine who is right or wrong
SALIENT FEATURE

KP discourages a lawyer to
appear at the Lupon except
if he is a respondent

KP involves cases which are limited

to misdemeanors (those punishable
by not more than one (1) year or fine
of not more than Five Thousand
Pesos (Php 5,000.00)
Punishable by imprisonment of 1 year and
below or fine of 5,000.00 and below
PENALTIES IMPRISONMENT
1.Arresto menor - from 1 day to 30 days
2.Arresto mayor - from 1 month and 1 day
to 6 months
3. Prision correctional - from 6 months and 1 day
to 2 years and 4 months
(minimun period)
Reference: Revised Penal Code or Act No. 3185
PURPOSE AND OBJECTIVES

It promotes the speedy administration of justice

It implements the constitutional mandate to

preserve and develop Filipino culture and to
strengthen the family as a basic social institution

It helps relieve the courts of docket congestion and

thereby enhance the quality of justice dispensed by
them ( Moreta vs. Go 125 SCRA 444)
