THE ANTI-DEFECTION LAW

What is defection?
“In politics, a defector is a person who gives up allegiance to one state in
exchange for allegiance to another, in a way which is considered
illegitimate by the first state.”

1. Since when?
1st March 1985, Passed under the government of Rajiv Gandhi

2. Why?
To ensure political stability…So when elected members frequently change the
parties…The governments fall…i.e.…Political Instability

• “Aaya Ram, Gaya Ram” sarcasm used when a political leader changes party,
popularized when MLA Gaya Lal changed his party 3 times….In A Day!

1. Why do MLA wish to switch party?


a. Rain some money on me!
b. To get a higher and better position
c. Genuinely… the party policies are not matching the MLA’s thoughts of
betterment.

Example of affidavit: Tehri region: Mala Rajya (BJP) (Winning Candidate)

What all information?

1. Nomination paper in Form 2A for Lok Sabha election and Form 2B for Assembly
election.
2. Affidavit in Form 26 with all the columns filled up and sworn before an Oath
Commissioner or Magistrate of First Class or before a Notary Public. This includes
details of pending criminal cases, movable & immovable assets including foreign
assets, liabilities, sources of income, educational qualification etc.
3. Certified extract of electoral roll (when candidate is an elector of a different
constituency)

What all information?

1. Form A and Form B (applicable in the case of candidates set up by political


parties)
2. Copy of Caste certificates (if the candidate claims to belong to SC/ST)
3. Security deposit
4. Oath and affirmation

Supreme Court

Why?
1. Transparency
2. Reduces the influence of money and criminals
3. Good politician in political party=Good Political Party

Is it helpful?
Umm…maybe…As there is no way to check if information given by
candidate is true or not.

Who is going to oversee all this? (Who is going to take all the burden?)
Answer: The Election Commission

What all Political Party need to do?


1. File their income tax
2. Hold their organizational elections

Is it efficient?
1. Political Parties take it as formality
2. There is no evidence to support if this is even helpful to increase internal
democracy. (The Gandhi family still has the power…Well maybe they are still
getting elected)
