1. Definitions

A. Appropriate airworthiness requirements

 The comprehensive and detailed airworthiness codes established,


adopted or accepted by a Contracting State for the class of aircraft ,
engine or propeller under consideration .

(Article 33 of the convention on International Civil Aviation)

B. Rendering (a Certificate of Airworthiness) valid


 The action taken by a Contracting State, as an alternative to issuing
its own Certificate of Airworthiness, in accepting a Certificate of
Airworthiness issued by any other Contracting State as the
equivalent of its own Certificate of Airworthiness.
C. State of Design
 The State having jurisdiction over the organization responsible for
the type design.

D. State of Manufacture
 The State having jurisdiction over the organization responsible for
the final assembly of the aircraft.
E. State of Registry
 The State on whose register the aircraft is entered.
F. Type Certificate
 A document issued by a Contracting State to define the design of an
aircraft type and to certify that this design meets the appropriate
Airworthiness requirements of that State.

2. Relationship b/n ICAO Annex 8 and EASA
 ICAO and EASA describe certain standards, recommendations and
regulations regarding the airworthiness of aircraft in their publications.

 In Annex 8, ICAO defines minimum requirements and standards for


the airworthiness of aircraft.

 All member states obligate themselves to convert those regulations to


national law.

• EASA's regulations go further. While ICAO Annex 8 “only"
describes the minimum standard;
• EASA defines essential airworthiness requirements.
• Requirements and regulations can be seen as conforming to ICAO
Annex 8, meaning that they are geared to the ICAO
recommendations, implement their minimum standards and go a
step further by refining them as well as by going into small details
in order to cover all eventualities.

3. Applicability

 The Standards of this chapter shall be applicable on or after 13 June 1960.

 EASA regulations are relevant for all aircraft that


 are registered in an EASA member state
 are registered in a third state but used by an operator supervised by the
agency or a member state.

 For other aircraft, other regulations might be relevant or the guidelines and
standards ICAO Annex 8 are to be applied.

4. Certificate of Airworthiness
(C of A)
4.1. Issuing Authority for C of A

 A Certificate of Airworthiness shall be issued by a Contracting


State on the basis of satisfactory evidence that the aircraft complies
with the design aspects of the appropriate airworthiness
requirements.

 A Contracting State shall not issue or render valid a Certificate of


Airworthiness for which it intends to claim recognition pursuant to
Article 33 of the Convention on International Civil Aviation unless
it has satisfactory evidence that the aircraft complies with the
applicable Standards of this Annex through compliance with
appropriate airworthiness requirements.

 When an aircraft possessing a valid Certificate of Airworthiness
issued by a Contracting State is entered on the register of another
Contracting State,

 the new State of Registry, when issuing its Certificate of


Airworthiness may consider ,

 the previous Certificate of Airworthiness as satisfactory evidence,


in whole or in part, that the aircraft complies with the applicable
Standards of this Annex through compliance with the appropriate
airworthiness requirements.

 When a State of Registry renders valid a Certificate of Airworthiness
issued by another Contracting State, as an alternative to issuance of
its own Certificate of Airworthiness,

 it shall establish validity by suitable authorization to be carried with


the former Certificate of Airworthiness accepting it as the
equivalent of the latter.

 The validity of the authorization shall not extend beyond the period
of validity of the Certificate of Airworthiness being rendered valid.

4.2. Necessity to Have a C of A

 The Convention on International Civil Aviation provides that every


aircraft of a Contracting State, engaged in international navigation,
shall carry a Certificate of Registration and a Certificate of
Airworthiness (Article 29).

 It also provides that the Certificate of Airworthiness shall be


issued or rendered valid by the State in which the aircraft is
registered (Article 31).

4.3. Required elements for the issue of a C of A
 A set of documents and information are necessary for issuing a C of
A.
 Which documents are needed primarily depends on the state of the
aircraft, e.g. whether it is new or used.
 A statement about which class of C of A is being filed for; brand
new aircraft
 a declaration of conformity (stating that the aircraft conforms to
producer specifications and legal requirements)
 a weight and balance report
 if required, the flight manual

4.4. Continuity of Aircraft Airworthiness
The operator of an airplane over 5 700 kg maximum certificated take-
off mass shall ,
 monitor and assess maintenance and
 operational experience with respect to continuing airworthiness
and
 provide the information as prescribed by the State of Registry
 obtain and assess continuing airworthiness information and
 recommendations available from the organization responsible
for the type design and shall

 implement resulting actions considered necessary in accordance with


a procedure acceptable to the State of Registry.
 Any failure to maintain an aircraft in an airworthy condition as
defined by the appropriate airworthiness requirements shall
 render the aircraft ineligible for operation until the aircraft is
restored to an airworthy condition.

 When an aircraft has sustained damage, the State of Registry
shall judge whether the damage is of a nature such that the
aircraft is no longer airworthy as defined by the appropriate
airworthiness requirements.

 If the aircraft is no longer airworthy, it shall prohibit the


aircraft from resuming flight until it is restored to an
airworthy condition

 If the damage sustained is of a nature such that the aircraft is


still airworthy, the aircraft shall be allowed to resume its
flight.

4.5. Renewal of certificate of
Airworthiness
 A Certificate of Airworthiness shall be renewed or shall remain
valid, subject to the laws of the State of Registry

 provided that the State of Registry shall require that the


continuing airworthiness of the aircraft shall be determined by;
 a periodical inspection at appropriate intervals having regard to
lapse of time and
 type of service or, alternatively, by means of a system of
inspection, approved by the State, that will produce at least an
equivalent result.
