This was an act providing for the establishment and
1982
maintenance of an integrated system of education. I n
accordance with Section 2, this act shall apply to and
govern both formal and non- formal system in public
and private schools in all levels of the entire
educational system.

S e c t i o n 1. D e c l a r a t i o n o f P o l i c y. I t i s h e r e b y d e c l a r e d t o b e t h e
policy of this A c t to promote and improve the social and
economic status of public school teachers, their living and
w ork ing c ondit ions, t heir t erm s of em ploym ent and
prospects in order c areer t hat t hey m ay c om pare
e x i s t i n g o p p o r t u n i t i e sf aivno or at hbel yr wwi a
t hl k s o f li fe, a t t r a c t a n d r e t a i n
in the teaching profession more people w i t h the proper
qualifications, it being recognized that advance in education
depends on the qualifications and ability of the teaching staff
and that education is an essent ial fac t or in t he ec onom ic
growth of the nation as a produc t ive invest m ent of vit al
importance.
S e c t i o n 3. R e c r u i t m e n t a n d Q u a l i f i c a t i o n . R e c r u i t m e n t
policy w i t h respect t o the selection and appointment of
teachers shall be clearly defined by the Department
o f E d u c a t i o n : Provided, h o w e v e r, T h a t e f f e c t i v e u p o n
the approval of this Act, the following shall constitute
the minimum educational qualifications for teacher-
applicants:

(a) For t e a c h e r s i n t h e k i n d e r g a r t e n a n d e l e m e n t a r y
g r ad e s , B a c h e l o r ' s d e g r e e i n E l e m e n t a r y
E d u c a t i o n (B.S.E.ED.);
(b) For t e a c h e r s o f t h e s e c o n d a r y s c h o o l s , B a c h e l o r ' s d e g r e e i n
Education or its equivalent w i t h a major and a minor; or a
Bachelor's degree in Arts or Science w i t h at least eighteen
professional units in Education.

(c)For t e a c h e r s o f s e c o n d a r y v o c a t i o n a l a n d t w o y e a r s t e c h n i c a l
courses, Bachelor's degree in the field of specialization w i t h at
least eighteen professional units in education;

(d)For t e a c h e r s o f c o u r s e s o n t h e c o l l e g i a t e le v el, o t h e r
than vocational, master's degree w i t h a specific area of
specialization;
S e c t i o n 4. P r o b a t i o n a r y Period. When r e c r u i t m e n t t a k e s p l a c e
after adequate training and professional preparation in any
school recognized by the Government, no probationary period
preceding regular appointment shall be imposed if the teacher
p o s s e s s e s t h e a p p r o p r i a t e c i v i l s e r v i c e e l i g i b i l i t y : Provided,
h o w e v e r, T h a t w h e r e , d u e t o t h e e x i g e n c i e s o f t h e s e r v i c e , i t i s
necessary to employ as teacher a person w h o possesses the
minimum educational qualifications herein above set forth but
l a c k s t h e a p p r o p r i a t e c i v i l s e r v i c e e l i g i b i l i t y, s u c h p e r s o n s h a l l
be appointed on a provisional status and shall undergo a period
of probation for not less than one year from and after the date
of his provisional appointment.
S e c t i o n 5. Te n u r e o f O ff ice. S t a b i l i t y o n e m p l o y m e n t a n d
security of tenure shall be assured the teachers as provided
under existing laws.
S u b j e c t t o t h e p r o v i s i o n s o f S e c t i o n t h r e e h er e of , t e a c h e r s
appointed on a provisional status for lac k of necessary
civil service eligibility shall be extended permanent
appointment for the position he is holding after having
rendered a t least ten years of continuous, efficient and
faithful service in such position.
S e c t i o n 6. C o n s e n t f o r Tr a n s f e r Tr a n s p o r t a t i o n
Ex p e n s e s . E x c e p t f o r c a u s e a n d a s h e r e i n o t h e r w i s e
provided, no teacher shall be transferred w i t h o u t
h i s c o n s e n t f r o m o n e s t a t i o n t o a n o t h e r.

superintendent w h o shall previously notify the
teacher concerned of the transfer and the reason or
r e a s o n s t h e r e f o r.
S e c t i o n 8. S a f e g u a r d s i n D i s c i p l i n a r y P r o c e d u r e . Every
teacher shall enjoy equitable safeguards at each
s t a g e o f a n y d i s c i p l i n a r y p r o c e d u r e a n d s h a l l have:
a. t h e r i g h t t o b e i n f o r m e d , i n w r i t i n g , o f t h e c h a r g e s ;
b. t h e r i g h t t o f u l l a c c e s s t o t h e e v i d e n c e i n t h e c a s e ;
c.t h e r i g h t t o d e f e n d h i m s e l f a n d t o b e d e f e n d e d b y a
r e p r e s e n t a t i v e o f h i s c h o i c e and/or b y h i s o r g a n i z a t i o n ,
adequate time being given to the teacher for the
preparation of his defense; and
d. t h e r i g h t t o a p p e a l t o c l e a r l y d e s i g n a t e d a u t h o r i t i e s .
S e c t i o n 9. A d m i n i s t r a t i v e Charges. A d m i n i s t r a t i v e
charges against a teacher shall be heard initially by a
c omm ittee composed of the corresponding School
Superintendent of the Division or a duly authorized
representative w h o should at least have the rank of a
d i v i s i o n s u p e r v i s o r, w h e r e t h e t e a c h e r b e l o n g s , a s
c h a i r m a n , a r e p r e s e n t a t i v e o f t h e l o c a l or, i n i t s a b s e n c e ,
any existing provincial or national teacher's
o r g a n i z a t i o n a n d a s u p e r v i s o r o f t h e Division, t h e l a s t
t w o t o be designated by the Director of Public Schools.
S e c t i o n 10. N o D i s c r i m i n a t i o n . T h e r e s h a l l b e n o d i s c r i m i n a t i o n
whatsoever in entrance t o the teaching profession, or during its
exercise, or in the termination of services, based on other than
professional consideration.

S e c t i o n 11. M a r r i e d Te a c h e r s . W h e n e v e r p o s s ib l e , t h e p r o p e r
authorities shall take all steps to enable married couples, both of
w h o m are public school teachers, to be employed in the same
l o c a l i t y.

S e c t i o n 12. A c a d e m i c F r e e d o m . Te a c h e r s s h a l l e n j o y a c a d e m i c
freedom in the discharge of their professional duties, particularly
w i t h regard to teaching and classroom methods.
S e c t i o n 13. Te a c h i n g Ho ur s . A n y t e a c h e r e n g a g e d i n
actual classroom instruction shall not be required to
render more than six hours of actual classroom teaching
a day, w h i c h s h a l l b e s o s c h e d u l e d a s t o g i v e h i m t i m e
for the preparation and correction of exercises and
other w o r k incidental to his normal teaching duties:
S e c t i o n 14. A d d i t i o n a l C o m p e n s a t i o n .
I n t h e c a s e o f o t h e r t e a c h e r s o r s c h o o l o ff i c i a l s n o t
engaged in actual classroom instruction, any w o r k
performed in excess of eight hours a day shall be paid an
additional compensation of at least twenty-five per
c en t of their regular remuneration.
S e c t i o n 15. C r i t e r i a f o r Salaries. Te a c h e r ' s s a l a r i e s s h a l l c o r r e s p o n d
to the following criteria:
(a)t h e y s h a l l c o m p a r e f a v o r a b l y w i t h t h o s e p a i d i n o t h e r o c c u p a t i o n s
requiring equivalent or similar qualifications, training and abilities;
(b)t h e y s h a l l b e s u c h a s t o i n s u r e t e a c h e r s a r e a s o n a b l e s t a n d a r d o f
life for themselves and their families; and
(c)t h e y s h a l l b e p r o p e r l y g r a d e d s o a s t o r e c o g n i z e t h e f a c t t h a t
certain positions require higher qualifications and greater
r e s p o n s i b i l i t y t h a n o t h e r s : Provided, h o w e v e r, T h a t t h e g e n e r a l s a l a r y
scale shall be such that the relation between the lowest and highest
s a l a r i e s p a i d i n t h e p r o f e s s i o n w i l l b e o f r e a s o n a b l e order. N a r r o w i n g
of the salary scale shall be achieved by raising the lower end of the
s a l a r y s c a l e s r e l a t i v e t o t h e u p p e r end.
S e c t i o n 16. S alar y S c ale. S alary s c a l e s o f t e a c h e r s s h a l l p r o v i d e f o r a
gradual progression from a minimum t o a m a x i m u m salary by
means of regular increments, granted automatically after three
years : Provided, T h a t t h e e ff i c i e n c y r a t i n g o f t h e t e a c h e r c o n c e r n e d
i s a t l e a s t s a t i s f a c t o r y. T h e p r o g r e s s i o n f r o m t h e m i n i m u m t o t h e
m a x im u m of the salary scale shall not extend over a period of ten
years .
S e c t i o n 19. S p e c i a l H a r d s h i p A l l o w a n c e s . I n a r e a s i n w h i c h t e a c h e r s
are exposed t o hardship such as difficulty in commut ing t o the place
o f w o r k o r o t h e r haz ard s p e c u l i a r t o t h e p l a c e o f e m p l o y m e n t , a s
determined by the Secretary of Education, they shall be compensated
special hardship allowances equivalent t o a t least twenty-five per
c e n t o f t h e i r m o n t h l y s alar y.
S e c t i o n 21. D e d u c t i o n s P ro hi b it ed . N o p e r s o n s h a l l m a k e a n y
deduction whatsoever from the salaries of teachers except under
s p e c i f i c a u t h o r i t y o f l a w a u t h o r i z i n g s u c h d e d u c t i o n s : Provided,
h o w e v e r, T h a t u p o n w r i t t e n a u t h o r i t y e x e c u t e d b y t h e t e a c h e r
c o n c e r n e d , (1) l a w f u l d u e s a n d f e e s o w i n g t o t h e P h il i pp in e P u b l i c
S c h o o l Te a c h e r s A s s o c i a t i o n , a n d (2) p r e m i u m s p r o p e r l y d u e o n
insurance policies, shall be considered deductible.
S e c t i o n 22. M e d i c a l E x a m i n a t i o n a n d Tr e a t m e n t . C o m p u l s o r y m e d i c a l
examination shall be provided free of charge for all teachers before
they ta k e up teaching, and shall be repeated not less than once a
y e a r d u r i n g t h e t e a c h e r ' s p r o f e s s i o n a l life. Where m e d i c a l
e x a m i n a t i o n s h o w t h a t m e d i c a l t r e a t m e n t and/or h o s p i t a l i z a t i o n i s
n e c e s s a r y, s a m e s h a l l b e p r o v i d e d f r e e b y t h e g o v e r n m e n t e n t i t y
paying the salary of the teachers.
S e c t i o n 23. C o m p e n s a t i o n For I nj ur i es . Te a c h e r s s h a l l b e p r o t e c t e d
against the consequences of employment injuries in accordance w i t h
existing laws. The effects of the physical and nervous strain on the
teacher's health shall be recognized as a compensable
occupational disease in accordance w i t h existing laws.

S e c t i o n 2 4 : S T U D Y L E AV E : 6 0 p e r c e n t o f s a l a r y

S e c t i o n 25. I n d e f i n i t e Leav e. A n i n d e f i n i t e s i c k l e a v e o f a b s e n c e s h a l l
be granted to teachers when the nature of the illness demands a
long treatment that will exceed one year at the least.
S e c t i o n 26. S alar y I n c r e a s e u p o n R e t i r e m e n t . P u b l i c s c h o o l t e a c h e r s
having fulfilled the age and service requirements of the applicable
retirement laws shall be given one range salary raise upon
retirement, w h i c h shall be the basis of the computation of the lump
sum of the retirement pay and the monthly benefits thereafter

S e c t i o n 27. F r e e d o m t o Organize. P u b l i c s c h o o l t e a c h e r s s h a l l h a v e
the right to freely and w i t h o u t previous authorization both t o
establish and t o join organizations of their choosing, whether local or
national to further and defend their interests.
S e c t i o n 29. N a t i o n a l Te a c h e r ' s O rganiz ations . N a t i o n a l t e a c h e r s '
organizations shall be consulted in the formulation of national
educational policies and professional standards, and in the
formulation of national policies governing the social security of the
teachers.
