Dilemma- Week 2 (DELETE SCENARIO NOT FOCUSSED ON) Dilemma B

• An adult with a learning disability is admitted to hospital having


been involved in a road traffic accident. The doctor on duty takes
the decision that the man requires a blood transfusion. The man
listens to the information given by the doctor and refuses to
consent to the treatment. The doctor decides it is in the best
interests of the patient to go ahead with the treatment and does
so. You need to decide if the doctor acted lawfully. Refer to
relevant guidelines/ standards and legislation when justifying
your position.

• Consent- National Consent Policy 2013. The doctor gave the patient
all the information and while conscious and coherent the patient
refused treatment. Therefore the doctors violated the patients rights.
• Religion- Advanced Healthcare Directive, Hospital Liaison Committee
that are in place to act in best care of patient. Document releases
Doctor and Hospital of all responsibility. Assisted Decision Making
(Capacity) Act 2015
• Disability- National Disability Authority- question raised on family role
in decision making in case of medical emergency.
