LEGAL PARAMETERS OF PUBLIC SAFETY SERVICES

• The prime duty of the state is to serve and protect


the people (1987 Phil Constitution)
• The maintenance of peace and order, the protection
of life, liberty, and property, and the promotion of the
general welfare are essential for the enjoyment by
all the people of the blessings of democracy (1987 Phil
Constitution)

Types of Threats

 A direct threat identifies a specific target and is delivered in a


straightforward, clear, and explicit manner.
 An indirect threat tends to be vague, unclear, and ambiguous.
The plan, the intended victim, the motivation, and other
aspects of the threat are masked or equivocal.
 A veiled threat is one that strongly implies but does not
specifically threaten violence.
 A conditional threat is the type of threat often seen in
extortion cases. It warns that a violent act will happen
unless certain demands or terms are met.

The term security is broadly used to refer to the protection of individuals,


organizations, and assets against threats and criminal activities that
can be directed to such entities hence rendering them (threats) inactive.
It is important to note that security is highly focused on the deliberate actions that are geared
towards inflicting harm to an individual, organization, or even assets .

SAFETY

The term safety is used to refer to the condition of being protected


from the scene that are likely to cause harm. In addition, the
term safety can be used to refer to the state at which one has the control
of the risk causing aspects hence protecting himself or herself
against risk that is fully unintended.
Public Safety

Public safety is a system of rules,


enforcement mechanisms, infrastructure and
services that reduce risk to life and quality of life.
These are provided by all levels of government
and often represent a significant portion of
government spending.
Public Safety includes all elements (efforts of the gov't and its positive impact)
that enable residents of a community to enjoy its streets, sidewalks, parks, and other public spaces
as well as sense of security in their homes, schools, and workplaces.

Public Safety Public Safety refers to the welfare and protection of


the general public. It is usually expressed as a governmental responsibility. Most states
have departments for public safety. The primary goal of the department is prevention and
protection of the public from dangers affecting safety such as crimes or disasters.

ALVIN TOFFLER asserts order and safety is a craving biological needs, irrepressible hunger.
ROUSSEAU claims that this is a justification of the very existence of a state.
No civilization is possible without PUBLIC ORDER AND SAFETY.
PUBLIC SAFETY MANAGEMENT refers to the
‘administration’ of all activities pertaining to the promotion of security,
safety, health and welfare of the community.
Immediate, prompt and effective response to any types of threats, disasters (whether man-made or by accidents),
crisis and other forms of negativism that affect the social order of society is the concept of
public safety management.

PUBLIC SAFETY MANAGEMENT involves the coordination and administration


of resources that provide for the safety and security of the community.
Jobs in the field can be found within police, fire, and emergency medical services.
Management of these services requires strategic planning, preparedness strategies,
inter-agency coordination and fiscal management skills.
Basic Underlying Notions
(Public Safety)
• Public Safety (PS) and Criminal Justice System (CJS) have common
objective of insuring the safety and security of the people .

• CJS makes the people safe from criminals in the streets,


workplace, schools, churches, their homes and wherever they maybe.

• PS carry over their protection where CJS leaves off against the
furies and hazards of nature and those caused by men whose damage
and devastation transcends the competence of CJS. Earthquakes, fires,
flood, lahar, oil spills, el niño, pollution, red tide. Poisoned meat and
fruits, water system. In short, beyond the sphere of mere safety but
health and well being.
The Public Safety (PS) and Criminal Justice
System (CJS) and our entire social defense
mechanism cannot work effectively without the full
support of committed people. The people in turn
can only get the PS, CJS and government they
deserve. This is true since the time of Methusaleh
and Moses. Today, tomorrow and for all times, as
long as nature of man and government stay
unaltered.
The Public Safety (PS) and the
Criminal Justice System (CJS) are
complimentary and intertwined
systems. They must work as a team.
Coordinate and orchestrate their efforts
or fail sadly this is not often happening.
Pillars are working at cross-purposes, engaged
in ruinous rivalries to maintain their respective
turfs. As a result, the people suffer.
Regarding the police, it is not only an agency of force but also of service unfortunately, this service aspect is often forgotten, efforts, time and resources are disproportionally focused on the first function s: investigating, searchin g, arresting, detaining, often with arrogance and blatant abuse thereby alienating more people and their vitally needed support. The result is negative image and low credibility. Too few police operatives are fielded in the streets, many are at headqu arters or elsewhere doing things, if not the wrong things.
There is a need for constant and continuing
modernization of equipment and technologies.
However, this must be accompanied by the
modernization for our thinking, character,
values, work ethics and perspective of global
standards, so that we can compete and win over our
competitors and adversaries in all spheres.

We can do things fast and effectively if we work all together as a team.


This is the secret formula for all successes and miracles. This is true in
building roads in winning wars, building cathedrals and building
institutions and nations.

Recent Security Assessment

The signing and implementation of peace agreements, together


with sustained law enforcement efforts, have stabilized security in
geographically isolated and conflict- affected (GICA) communities
and resulted in an increase in economic activities.

The implementation of a whole-of-government and whole-of-nation


approach16 fostered a more holistic and cohesive government response,
addressing the interrelated drivers of armed conflict in the country.
Various clusters and regional and local task forces under the National Task Force
to End Local Communist Armed Conflict (NTF-ELCAC) were activated.

Significant progress has also been made in terms of increasing the


capacity of the security sector to respond to the adverse
impacts of natural hazards and other security threats.

The updating of the National Disaster Risk Reduction and Management


Plan 2020–2030 outlines actions to ensure coordination and
efficient logistics operations before and during disasters

Challenges

In BARMM, all other intergovernmental relations mechanisms still


need to be operationalized, such as the newly created Bangsamoro
Sustainable Development Board and other intergovernmental
arrangements between BARMM, the national government, and relevant LGUs

Criminality and threats to public safety, including non-traditional security issues,


also persist. The rapid growth and sophistication of cybercrimes
and cyberattacks have increased

Cross-border and transnational criminal activities are still major concerns, given
the porous borders and structural inadequacy of relevant state institutions .
Hence, support for the modernization of the Armed Forces of the Philippines ,
Philippine Coast Guard, and other relevant security sector agencies is critical.

Implementation of the peace and development interventions is not fully


institutionalized at the regional and local levels. Gaps in efforts geared
toward threat assessment, programming of responses, community
engagement, dismantling of private armed groups, and
strategic communication also need to be addressed.

Development and management of the country’s territory and maritime domain,


including enforcement, regulation, conservation, and security need to be tackled.
The 2016 Permanent Court of Arbitration (PCA) Ruling on the West Philippine Sea issue was
a clear victory of a rules-based international order. However, the Association of Southeast
Asian Nations (ASEAN)–China Code of Conduct in the South China Sea remains unfinished.
