& Duties
What are Fundamental Rights :
• Fundamental rights are the basic human rights enshrined in the
Constitution of India which are guaranteed to all citizens. They
are applied without discrimination on the basis of race, religion,
gender, etc. Significantly, fundamental rights are enforceable by
the courts, subject to certain conditions.
• Article 12 to 35 contained in Part III of the Constitution deal with
Fundamental Rights.
• The model for Fundamental Rights in India has been taken from
the Constitution of the USA.
Right to freedom :
• From Article 19, 20, 21a, 22 says
the Right to freedom.
• The Right To Freedom gives a
person the right to live and work
freely, without interference from
the state. The Significance of the
Right To Freedom is it ensures
that all people are treated
equally and have the same
rights. It also protects people
from being arbitrarily detained
or imprisoned
Right to Freedom Of Religion :
• Right to freedom of
religion is well
described in the
Articles 25, 26, 27 and
28 of Indian
constitution. Before
the State and no
religion shall be given
preference over the
other. Citizens are
Right to Constitutional Remedies
• Article 226 along with Article 32 of the
Indian Constitution guarantees every
citizen the Right to Constitutional
Remedies, which includes equality before
the law and equal protection of laws.
• Anyone can apply for the right to
constitutional remedies and approach the
High Court or Supreme Court. This right
allows the citizens to restore their
fundamental rights if they are violated.
After that, the High Court or Supreme
Court will issue the directives or orders
to the government for the right
enforcement.
What are Fundamental Duties :
• The idea of Fundamental Duties has been borrowed from the
Constitution of erstwhile USSR. Till then, Japan was only the
democratic that contains the duties of the citizen. Fundamental
Duties are embedded in Part IV-A of the Indian Constitution.
• The importance of fundamental duties is that they define the
moral obligations of all citizens to help in the promotion of the
spirit of patriotism and to uphold the unity of India.
• Total 11 fundamental duties in the Indian Constitution. They are
important because they believe that rights and duties go hand in
hand.
