upon any public highway of the Philippines unless the
same is properly registered for the current year in
accordance with the of this act.

a. private – mv registered under this classification
shall not be used for hire under any circunstances.
b. For hire – mv registered under this classification are
those covered by certificates of public convenience,
or special permits issued by the LTO/LFTRB and shall
be subject the provisions of the Public service Act.
c. Government – mv owned by gov’t of the
Philippines, or any of its political subdivisions shall be
registered under this classification.
d. Diplomatic – mv owned by foreign gov’t or by their
duly accredited diplomatic officers in the Philippines
and used in the discharge of their official duties.
Tourists bringing their own mv to the Philippines may,
however, without registering such MV , use the same
during but not after ninety days (90) of their sojourn:
provided, that the MV displays the number plates for
the current year of some other country or state, and
said number plates as well as the name and address
(temporary/permanent) of the owner thereof are
registered in the BLT prior to the operation of the MV.

Sec 19 – except as otherwise specifically provided in
this act, it shall be unlawful for any person to operate
any motor vehicle without having in his possession a
valid license to drive a MV.
The license shall be carried by the driver at all times
when operating a MV and shall be shown and/ot
surrendered for cause and upon demand to any
person with authority under this act to confiscate the
same.
Sec 21 – bona fide tourists and similar transients who
are duly licensed to operate MV in their respective
countries may be allowed to operate MV during but
not after 90 days of their sojourn in the Philippines.
if any accident involving such tourist or
transient occurs, which upon investigation by the
Commissioner of his deputies indicates that the said
tourist or transient is incompetent to operate MV, the
C shall immediately inform him/her in writing that
he/she shall be no longer be permitted to operate a
MV.

 Restriction as to speed. a) any person driving a
MV on a highway shall drive the same at a careful
and prudent speed, not greater nor less than is
reasonable and proper, having due regard for the
traffic, the width of the hi-way, and of other
condition then and there existing; and no person
shall drive any MV upon hi-way at such a speed
as to endanger the life, limb and property of any
person, nor at a speed greater than will permit
him/her to bring the V to a stop within the
assured clear distance ahead. B) subject to the
provisions of the paragraph, the rate of speed of
any MV shall not exceed the following:

1. On open country roads, with no “blind
corners” not closely bordered by
habitations. Passengers cars and MC – 80
km/hr motor trucks and buses – 60 km/hr
2. On “through streets” or boulevards clear
of traffic, with no “blind corners”, when
so designated. Passenger cars and MC –
40 km/hr motor trucks and buses – 30
km/hr
On city and municipal streets, with light
traffic, when not designated “through
streets” passengers cars and MC – 30
km/hr motor trucks and buses – 30 km/hr
Through crowded streets, approaching
intersection at blind corners, passing
school zones, passing other vehicles which
are stationary, or for similar dangerous
circumstances. 20 km/hr
c) The rates of speed hereinabove
prescribed shall not apply to the ff:
1) a physician or his driver when the
former responds to emergency calls;
2) the driver of a hospital ambulance on
the way to and from the place of accident
or other emergency;
3) any driver bringing a wounded or sick
person for emergency treatment to a
hospital, clinic or, or any other similar
place;
4)The driver of a MV belonging to the Armed
Forces while in use for official purposes in
times of riot, insurrection or invasion;
5)The driver of a V, when he or his
passengers are in pursuit of a criminal;
6)A law-enforcement officer who is trying to
overtake a violator of traffic laws; and
7)The driver officially operating a MV of any
fire department, provided that exemption
shall not be construed to allow useless or
unnecessary fast driving of drivers
aforementioned.
Sec 36- no provincial, city or municipal
authority shall enact or enforce any
ordinance or resolution specifying
maximum allowable speeds other
than those provided in this Act.
Sec 37 – unless a different course of action is
required in the interest of the safety and the
security of life, person or property, or because of
unreasonable difficulty of operation in compliance
herewith, every person operating a MV or an
animal-drawn V on a highway shall pass to the
right when meeting persons or vehicles coming
toward him/her, and to left when overtaking
persons or vehicles going the same direction, and
when turning to the left in going from one
highway to another, every V shall be conducted
to the right of the center of the intersection of the
highway.

Sec. 42 Right of Way: a) when two
Sec 39 – the driver of any vehicle overtaking another
vehicle proceeding in the same direction shall pass at
a safe distance to the left thereof, and shall not again
drive to the right side of the highway until safely clear
such overtaken vehicle, except that, on a highway,
within a business or residential district, having two or
more lanes for the movement of traffic in one
direction, the driver of a vehicle may overtake and
pass another vehicle on the right. Nothing in this
section shall be construed to prohibit a driver
overtaking and passing, upon the right, another
vehicle which is making or about to make a left turn.

 No person shall operate a motor vehicle on
any highway recklessly or without
reasonable caution considering the width,
traffic, grades, crossing, curvatures,
visibility and other conditions of the
highway and the conditions of the
atmosphere and weather, or so as to
endanger the property or safety or rights
of any person or so as to cause excessive
or unreasonable damage to the highway.
Sec 55
 in the event that any accident should occur as a result of the
operation of a motor vehicle upon a highway, the driver shall stop
immediately , and, if requested by any person present, shall show
his driver’s license, give his true name and address and also the
true name and address of the owner of the motor vehicle. No
driver of a motor vehicle concerned in a vehicular accident shall
leave the scene of the accident without aiding the victim, except
under any of the following circumstances :
 1. If he/she is in imminent danger of being seriously
harmed by any person or persons by reason of the accident.
 2. if he/she reports the accident to the nearest officer of
the law.
 3. If he/she has to summon a physician or nurse to aid the
victim.
