CLEAN WATER ACT

Republic Act No. 9275

Section 3. The PCG shall have the following powers and functions:

 (m) To board and inspect all types of merchant ships and watercrafts in the
performance of this functions;
 (n) To enforce laws and promulgate and administer rules and regulations
for the protection of marine environment and resources from offshore
sources of pollution within the maritime jurisdiction of the Philippines;
 (o) To develop oil spill response, containment and recovery capabilities
against ship-based pollution;
 (p) To grant, within the capabilities and consistent with its mandate,
requests for assistance of other government agencies in the performance
of their functions;
National Water Quality
Management System
 DENR and National Water Resources Board (NWRB) to establish water
management areas according to characteristics ex. watershed, river
basin, lake, etc which shall be overseen by governing boards

 Water quality standards shall be set, to be monitored by a technical


secretariat which shall submit regular reports to the governing board

 Water areas that fail to meet quality standards shall be designated as


non-attainment areas and managed accordingly ex. Stricter monitoring
etc
National Water Quality
Management System
 National Program for Sewage and Septage Management shall be
prepared by the DPWH in coordination with the DENR, LGUs and other
relevant government agencies

 Waste water charge system, or use of discharge permits whereby


charges will be imposed upon facilities for their discharge of waste water

 Environmental Impact Assessment System – to be required before


approving or granting permits for proposed projects
Roles of Relevant Agencies

 DENR is the lead agency for the implementation of the Clean Water Act

 LGUs shall work with the DENR for the monitoring of standards of water
quality in their respective jurisdictions

 Business and industry sectors shall work with DENR and LGUs to
formulate incentives to protect water systems and water areas

 PCG shall enforce water quality standards in marine areas from offshore
sources
Roles of Relevant Agencies

 DPWH shall work with its attached agencies and with urban water utilities to
provide for sewage and sanitation facilities

 DA shall coordinate with DENR to formulate guidelines for the re-use of


wastewater for irrigation and other agricultural purposes

 DOH for the enforcement of drinking water quality standards

 DOST for research and technology development and dissemination

 DepEd, CHED, PIA for public education and information


Funds

 National Water Quality Management Fund – managed by DENR, used for


containment and clean-up of water pollution, restoration of ecosystems,
rehabilitation of the environment, research and monitoring activities,
grant of incentives and rewards, etc

 Area Water Quality Management Fund – managed by the governing


boards of the water management areas, to be used for the maintenance
and upkeep of water bodies in water management areas, provide
incentives and rewards for entities whose discharge are better than
established standards, provide loans to help facilities improve their
discharges, etc
Funds

 Environmental Guarantee Fund (EGF) – for the maintenance of water


systems, conservation of watersheds, need for emergency response or
clean-up operations, etc
Prohibited Acts

 Discharging, depositing or causing to be deposited material of any kind


directly or indirectly into the water bodies

 Discharging, injecting or allowing to seep into the soil or sub-soil any


substance in any form that would pollute groundwater

 Operating facilities that discharge regulated water pollutants without the


valid required permits

 Disposal of potentially infectious medical waste into sea water by vessels


unless the health or safety of individuals on board the vessel is threatened by
a great and imminent peril;
Prohibited Acts

 Unauthorized transport or dumping into sea waters of sewage sludge or


solid waste

 Transport, dumping or discharge of prohibited chemicals, substances or


pollutants listed under Republic Act No. 6969;

 Operate facilities that discharge or allow to seep, willfully or through


gross negligence, prohibited chemicals, substances or pollutants listed
under Republic Act No. 6969, into water bodies
Prohibited Acts

 Undertaking activities or development and expansion of projects, or


operating wastewater/sewerage facilities in violation of law

 Discharging regulated water pollutants without the valid discharge


permit

 Noncompliance of the LGU with the Water Quality Framework and


Management Area Action Plan

 Refusal to allow entry, inspection and monitoring by DENR


Prohibited Acts

 Refusal to allow access by DENR to relevant reports and records

 Refusal or failure to submit reports whenever required by DENR

 Refusal or failure to designate pollution control officers whenever


required by the DENR

 Directly using booster pumps in the distribution system or tampering


with the water supply in such a way as to alter or impair the water
quality
Penalties
under PD No. 600
 Fines to be imposed on a daily basis

 imprisonment for 2 to 4 years

 Suspension of operations or closure of establishment

 Civil liability

 LGUs may also impose administrative sanctions
