• refers to the power to make laws, and
subsequently to alter and repeal them
1987 Constitution
ARTICLE VI, SECTION 1
vested the legislative power to the Congress of the
Philippines. It is a bicameral body consisting of the
Senate (upper house) and the House of Representatives.
(Lower house)
SEC. 2
THE SENATE

It is composed of
twenty-four senators,
half of it is elected
every three years
SECTION 3
Qualification — A Senator must be:

THE HOUSE OF
REPRESENTATIVES

It is composed of

250 congressmen.
2 TYPES OF Representatives
a. District Representative. The district representatives
apportioned among the provinces, cities and
the
Metropolitan Manila area.
b. Party-list representatives. The party-list
representatives are from the sectorial minority like
labor unions, rights groups, and other organizations
which constitute twenty percent of the total
number of representatives.

SECTION 6
Qualification — A Representative must
be:

Parliamentary Immunities
SECTION 11
A Senator or Member of the House of Representatives
shall, in all offenses punishable by not more than six
years imprisonment, be privileged from arrest
(Freedom from arrest) while the Congress is in session.
No member shall be questioned nor be held liable in
any other place for any speech or debate in
Congress or in any committee thereof.

SECTION 12
The provisions of this section are intended
to ensure the probity and objectivity of
the
members of Congress.

House of Representatives shall, upon
assumption of office, make a full

Section 13
No Senator or Member of the House of Representatives may
hold any other office or employment in the Government, or
any subdivision, agency, or instrumentality thereof, including
government-owned or controlled corporations or their
subsidiaries, during his term without forfeiting his seat.
Neither shall he be appointed to any office which may
have been created or the emoluments thereof increased
during the term for which he was elected.
The Leaders of the Congress
The Senate President leads the Upper House while
the Speaker of the House headed the Lower House.
They preside over their sessions, preserve order and
decorum, decide all questions of order, sign acts,
resolutions, orders and warrants, issue subpoena, and
appoint personnel and discipline them.
Functions and Composition of the
Electoral Tribunal
SECTION 17
It is created by each house, which shall have
exclusive
jurisdiction and sole judge over all contests relating to
returns and qualifications of their respective members.
Each house shall have an Electoral Tribunal with nine
members each (three Justices of the Supreme Court,
designated by the Chief Justice and six members

Commission on Appointment
SECTION 18
The Commission on Appointment is to approve or
disapprove appointments presented to it by the
President within thirty days from the date of
submission. It is composed of a Chairman (Senate
President), twelve senators and twelve members of
the lower house.
SECTION 23
The Congress by a vote of two-thirds of both
Houses in joint sessions assembled, voting
separately, shall have the sole power to
declare the existence of a state of war.
SECTION 24
All appropriations revenue or tariff bills
authorizing the increase of the public debt,
bills of local application, and private bills shall
originate exclusively in the House of
representative, but the Senate may propose or
concur with amendments.
SECTION 26
No bill passed by either House shall become a
law unless it has passed three readings on
separate days, and printed copies thereof in its
final form have been distributed to its
members three days before its passage…upon
the last reading of a bill, no amendment to it
shall be allowed, and the vote thereon shall be
taken immediately after that, and the years
and days entered in the journal.
