Prosecution
. Role of the Prosecutor
• Prosecutors in the are primarily part of the prosecutors' national
service under the department of justice

• Their role is to:

• Evaluate evidence submitted by compliance


• Determined if there’s probable cause to file charge in court
• Represent the state in Criminal Cases
The Prosecution Process
• Filing of a complaint a complaint: fa complaint files a criminal
complaint with supporting evidence before the prosecutor’s office.

• Preliminary Investigation:

• Conducted by prosecutor to determine if probable cause exist.


• Parties may submit affidavits and evidence.
• No Need for a full trial, but the investigation ensures the accused is
not subjected to unwarranted prosecution.
Resolution:
• If probable cause is found, the prosecutor files an information ( a
formal charge in court.)

• If no probable cause exist the case is dismissed.

Trial:
prosecutor represents the state during the trail, presenting evidence
and witnesses
• The court ultimately determines guilt or innocnets.

• Level of Courts
• Cases are filed depending on the nature of the offense:

• Municipal trial courts: handle less serious crimes,

• Regional Trial Court: establishes procedures for criminal cases,


including rule 112 on preliminary investigations.
Challenges in prosecution
• Case backlogs: courts and prosecutors are often overwhelmed with
numerous cases.

• Resource Constraints: Limited manpower and resources for thorough


• Investigation.

• Corruption and Political influence: Cases may be delayed or


manipulated due to external pressures.
Recent Developments

• Efforts to strengthen the justice system through modernization and


digitization.

• Focus on faster resolution of cases and reducing court dockets.
