Public hearing, consideration, and action regarding a request of Beth Smith of The
Argyle, applicant, representing the Texas Biomedical Research Institute, owner, for
a Specific Use Permit (SUP) to add on north side of existing building an addition
at 934 Patterson and to consolidate all prior Specific Use Permits relating to The
Argyle into an omnibus SUP to support its operation of a dining, social club and
venue on the premises located at 934 Patterson Ave, 815 Patterson Ave, 820
Patterson Ave, 423 Argyle Ave, a 2,417sq ft tract of land, and the northernmost one
hundred fifty fee (150ft) of 401 Torcido Dr all zoned Single Family District (SF-
A).

SUMMARY
The applicant is requesting a Specific Use Permit (SUP) for approval to add on north side of
existing building an addition of 9,904 square feet at 934 Patterson and to consolidate all prior
Specific Use Permits relating to The Argyle into an omnibus SUP to support its operation of a
dining, social club and venue at associated premises located at 934 Patterson Ave, 815 Patterson
Ave, 820 Patterson Ave, 423 Argyle Ave, a 2,417sq ft tract of land, and the northernmost one
hundred fifty fee (150ft) of 401 Torcido Dr. The case was tabled at the November 04, 2024 meeting
until February 03, 2025 and rescheduled a number of times ultimately to the April 15, 2025 Special
Meeting. Since the November 2024 meeting, the requested SUP was revised by the applicant and
resubmitted for consideration. Planning & Zoning recommended approval of the revised SUP with
additional revisions submitted during the April 15th
Special Meeting.
BACKGROUND INFORMATION
The properties are zoned SF-A and The Argyle is on the east side of Patterson between Argyle and
Estes/Crescent and off-street parking is located on the west side of Patterson across from The
Argyle and the west side of Torcido between Argyle and Grant.
POLICY ANALYSIS
Sec. 3-8 – Use of Land and Buildings
Use of permitted establishments for institutions of a religious or philanthropic nature set out in this
chapter in 2F-C, MF-D, O-1, B-1, B-2, and B-3. Permitted institutions shall mean the institutions
categorized as special uses in the table of land uses in section 3-8 of the Zoning Code.
Sec. 3-21 – Required Off-street Parking
In the SF-A and SF-B District, off-street parking shall hereafter be provided on each lot or tract
upon which a building is erected or upon a contiguous lot or tract, and no building or structure or
part thereof, shall be hereafter erected, altered, converted or enlarged for any permitted use in the
district in which it is located unless off-street parking facilities are provided in accordance with
the section.
Sec. 3-84(2). - Special parking regulations.
A parking space shall be defined as an all-weather-surfaced area not located in any public rights-
of-way, together with an all-weather-surfaced driveway connecting the area with a street or alley
and permitting free ingress and egress thereto. All-weather surfaces include asphalt, concrete,
flagstone, brick pavers, concrete pavers and similar materials. Any parking adjacent to a public
street wherein the maneuvering is done on the public street shall not be classified as off-street
parking in computing the parking area requirements for any use. Approval of a ratio of compact
spaces to be provided in lieu of standard spaces.
STAFF FINDINGS
Texas BioMed and The Argyle have been granted numerous special exceptions and variances since
the original 1955 variance and special exception which permit its use as a private club, including,
but not limited to:
 934 Patterson (being the property subject to Board of Adjustment Resolution No. 134 dated
July 6, 1955);
 815 Patterson (being the property subject to Ordinance 1756 dated February 25, 2008);
 820 Patterson (being the property subject to Ordinance 1757 dated February 25, 2008);
 Deed to a 2,417 square feet tract of land (being the property described in Ordinance 2095
dated December 11, 2017; and
 423 Argyle (being the property subject to Ordinance 2114 dated November 13, 2018).
The proposed SUP requests to consolidate all prior Special Use Permits relating to The Argyle into
an omnibus SUP in keeping with the historic and current operations of The Argyle. The requested
SUP proposes adding a North Addition to the existing building in the existing parking lot on The
Argyle’s northwest corner. The requested SUP provides a parking plan for Club operations,
including access to leased off-site locations.
The case was originally heard by P&Z on November 4, 2024, where it was tabled until February
03, 2025.At the meeting, the Commission recommended a subcommittee of Commission members
meet with The Argyle and an organized group of neighbors to develop a compromise SUP prior to
the February 2025 meeting. In early 2025, the applicant rescheduled the case for March 03, 2025
and then April 07, 2025. In March 2025, the original SUP was withdrawn by the applicant, and a
revised SUP was submitted for April 2025 consideration. Staff rescheduled consideration of the
revised SUPfor theApril 15, 2025 special meeting. At theApril 15, 2025 special meeting, Planning
& Zoning Commission recommended approval of the revised SUP with the additional revisions
submitted by the applicant during the meeting – Aye: 8, Nay: 0.
The project will require further board review by the City Council for Final Architectural Review.
The Architectural Review Board’s Final Review on November 19, 2024 made a motion
recommending denial of the project – Aye: 3, Nay: 2.
Both the Final Architectural Review and SUP request are currently scheduled for consideration at
the April 28, 2025 City Council meeting.
FISCAL IMPACT
No projected fiscal impact from this project has been calculated.

A ZONING ORDINANCE GRANTING A SPECIFIC USE PERMIT FOR THE
OPERATION OF A PRIVATE PHILANTHROPIC CLUB (“THE ARGYLE”)
ON PROPERTY ZONED SINGLE FAMILY-A DISTRICT, AS AUTHORIZED
BY SECTION 3-87(22) OF THE ZONING CODE; PROVIDING FOR
SEVERABILITY; AND SETTING AN EFFECTIVE DATE.
WHEREAS, the property located at 934 Patterson Avenue, Alamo Heights, Texas, has been
continuously operated as a private dining club, with overnight sleeping accommodations for its
out-of-town members and guests since 1956 (“The Argyle”), and prior to 1956 served first as a
private residence and later as a restaurant and overnight inn since 1859.
WHEREAS, the Property served as the venue for all meetings of the Alamo Heights City Council
(the “City Council”) from 1922 to 1927;
WHEREAS, the Texas Biomedical Research Institute (originally part of the Foundation of
Applied Research, subsequently renamed the Southwest Foundation for Research and Education,
subsequently separated to form the Southwest Foundation for Biomedical Research, and
subsequently renamed the Texas Biomedical Research Institute) is a Texas non-profit corporation
conducting applied and fundamental research since 1941. This entity and its successors or assigns
shall be referred to as “Texas Biomed”;
WHEREAS, Texas Biomed acquired ownership of the Property in 1955 for the purpose of leasing
it to a newly formed private club named “The Argyle,” a Texas non-profit corporation whose
purpose is to provide financial support to Texas Biomed;
WHEREAS, The Argyle, in addition to providing financial support for Texas Biomed, also hosts
numerous meetings and educational presentations of Texas BioMed, its scientists, and other
research support organizations and other educational meetings and presentations approved in
advance by The Argyle Board (“Educational Events”).;
WHEREAS, The Argyle leased the Property in 1956, at which time it renovated and restored the
historic mansion on the property (built in 1859) and opened to its members for fine dining and
social events, continuing its prior use;
WHEREAS, Texas Biomed, as owner of the Property, was granted a variance and special
exception in Case No. 134 from the Board of Adjustment of the City of Alamo Heights on July 6,
1955;
WHEREAS, The Argyle was designated a Recorded Texas Historical Landmark by the Texas
Historical Commission in 1972;
WHEREAS, Texas Biomed and The Argyle have made various renovations to the Property over
the years;

WHEREAS, the City of Alamo Heights (the “COAH”) has issued all requisite building permits,
certificates of occupancy, and other necessary approvals for the prior renovations;
WHEREAS, Texas Biomed and The Argyle have been granted numerous special exceptions and
variances from the COAH since the original 1955 variance which have permitted its use as a
private club and place of entertainment and Educational Events consistent with its historic
beginning and current operations, including, but not limited to (collectively being defined as the
“Prior Entitlements”):
• 934 Patterson (being the property subject to Board of Adjustment Resolution
No. 134 dated July 6, 1955);
• 815 Patterson (being the property subject to Ordinance 1756 dated February 25,
2008);
• 820 Patterson (being the property subject to Ordinance 1757 dated February 25,
2008);
• Deed to a 2417 square feet tract of land (being the property described in
Ordinance 2095 dated December 11, 2017);
• 423 Argyle (being the property subject to Ordinance 2114 dated November 13,
2018);
WHEREAS, The Argyle submitted a Notice of Intent on November 17, 2021, for a proposed
addition to the existing building at 934 Patterson (the “North Addition”);
WHEREAS, on October 12, 2021, The Argyle received the approval of the Texas Historical
Commission for all prior renovations as well as the proposed North Addition;
WHEREAS, The Argyle submitted its Architectural Review Board Project Review Application
on December 23, 2021, and again in 2024;
WHEREAS, The Argyle submitted its Building Permit application for the North Addition on
February 11, 2022, which was assigned Project Number 49213;
WHEREAS, The Argyle submitted a revised Building Permit Application for the North Addition
on August 5, 2022, containing modifications to the scale of the North Addition, among other
revisions, and submitted a revised permit application on August 1, 2023;
WHEREAS, Texas Biomed has requested the COAH to consolidate all prior special use permits
relating to The Argyle into this omnibus Specific Use Permit (the “SUP”) in keeping with the
historic and current operations of The Argyle;
WHEREAS, The Argyle, Texas Biomed and the COAH intend to address the effects and
disturbance on the nearby residential districts by regulating the parking, noise, crowd management
and outdoor activities inherent in the historic and current operations of The Argyle upon the
completion of the North Addition;

WHEREAS, Texas Biomed submitted its application for an omnibus SUP on February 23, 2022,
and submitted a revised application on August 1, 2023;
WHEREAS, the Planning and Zoning Commission held a public hearing on November 4, 2024,
to consider approval of the prior SUP draft, and a motion was made and carried to table any action
at that time to allow further clarification of certain matters;
WHEREAS, Texas Biomed withdrew its application for approval of the prior SUP draft in
February 2025 in order to submit a revised application and SUP;
WHEREAS, the Planning and Zoning Commission, having considered this SUP application
following due notice and a public hearing, and having considered all required factors and made all
required findings set forth in the Texas Local Government Code and Code of Ordinances,
[approved/disapproved] by majority vote to recommend to City Council that this SUP be
[approved/disapproved];
WHEREAS, the City Council, having considered this SUP application following due notice and
a public hearing, and having considered all required factors and made all required findings set forth
in Texas Local Government Code and Code of Ordinances, has determined that this SUP should
be [approved/disapproved] subject to certain terms and conditions set forth herein;
WHEREAS, two public hearings were held to discuss the SUP application described herein; with
the first public hearing being conducted by the Planning & Zoning Commission on April 15, 2025,
and the second public hearing being conducted by City Council on April 28, 2025; each being
conducted for the purpose of providing all interested persons the opportunity to be heard
concerning the proposed SUP described herein;
WHEREAS, legal notice notifying the public of both public hearings on the requested SUP was
posted on the COAH’s official website and published in the Express News, a newspaper of general
circulation in the City of Alamo Heights, on ________________; and
WHEREAS, Texas Biomed and The Argyle find these conditions and enforcement provisions to
be reasonable;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALAMO HEIGHTS, TEXAS:
SECTION 1. SPECIFIC USE PERMIT APPROVED. Texas Biomed is granted a Specific Use
Permit, pursuant to Section 3-87 (22) of the Zoning Code, to operate, lease, or assign to a tenant,
subject to the conditions herein stated, a private philanthropic dinner club and place of
entertainment and Educational Events at a location on the following property (the “Property”) for
as long a period of time as the Property is owned by Texas Biomed or any other philanthropic,
charitable or non-profit entity whose primary purpose is to provide philanthropic support to Texas
Biomed:
• 934 Patterson (being the property subject to Board of Adjustment Resolution No.
134 dated July 6, 1955);

• 815 Patterson (being the property subject to Ordinance 1756 dated February 25,
2008);
• 820 Patterson (being the property subject to Ordinance 1757 dated February 25,
2008);
• A 2417 square feet tract of land (being the property described in Ordinance 2095
dated December 11, 2017);
• 423 Argyle (being the property subject to Ordinance 2114 dated November 13,
2018);
• The northernmost one hundred fifty feet (150’) of 401 Torcido (the “Tennis Court
Property”).
1) DEFINITIONS.
a. Maximum Occupancy. Maximum Occupancy for all permanent structures on the
Property upon completion of the North Addition will be 1100 persons. If an
event is partially hosted in an outdoor area, Maximum Occupancy will be no
more than 1200 persons.
b. North Addition. The North Addition is the improvement to the existing building
at 934 Patterson built substantially in accordance with plans titled ‘The Argyle
Permit Set’ dated February 09, 2023, for which a building permit application was
submitted to the COAH on August 3, 2023, as Project No. 2023-887.
c. Outdoor. Outside of a permanent structure on the Property.
d. Permitted Function. A Permitted Function is a special or social event held on the
Property other than normal dining and bar services for members and their guests.
e. Temporary Structure: Any Outdoor structure not on a permanent foundation,
including, but not limited to, event tents, food trucks, and sheds.
2) PERMITTED USES. Subject to the conditions herein, the Property may be used for
a private philanthropic and non-profit club supporting Texas Biomed, which includes
these limited activities:
a. dining and bar services for members and guests;
b. catering and hosting of indoor and/or Outdoor Permitted Functions;
c. off-street parking of vehicles, administrative offices, meeting rooms, and food
preparation supporting and associated with such use; and

d. five (5) guest units at 934 Patterson for temporary overnight lodging for members
and their guests.
3) OPERATIONAL REQUIREMENTS. The following requirements shall apply to
The Argyle, and its hosts, vendors, suppliers, subcontractors, licensees, and or invitees,
and shall be included in all contracts executed by The Argyle after the issuance of a
Certificate of Occupancy for the North Addition:
a. Valet. The Argyle shall provide complimentary off-street valet parking during
all Permitted Functions. Valet attendants shall park vehicles off-street within
areas designated on the Parking Diagram attached as Exhibit “A”. Valet drop-off
and pick-up must occur off-street but within the bounds of the Property in
accordance with the following:
i) 1-100 Attendees: four (4) valet attendants.
ii) Over 100 Attendees: four (4) valet attendants plus one (1) valet
attendant for each additional 50 attendees in excess of 100
attendees that are not scheduled to arrive by bus.
b. Rideshare. Rideshare drop-off and pick-up must occur off-street or within areas
designated on the Parking Diagram attached as Exhibit “A” (page 2).
c. Buses and other Commercial Vehicles. Bus pickup and drop-off must occur
only at the 934 Patterson curb, off-street, or within areas designated on the
Parking Diagram attached as Exhibit “A”. Buses are prohibited from on-street
idling (excluding direct loading and unloading) for more than five (5) minutes
except at the 281 Parking Area.
d. Security. Security shall be provided by The Argyle:
i) Under 250 Attendees: one (1) peace officer.
ii) 250-399 Attendees: two (2) peace officers.
iii) 400-499 Attendees: three (3) peace officers with one of those
officers dedicated to parking, traffic control, and other provisions
of this SUP.
iv) 500+ Attendees: four (4) peace officers with at least one of those
officers dedicated to parking, traffic control, and other provisions
of this SUP.
e. Lights. All lighting shall comply with Code of Ordinances.

f. Outdoor Event Activities. No Outdoor event activities such as food or bar
service may occur after 4:00 pm Sundays, 10:00 pm Monday – Thursday, or
12:00 midnight Friday and Saturday nights.
g. Guests. All guests (excluding overnight guests in a guest room) must depart
before 11:00 pm Sunday – Thursday or 1:00 am Saturday or Sunday morning.
h. No Amplified Music. Amplified music may not emanate from any Outside area
of the Property. Percussion instruments, including without limitation drums,
must not be played in any Outside area.
i. Temporary Structures. Temporary Structures intended to be utilized by
attendees (such as tents or canopies):
i) must be located within the property bounds of 934 Patterson, and
limited to the North and East side of the main structure; and
ii) shall be no larger than 44’ X 103’ (standard size designed for the
anchor infrastructure on The Argyle front lawn) to be used only if
the weather forecast during the preceding week indicates a
probability of rain.
j. Number of Events.
(i) In aggregate, there shall be no more than 52 events in the trailing
365 calendar days with contracted attendance between 250 and
1200 subject to the further limitations and provisions below and
herein, and there shall not be more than a single event in this
category per calendar day;
(ii) As a further restriction to item j(i) above, there shall be no more
than 10 events in the trailing 365 calendar days with contracted
attendance between 400 and 600;
(iii) As a further restriction to item j(i) above, there shall be no more
than 6 events in the trailing 365 calendar days with contracted
attendance between 601 and 750;
(iv) As a further restriction to item j(i) above, there shall be no more
than 2 events in the trailing 365 calendar days with contracted
attendance between 751 and 1200;
(v) For all events over 600 persons, The Argyle shall post a notice of
date, time, and number of expected attendees and availability of
parking on their publicly accessible website; and

(vi) The preceding caps on Number of Events do not include or restrict
historic holiday events such as Easter, Mother’s Day,
Thanksgiving, and Christmas, or any celebration of life or funeral
related events.
k. Leaf Blowers. The Argyle and its subcontractors shall not use gasoline leaf
blowers. It will only use electric or battery-operated blowers between the hours:
(i) Monday through Friday: 8:00 a.m. – 5:00 p.m.; and
(ii) Saturday and Sunday: 9:00 a.m. – 5:00 p.m.
l. Bi-Annual Meetings. The COAH will host and direct bi-annual meetings
between COAH representatives, The Argyle representatives, and any neighbors
owning real property which touches The Argyle property lines. Any street shall
be assumed to be zero width for the purpose of identifying these adjacent
properties. These meetings shall be limited to the subject of operational issues
under the SUP.
4) PROHIBITED USES. The Property may not be used for the following uses:
a. as a public event center or for trade shows, spectator sporting events, conventions
or other functions open to the general public; provided, however, community-
wide and Educational Events open to the public are permitted;
b. for on-premises retail sales other than The Argyle’s dining and bar service.
c. To raise funds for any non-member or entity other than Texas Biomed (excluding
political events hosted by a member and approved by The Argyle Board) or
commercially advertised goods or services of any non-member or entity other
than Texas Biomed.
d. Functions at the Property are limited to private matters by invitation only,
approved by the governing body of The Argyle, not open to the general public,
and must comply with all requirements of this ordinance.
5) NORTH ADDITION. The North Addition may be constructed in compliance with
plans submitted to the COAH and incorporated by reference for all purposes herein
and is further subject to all applicable building codes and the requirements of this
omnibus SUP. A rear buffer space wherein no permanent or temporary structures,
equipment or signs (save and except for otherwise allowable walls or fences) may be
erected within ten feet (10’) of the property line as established on the portion of the
Property adjoining Olmos Dam Drive subject to the COAH approval process.
6) PARKING. As a condition precedent to the issuance of a final Certificate of
Occupancy for the North Addition:

a. Parking requirements shall comply with the approved on-street and off-street
Parking Diagram attached hereto as Exhibit “A” and incorporated herein by
reference which shall identify total available off-street parking spots, including
requirements for off-site employee and vendor parking, and rideshare and traffic
flow patterns. In addition, all of the applicable provisions of this Section 1,
subsection 3 (Operational Requirements), parts (a-c) are incorporated herein by
reference;
b. The Argyle shall construct or otherwise provide for off-street drop-off and pick-
up pull-through lanes within the bounds of the Property for valet and rideshare
services suitable for eight (8) queuing passenger vehicles which are clearly
marked and striped and on an all-weather surface, and as otherwise provided in
Exhibit “A”;
c. The Argyle shall construct a parking lot on (a) the Tennis Court Property for off-
street parking consisting of no less than 56 spaces and (b) on an area located to
the west of The Argyle under the Highway 281 overpass on E. Olmos Drive
consisting of no less than 108 spaces (the “281 Parking Area”). The Tennis Court
Property parking shall be in accordance with the Code of Ordinances as it applies
to the Parking District and subject to the COAH approval process, and shall be
shielded visually from any property outside of the Property, by a ten foot (10’)
wide landscape buffer adjacent to public ROW, and fencing no less than six feet
(6’) tall to minimize sound and light impacts to any adjacent lots which have a
residential use. The 281 Parking Area shall be constructed in accordance with
the requirements of the Texas Department of Transportation; and
d. If any parking indicated on the Parking Diagram attached as Exhibit “A” is no
longer available to be used by The Argyle, there will be a reduction in Maximum
Occupancy in a ratio of 2-to-1 for each space lost unless replacement off-street
parking is procured via purchase, lease or written agreement, in locations
acceptable to the local municipality governing where such replacement parking
is located.
e. The Argyle or Texas Biomed shall not purchase any additional properties within
the City of Alamo Heights other than the property located at 401 Torcido. The
portion of the 401 Torcido property not included in the Tennis Court Property
parking lot must remain single-family residential zoned.
7) ENFORCEMENT AND PENALTIES.
a. The persons who may be cited for and are responsible for violations of the
conditions of this SUP are The Argyle, its governance board, manager, or
employee in charge. For violations of valet, bus, rideshare, and outdoor structure
regulations, the operator and/or employees of the applicable valet service, bus,

rideshare vehicle operator, or tent/outdoor structure rental company may be
cited in addition to the individuals identified in the preceding sentence.
b. The COAH is entitled to pursue all other criminal and civil remedies to which it
is entitled under authority of statutes or other ordinances against a person, firm,
or corporation that remains in violation of this chapter.
SECTION 2. PUBLIC PURPOSE. The City Council finds that the SUP herein approved
complies with all applicable rules and regulations set forth in the COAH’s Code of Ordinances
and other law and is consistent with the COAH’s Comprehensive Master Plan.
SECTION 3. INCORPORATING RECITALS. The City Council approves the recitals hereto
and incorporates them herein as findings of fact.
SECTION 4. REPEALING ORDINANCES IN CONFLICT AND SAVINGS CLAUSE. All
ordinances or parts of ordinances in conflict herewith (including the Prior Entitlements) are hereby
repealed to the extent of such conflict with all remaining portions not conflicting being saved from
repeal herein.
SECTION 5. SEVERABILITY. If any section, subsection, sentence, clause, or phrase of this
ordinance is for any reason held to be unconstitutional or illegal, such decision shall not affect the
validity of the remaining sections of this ordinance. The City Council hereby declares that it would
have passed this ordinance, and each section, subsection, clause, or phrase thereof, irrespective of
the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared void.
SECTION 6. REVOCATION OF SPECIFIC USE PERMIT. This SUP may be suspended,
revoked, or modified by the City Council, after public hearing, notice and report by the Planning
and Zoning Commission pursuant to Texas Local Government Code 211 to determine whether any
condition, stipulation, or term of the approval of this SUP has been knowingly violated. In addition
and without any public hearing or public action, this SUP may be revoked and terminated
following written notice to The Argyle and a subsequent ninety (90) day cure period if: (i) the
Property is no longer owned by Texas Biomed or any other philanthropic, charitable or non-profit
entity supporting Texas Biomed; or (ii) the North Addition is not completed within twenty-four
(24) months after the building permit is issued unless there are delays due to force majeure events,
threatened or actual legal action, or other delays in the construction process beyond The Argyle’s
control.
SECTION 7. EFFECTIVE DATE. The Ordinance shall be effective immediately following
approval by City Council.

I am writing to express my opposition to the Argyle expansion. Last week there were two large events at the Argyle, a
600 person luncheon on April 14th, and then Easter. Having lived at 4 Albertina Lane for 43 years I have become
accustomed to occasional large events at the Argyle. What happened in my neighborhood last week was alarming.
The amount of speeding traffic up and down Torcido and Argyle was dangerous. The valet parkers were scrambling to
park cars on the 200 Patterson field on Easter and the employees were parking at Cathedral Park on the 14th. The
traffic on Argyle was so chaotic on Easter I was unable to pull out of Albertina for a brief period. This situation poses a
real problem and is a serious safety issue for the residents who live in this neighborhood.
I could ignore this if, as in the past, I knew that it didn't happen that often. With the proposed expansion and the real
possibility of this becoming a much more frequent occurence, this is now completely unsustainable.
I urge you to vote to oppose this expansion for the safety and well being of the residents of Alamo heights.

Dear Board Members,
As a neighbor, member of the Argyle, and architect, I would like to address, not the appearance of the building, but
the impact that this proposed specific use permit and building will have upon the neighborhood. With the huge
up ck on events as outlined in SUP, (112, an average of one event every 3 days) the neighborhood is going to be
flooded with traffic, service and parking challenges that dwarf an already strained condi on.
To handle all of this addi onal traffic, the Argyle is proposing one addi onal parking lot to the south of the Argyle
(ne ng just 12 addi onal parking spaces) and an ill-defined bus and valet service to a very remote “leased lot” on
the other side of the Olmos Basin.
Now let’s imagine this: the streets around the Argyle, which traverse the Olmos Basin, are the most popular
walking and biking corridors of the neighborhood. These roads are narrow, curvy, hilly and quiet. Now add buses,
cars and alcohol to these pedestrian corridors, roads that can barely handle two cars going in different direc ons.
The possibili es for casual es will be huge, and what were once lovely strolling streets are no longer. And imagine
the confusion of Ubers and visitors arriving and depar ng among this very challenged valet system with the
policing and management of this whole complex parking mess ul mately falling on the city. These plans are not
taking us in a good direc on.
The current ac vi es at the Argyle, with its lawn par es, traffic, parking and service vehicles are already a nuisance
to the neighborhood and well beyond the quiet dining club that was permi ed in 1955. It is me to ask the Argyle
to be a be er neighbor, to focus on fixing these current condi ons, and certainly not building a facility that will
exacerbate those condi ons and change the neighborhood forever.
Build it and they will come and keep on coming may be great business plan for the Argyle, but it is terrible for the
neighborhood. We ask that you not approve this building based upon its nega ve impact upon our neighborhood.

I am not a member of the Argyle, however I have enjoyed memorable dining experiences there.
Until about fourteen years ago, I viewed the Argyle as a welcome neighbor and an attribute to our city. Since that time , my
attitude has shifted and I now view the Argyle as problem for our neighborhood.
In the last decade there has been considerable noise and traffic impacts upon our neighborhood. While I applaud the Agyle in
their current effort to address traffic,noise, and safety issues , the current SUP lacks clarity and accountability .
I urge the City of Alamo Heights and the Planning and Zoning Board to NOT APPROVE this SUP .
The Argyle should be commended for engaging the neighborhood and in particular the closet neighbors to the Argyle . Please

Dear Planning and Zoning Commissioners,
I write in opposition to approval of The Argyle’s Special Use permit.
I have owned 210 Morton Street since 1989, buying the 1922 house from the Graham family as the second owner. I was
fortunate to raise my family there. My son lives there now with his own family.
These nearby blocks are a pleasant scene for generations of walkers, bicyclists, and spontaneous street-side chats
between people ranging from the very old to the very young. Every large Argyle party leaves many cars on the street
overnight, materially impacting residents’ use. Street parking overnight is not allowed for residents so why are Argyle
guests allowed to do so? If we want to have a party of our own, personal guests must contend with current Argyle
congestion. Imagine what it would be like with expanded volume. During these events it feels like living near a bar-
restaurant, however, without access.
The proposed ordinance would increase the number of people allowed from 9 parties of 300+ people to 117 parties of
250+ people. With greater crowd size and frequency of events comes more security risk. The guest numbers stated in the
proposed permit will not fit into the parking scheme delineated, is below code, and will flood the streets with cars. Bus
shuttles add congestion. The intention stated by The Argyle to discourage neighborhood parking is not enforceable, nor is
the promise not to purchase additional properties for surface parking. Revelry of this proposed magnitude and the new
development itself will cause concentric devaluation of property values in a neighborhood like ours.
When I happily chose to live one block and two doors from The Argyle, it was a breathtaking site anchored by a fine
historic house serenely floating in an almost rural landscape. Club functions were subordinated to those essential qualities,
which the members and the neighbors cherished. The original appearance and configuration of the club enhanced the
image of Alamo Heights and San Antonio as a gracious place. Each addition thus far has managed to hold onto its
traditional heritage as intended by the founders.
I believe that the present effort by Argyle leadership to transform the private facility into a very large party and event
center is going to drastically erode the quality of life and reduce the safety of the area. Why do we have to bear the burden
of this massive expansion of activities for an exclusive clientele?
Please do not pass this ordinance. Thank you.

orchestra. While I was away, my ‘home’ orchestra, the San Antonio Symphony filed for bankruptcy. In the fall, after such an
extended stay away, I look forward to returning to my home of some 30 years in Alamo Heights, 420 Ogden Lane. It is a small
house but it has been home for my husband and myself and a history of beautiful canine souls. It is HOME. It is part of
a community of homes where you know your neighbors, you wake up in the middle of the night to a deep quiet, a peacefulness.
A quiet so dense you hear your nervous system humming. Dallas is not that, and I am living in a residential neighborhood. Traffic
and noise and people, lots of people with no regard for place and purpose of a place. I have pined for that sense of place, my
Alamo Heights. To think that my elected officials - and yes, I vote - would turn a blind ear to the dozens of tax paying home
owners like myself and my colleagues and friends throughout Alamo Heights to this expansion for the wealthy, gives me grave
pause. Shame on them for not hearing our voice. We are Alamo Heights. Protect what has made Alamo Heights what it is today.
A community. Not a luxury destination for visitors who have no concern for our unique and rare corner of the world. You have
the power to do that still, right now. Turn down this Argyle expansion. Their wealth can purchase destinations with far less
restrictions elsewhere where they are not in someone’s backyard and community.

I live with my husband at 243 Encino Avenue, in a house that was built in 1929 and write in opposition to the further
expansion of the Argyle .
When deciding where to live there was no question that we wanted our first home to be
in Old Alamo Heights, the home in which we still reside all these years later.
Where we live is all about the neighborhood...what kind of environment we choose to live in..
For those who have chosen Old Alamo Heights...it is not only the beautiful oak trees...the wonderful location.... that is
central to so much and yet so perfect for walking and biking..but the peacefulness..
the quiet ..the calm. ... where you can listen to to the chirping song of birds...see the eagles and
hawks soar...have a oneness with nature..
This is in sharp contrast to the chaotic noisy car-filled areas now surrounding the Argyle and encroaching bit by bit
ever further into the surrounding neighborhood....no beautiful walking there... walking around all the ugly Argyle
cones further reminders of the destruction of our once calm neighborhood.
Definitely not a place to ride, walk or jog and get in touch with your inner self and have quiet
time for your thoughts....strangers constantly getting out of cars in front of neighbors lawns...
constant bustle..constant deliveries in and out...guests in and out ...staff in and out day after day..
It is time that the Argyle becomes a good neighbor to the wonderful neighborhood where it is situated.
Instead of further destruction, The Argyle should ask how they can help the neighborhood get
back to its roots.

Dear Board Members,
As a neighbor, member of the Argyle, and architect, I would like to address, not the appearance of the
building, but the impact that this proposed specific use permit and building will have upon the
neighborhood. With the huge uptick on events as outlined in the SUP, the neighborhood is going to be
flooded with traffic, service and parking challenges that dwarf an already strained condition.
To handle all of this additional traffic, the Argyle is proposing one additional parking lot to the south of
the Argyle, and a bus and valet service to remote lots at the Episcopal Diocese, 281 underpass, and the
Alamo Heights Swimming Pool.
Now let’s imagine this: the streets connecting the Diocese and the Pool, which traverse the Olmos Basin,
are the most popular walking and biking corridors of the neighborhood And these roads are narrow,
curvy, hilly and quiet. Now add buses, cars and alcohol to these pedestrian corridors, roads that can
barely handle two cars going in different directions, the possibilities for casualties will be huge, and, what
were once lovely strolling streets are no longer. And imagine the confusion of Ubers and visitors arriving
and departing among all of this ill-defined valet system with the policing and management of this whole
complex parking mess ultimately falling on the city. These plans are not taking us in a good direction.
The current activities at the Argyle, with its lawn parties, traffic, parking and service vehicles, are already a
nuisance to the neighborhood and well beyond the quiet dining club that was permitted in 1955. It is
time to ask the Argyle to be a better neighbor, to focus on fixing these current conditions, and certainly
not building a facility that will exacerbate those conditions and change the neighborhood forever.
Build it and they will come and keep on coming may be a great business plan for the Argyle, but it is
terrible for the neighborhood. We ask that you not approve this building based upon its negative impact
upon our neighborhood.

Hi Buddy, I have lived in a 100 plus year old centennial house since 1985.
I have been going to the argyle since I was 11. It has historically operated as a small private dinner club.
Our home located at 101 claiborne way is within earshot and traffic pattern of the argyle. For the first 20 years I
lived here things went smoothly enough with the argyle as a small private dinner club.
During the last 19 years things have gotten progressively noisier, more congested and less friendly to the argyle
neighbors.
Is Alamo heights leadership here to serve residents of Alamo heights or to allow the argyle to grow..causing more
noise, more congestion and more risk?
With the plan for expansion, the Alamo heights police force is going to have the added responsibility of monitoring
illegal parking around the argyle, including all the side streets and overflow into nearby streets.
The unsatisfactory parking proposals will only exacerbate the problem.
The Alamo heights police will also need to be sending extra manpower to make sure celebrants at argyle events
are not driving while intoxicated.
Our homes will be subject to more people entering our neighborhood, which could lead to more break-ins and
theft.
One of the benefits of living near the nature trails, the little league fields and the swimming pool is that it allows all
residents of Alamo heights to enjoy family fun and sport events together.
Daytime events, which the argyle is proposing they will have more of, will increase traffic in and around these
locales with pedestrians of all ages at risk of the increased vehicular traffic in these areas.
From what I have gleaned by attending the hearings about the argyle expansion, the argyle has already broken
promises and lost their variances. All the while nothing seems to stop these illegal activities.
What is our recourse? We are counting on you to stand up for our neighborhood as the city council of Alamo
heights.

CITY OF ALAMO HEIGHTS COMMUNITY DEVELOPMENT SERVICES DEPARTMENT CITY COUNCIL AGENDA MEMORANDUM TO: Mayor & City Council Members FROM: Lety Hernandez, Director of Community Development SUBJECT: Case No. 444 Public hearing, consideration, and action regarding a request of Beth Smith of The Argyle, applicant, representing the Texas Biomedical Research Institute, owner, for a Specific Use Permit (SUP) to add on north side of existing building an addition at 934 Patterson and to consolidate all prior Specific Use Permits relating to The Argyle into an omnibus SUP to support its operation of a dining, social club and venue on the premises located at 934 Patterson Ave, 815 Patterson Ave, 820 Patterson Ave, 423 Argyle Ave, a 2,417sq ft tract of land, and the northernmost one hundred fifty fee (150ft) of 401 Torcido Dr all zoned Single Family District (SF- A). DATE: April 28, 2025 SUMMARY The applicant is requesting a Specific Use Permit (SUP) for approval to add on north side of existing building an addition of 9,904 square feet at 934 Patterson and to consolidate all prior Specific Use Permits relating to The Argyle into an omnibus SUP to support its operation of a dining, social club and venue at associated premises located at 934 Patterson Ave, 815 Patterson Ave, 820 Patterson Ave, 423 Argyle Ave, a 2,417sq ft tract of land, and the northernmost one hundred fifty fee (150ft) of 401 Torcido Dr. The case was tabled at the November 04, 2024 meeting until February 03, 2025 and rescheduled a number of times ultimately to the April 15, 2025 Special Meeting. Since the November 2024 meeting, the requested SUP was revised by the applicant and resubmitted for consideration. Planning & Zoning recommended approval of the revised SUP with additional revisions submitted during the April 15th Special Meeting. BACKGROUND INFORMATION The properties are zoned SF-A and The Argyle is on the east side of Patterson between Argyle and Estes/Crescent and off-street parking is located on the west side of Patterson across from The Argyle and the west side of Torcido between Argyle and Grant.

POLICY ANALYSIS Sec. 3-8 – Use of Land and Buildings Use of permitted establishments for institutions of a religious or philanthropic nature set out in this chapter in 2F-C, MF-D, O-1, B-1, B-2, and B-3. Permitted institutions shall mean the institutions categorized as special uses in the table of land uses in section 3-8 of the Zoning Code. Sec. 3-21 – Required Off-street Parking In the SF-A and SF-B District, off-street parking shall hereafter be provided on each lot or tract upon which a building is erected or upon a contiguous lot or tract, and no building or structure or part thereof, shall be hereafter erected, altered, converted or enlarged for any permitted use in the district in which it is located unless off-street parking facilities are provided in accordance with the section. Sec. 3-84(2). - Special parking regulations. A parking space shall be defined as an all-weather-surfaced area not located in any public rights- of-way, together with an all-weather-surfaced driveway connecting the area with a street or alley and permitting free ingress and egress thereto. All-weather surfaces include asphalt, concrete, flagstone, brick pavers, concrete pavers and similar materials. Any parking adjacent to a public street wherein the maneuvering is done on the public street shall not be classified as off-street parking in computing the parking area requirements for any use. Approval of a ratio of compact spaces to be provided in lieu of standard spaces. STAFF FINDINGS Texas BioMed and The Argyle have been granted numerous special exceptions and variances since the original 1955 variance and special exception which permit its use as a private club, including, but not limited to:  934 Patterson (being the property subject to Board of Adjustment Resolution No. 134 dated July 6, 1955);  815 Patterson (being the property subject to Ordinance 1756 dated February 25, 2008);
  • 3.  820 Patterson (being the property subject to Ordinance 1757 dated February 25, 2008);  Deed to a 2,417 square feet tract of land (being the property described in Ordinance 2095 dated December 11, 2017; and  423 Argyle (being the property subject to Ordinance 2114 dated November 13, 2018). The proposed SUP requests to consolidate all prior Special Use Permits relating to The Argyle into an omnibus SUP in keeping with the historic and current operations of The Argyle. The requested SUP proposes adding a North Addition to the existing building in the existing parking lot on The Argyle’s northwest corner. The requested SUP provides a parking plan for Club operations, including access to leased off-site locations. The case was originally heard by P&Z on November 4, 2024, where it was tabled until February 03, 2025.At the meeting, the Commission recommended a subcommittee of Commission members meet with The Argyle and an organized group of neighbors to develop a compromise SUP prior to the February 2025 meeting. In early 2025, the applicant rescheduled the case for March 03, 2025 and then April 07, 2025. In March 2025, the original SUP was withdrawn by the applicant, and a revised SUP was submitted for April 2025 consideration. Staff rescheduled consideration of the revised SUPfor theApril 15, 2025 special meeting. At theApril 15, 2025 special meeting, Planning & Zoning Commission recommended approval of the revised SUP with the additional revisions submitted by the applicant during the meeting – Aye: 8, Nay: 0. The project will require further board review by the City Council for Final Architectural Review. The Architectural Review Board’s Final Review on November 19, 2024 made a motion recommending denial of the project – Aye: 3, Nay: 2. Both the Final Architectural Review and SUP request are currently scheduled for consideration at the April 28, 2025 City Council meeting. FISCAL IMPACT No projected fiscal impact from this project has been calculated.   • 4. 1 ORDINANCE NO.__________________ A ZONING ORDINANCE GRANTING A SPECIFIC USE PERMIT FOR THE OPERATION OF A PRIVATE PHILANTHROPIC CLUB (“THE ARGYLE”) ON PROPERTY ZONED SINGLE FAMILY-A DISTRICT, AS AUTHORIZED BY SECTION 3-87(22) OF THE ZONING CODE; PROVIDING FOR SEVERABILITY; AND SETTING AN EFFECTIVE DATE. WHEREAS, the property located at 934 Patterson Avenue, Alamo Heights, Texas, has been continuously operated as a private dining club, with overnight sleeping accommodations for its out-of-town members and guests since 1956 (“The Argyle”), and prior to 1956 served first as a private residence and later as a restaurant and overnight inn since 1859. WHEREAS, the Property served as the venue for all meetings of the Alamo Heights City Council (the “City Council”) from 1922 to 1927; WHEREAS, the Texas Biomedical Research Institute (originally part of the Foundation of Applied Research, subsequently renamed the Southwest Foundation for Research and Education, subsequently separated to form the Southwest Foundation for Biomedical Research, and subsequently renamed the Texas Biomedical Research Institute) is a Texas non-profit corporation conducting applied and fundamental research since 1941. This entity and its successors or assigns shall be referred to as “Texas Biomed”; WHEREAS, Texas Biomed acquired ownership of the Property in 1955 for the purpose of leasing it to a newly formed private club named “The Argyle,” a Texas non-profit corporation whose purpose is to provide financial support to Texas Biomed; WHEREAS, The Argyle, in addition to providing financial support for Texas Biomed, also hosts numerous meetings and educational presentations of Texas BioMed, its scientists, and other research support organizations and other educational meetings and presentations approved in advance by The Argyle Board (“Educational Events”).; WHEREAS, The Argyle leased the Property in 1956, at which time it renovated and restored the historic mansion on the property (built in 1859) and opened to its members for fine dining and social events, continuing its prior use; WHEREAS, Texas Biomed, as owner of the Property, was granted a variance and special exception in Case No. 134 from the Board of Adjustment of the City of Alamo Heights on July 6, 1955; WHEREAS, The Argyle was designated a Recorded Texas Historical Landmark by the Texas Historical Commission in 1972; WHEREAS, Texas Biomed and The Argyle have made various renovations to the Property over the years; Attachment A
  • 5. 2 WHEREAS, the City of Alamo Heights (the “COAH”) has issued all requisite building permits, certificates of occupancy, and other necessary approvals for the prior renovations; WHEREAS, Texas Biomed and The Argyle have been granted numerous special exceptions and variances from the COAH since the original 1955 variance which have permitted its use as a private club and place of entertainment and Educational Events consistent with its historic beginning and current operations, including, but not limited to (collectively being defined as the “Prior Entitlements”): • 934 Patterson (being the property subject to Board of Adjustment Resolution No. 134 dated July 6, 1955); • 815 Patterson (being the property subject to Ordinance 1756 dated February 25, 2008); • 820 Patterson (being the property subject to Ordinance 1757 dated February 25, 2008); • Deed to a 2417 square feet tract of land (being the property described in Ordinance 2095 dated December 11, 2017); • 423 Argyle (being the property subject to Ordinance 2114 dated November 13, 2018); WHEREAS, The Argyle submitted a Notice of Intent on November 17, 2021, for a proposed addition to the existing building at 934 Patterson (the “North Addition”); WHEREAS, on October 12, 2021, The Argyle received the approval of the Texas Historical Commission for all prior renovations as well as the proposed North Addition; WHEREAS, The Argyle submitted its Architectural Review Board Project Review Application on December 23, 2021, and again in 2024; WHEREAS, The Argyle submitted its Building Permit application for the North Addition on February 11, 2022, which was assigned Project Number 49213; WHEREAS, The Argyle submitted a revised Building Permit Application for the North Addition on August 5, 2022, containing modifications to the scale of the North Addition, among other revisions, and submitted a revised permit application on August 1, 2023; WHEREAS, Texas Biomed has requested the COAH to consolidate all prior special use permits relating to The Argyle into this omnibus Specific Use Permit (the “SUP”) in keeping with the historic and current operations of The Argyle; WHEREAS, The Argyle, Texas Biomed and the COAH intend to address the effects and disturbance on the nearby residential districts by regulating the parking, noise, crowd management and outdoor activities inherent in the historic and current operations of The Argyle upon the completion of the North Addition; Attachment A
  • 6. 3 WHEREAS, Texas Biomed submitted its application for an omnibus SUP on February 23, 2022, and submitted a revised application on August 1, 2023; WHEREAS, the Planning and Zoning Commission held a public hearing on November 4, 2024, to consider approval of the prior SUP draft, and a motion was made and carried to table any action at that time to allow further clarification of certain matters; WHEREAS, Texas Biomed withdrew its application for approval of the prior SUP draft in February 2025 in order to submit a revised application and SUP; WHEREAS, the Planning and Zoning Commission, having considered this SUP application following due notice and a public hearing, and having considered all required factors and made all required findings set forth in the Texas Local Government Code and Code of Ordinances, [approved/disapproved] by majority vote to recommend to City Council that this SUP be [approved/disapproved]; WHEREAS, the City Council, having considered this SUP application following due notice and a public hearing, and having considered all required factors and made all required findings set forth in Texas Local Government Code and Code of Ordinances, has determined that this SUP should be [approved/disapproved] subject to certain terms and conditions set forth herein; WHEREAS, two public hearings were held to discuss the SUP application described herein; with the first public hearing being conducted by the Planning & Zoning Commission on April 15, 2025, and the second public hearing being conducted by City Council on April 28, 2025; each being conducted for the purpose of providing all interested persons the opportunity to be heard concerning the proposed SUP described herein; WHEREAS, legal notice notifying the public of both public hearings on the requested SUP was posted on the COAH’s official website and published in the Express News, a newspaper of general circulation in the City of Alamo Heights, on ________________; and WHEREAS, Texas Biomed and The Argyle find these conditions and enforcement provisions to be reasonable; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALAMO HEIGHTS, TEXAS: SECTION 1. SPECIFIC USE PERMIT APPROVED. Texas Biomed is granted a Specific Use Permit, pursuant to Section 3-87 (22) of the Zoning Code, to operate, lease, or assign to a tenant, subject to the conditions herein stated, a private philanthropic dinner club and place of entertainment and Educational Events at a location on the following property (the “Property”) for as long a period of time as the Property is owned by Texas Biomed or any other philanthropic, charitable or non-profit entity whose primary purpose is to provide philanthropic support to Texas Biomed: • 934 Patterson (being the property subject to Board of Adjustment Resolution No. 134 dated July 6, 1955); Attachment A
  • 7. 4 • 815 Patterson (being the property subject to Ordinance 1756 dated February 25, 2008); • 820 Patterson (being the property subject to Ordinance 1757 dated February 25, 2008); • A 2417 square feet tract of land (being the property described in Ordinance 2095 dated December 11, 2017); • 423 Argyle (being the property subject to Ordinance 2114 dated November 13, 2018); • The northernmost one hundred fifty feet (150’) of 401 Torcido (the “Tennis Court Property”). 1) DEFINITIONS. a. Maximum Occupancy. Maximum Occupancy for all permanent structures on the Property upon completion of the North Addition will be 1100 persons. If an event is partially hosted in an outdoor area, Maximum Occupancy will be no more than 1200 persons. b. North Addition. The North Addition is the improvement to the existing building at 934 Patterson built substantially in accordance with plans titled ‘The Argyle Permit Set’ dated February 09, 2023, for which a building permit application was submitted to the COAH on August 3, 2023, as Project No. 2023-887. c. Outdoor. Outside of a permanent structure on the Property. d. Permitted Function. A Permitted Function is a special or social event held on the Property other than normal dining and bar services for members and their guests. e. Temporary Structure: Any Outdoor structure not on a permanent foundation, including, but not limited to, event tents, food trucks, and sheds. 2) PERMITTED USES. Subject to the conditions herein, the Property may be used for a private philanthropic and non-profit club supporting Texas Biomed, which includes these limited activities: a. dining and bar services for members and guests; b. catering and hosting of indoor and/or Outdoor Permitted Functions; c. off-street parking of vehicles, administrative offices, meeting rooms, and food preparation supporting and associated with such use; and Attachment A
  • 8. 5 d. five (5) guest units at 934 Patterson for temporary overnight lodging for members and their guests. 3) OPERATIONAL REQUIREMENTS. The following requirements shall apply to The Argyle, and its hosts, vendors, suppliers, subcontractors, licensees, and or invitees, and shall be included in all contracts executed by The Argyle after the issuance of a Certificate of Occupancy for the North Addition: a. Valet. The Argyle shall provide complimentary off-street valet parking during all Permitted Functions. Valet attendants shall park vehicles off-street within areas designated on the Parking Diagram attached as Exhibit “A”. Valet drop-off and pick-up must occur off-street but within the bounds of the Property in accordance with the following: i) 1-100 Attendees: four (4) valet attendants. ii) Over 100 Attendees: four (4) valet attendants plus one (1) valet attendant for each additional 50 attendees in excess of 100 attendees that are not scheduled to arrive by bus. b. Rideshare. Rideshare drop-off and pick-up must occur off-street or within areas designated on the Parking Diagram attached as Exhibit “A” (page 2). c. Buses and other Commercial Vehicles. Bus pickup and drop-off must occur only at the 934 Patterson curb, off-street, or within areas designated on the Parking Diagram attached as Exhibit “A”. Buses are prohibited from on-street idling (excluding direct loading and unloading) for more than five (5) minutes except at the 281 Parking Area. d. Security. Security shall be provided by The Argyle: i) Under 250 Attendees: one (1) peace officer. ii) 250-399 Attendees: two (2) peace officers. iii) 400-499 Attendees: three (3) peace officers with one of those officers dedicated to parking, traffic control, and other provisions of this SUP. iv) 500+ Attendees: four (4) peace officers with at least one of those officers dedicated to parking, traffic control, and other provisions of this SUP. e. Lights. All lighting shall comply with Code of Ordinances. Attachment A
  • 9. 6 f. Outdoor Event Activities. No Outdoor event activities such as food or bar service may occur after 4:00 pm Sundays, 10:00 pm Monday – Thursday, or 12:00 midnight Friday and Saturday nights. g. Guests. All guests (excluding overnight guests in a guest room) must depart before 11:00 pm Sunday – Thursday or 1:00 am Saturday or Sunday morning. h. No Amplified Music. Amplified music may not emanate from any Outside area of the Property. Percussion instruments, including without limitation drums, must not be played in any Outside area. i. Temporary Structures. Temporary Structures intended to be utilized by attendees (such as tents or canopies): i) must be located within the property bounds of 934 Patterson, and limited to the North and East side of the main structure; and ii) shall be no larger than 44’ X 103’ (standard size designed for the anchor infrastructure on The Argyle front lawn) to be used only if the weather forecast during the preceding week indicates a probability of rain. j. Number of Events. (i) In aggregate, there shall be no more than 52 events in the trailing 365 calendar days with contracted attendance between 250 and 1200 subject to the further limitations and provisions below and herein, and there shall not be more than a single event in this category per calendar day; (ii) As a further restriction to item j(i) above, there shall be no more than 10 events in the trailing 365 calendar days with contracted attendance between 400 and 600; (iii) As a further restriction to item j(i) above, there shall be no more than 6 events in the trailing 365 calendar days with contracted attendance between 601 and 750; (iv) As a further restriction to item j(i) above, there shall be no more than 2 events in the trailing 365 calendar days with contracted attendance between 751 and 1200; (v) For all events over 600 persons, The Argyle shall post a notice of date, time, and number of expected attendees and availability of parking on their publicly accessible website; and Attachment A
  • 10. 7 (vi) The preceding caps on Number of Events do not include or restrict historic holiday events such as Easter, Mother’s Day, Thanksgiving, and Christmas, or any celebration of life or funeral related events. k. Leaf Blowers. The Argyle and its subcontractors shall not use gasoline leaf blowers. It will only use electric or battery-operated blowers between the hours: (i) Monday through Friday: 8:00 a.m. – 5:00 p.m.; and (ii) Saturday and Sunday: 9:00 a.m. – 5:00 p.m. l. Bi-Annual Meetings. The COAH will host and direct bi-annual meetings between COAH representatives, The Argyle representatives, and any neighbors owning real property which touches The Argyle property lines. Any street shall be assumed to be zero width for the purpose of identifying these adjacent properties. These meetings shall be limited to the subject of operational issues under the SUP. 4) PROHIBITED USES. The Property may not be used for the following uses: a. as a public event center or for trade shows, spectator sporting events, conventions or other functions open to the general public; provided, however, community- wide and Educational Events open to the public are permitted; b. for on-premises retail sales other than The Argyle’s dining and bar service. c. To raise funds for any non-member or entity other than Texas Biomed (excluding political events hosted by a member and approved by The Argyle Board) or commercially advertised goods or services of any non-member or entity other than Texas Biomed. d. Functions at the Property are limited to private matters by invitation only, approved by the governing body of The Argyle, not open to the general public, and must comply with all requirements of this ordinance. 5) NORTH ADDITION. The North Addition may be constructed in compliance with plans submitted to the COAH and incorporated by reference for all purposes herein and is further subject to all applicable building codes and the requirements of this omnibus SUP. A rear buffer space wherein no permanent or temporary structures, equipment or signs (save and except for otherwise allowable walls or fences) may be erected within ten feet (10’) of the property line as established on the portion of the Property adjoining Olmos Dam Drive subject to the COAH approval process. 6) PARKING. As a condition precedent to the issuance of a final Certificate of Occupancy for the North Addition: Attachment A

Parking requirements shall comply with the approved on-street and off-street Parking Diagram attached hereto as Exhibit “A” and incorporated herein by reference which shall identify total available off-street parking spots, including requirements for off-site employee and vendor parking, and rideshare and traffic flow patterns. In addition, all of the applicable provisions of this Section 1, subsection 3 (Operational Requirements), parts (a-c) are incorporated herein by reference; b. The Argyle shall construct or otherwise provide for off-street drop-off and pick- up pull-through lanes within the bounds of the Property for valet and rideshare services suitable for eight (8) queuing passenger vehicles which are clearly marked and striped and on an all-weather surface, and as otherwise provided in Exhibit “A”; c. The Argyle shall construct a parking lot on (a) the Tennis Court Property for off- street parking consisting of no less than 56 spaces and (b) on an area located to the west of The Argyle under the Highway 281 overpass on E. Olmos Drive consisting of no less than 108 spaces (the “281 Parking Area”). The Tennis Court Property parking shall be in accordance with the Code of Ordinances as it applies to the Parking District and subject to the COAH approval process, and shall be shielded visually from any property outside of the Property, by a ten foot (10’) wide landscape buffer adjacent to public ROW, and fencing no less than six feet (6’) tall to minimize sound and light impacts to any adjacent lots which have a residential use. The 281 Parking Area shall be constructed in accordance with the requirements of the Texas Department of Transportation; and d. If any parking indicated on the Parking Diagram attached as Exhibit “A” is no longer available to be used by The Argyle, there will be a reduction in Maximum Occupancy in a ratio of 2-to-1 for each space lost unless replacement off-street parking is procured via purchase, lease or written agreement, in locations acceptable to the local municipality governing where such replacement parking is located. e. The Argyle or Texas Biomed shall not purchase any additional properties within the City of Alamo Heights other than the property located at 401 Torcido. The portion of the 401 Torcido property not included in the Tennis Court Property parking lot must remain single-family residential zoned. 7) ENFORCEMENT AND PENALTIES. a. The persons who may be cited for and are responsible for violations of the conditions of this SUP are The Argyle, its governance board, manager, or employee in charge. For violations of valet, bus, rideshare, and outdoor structure regulations, the operator and/or employees of the applicable valet service, bus, Attachment A
  • 12. 9 rideshare vehicle operator, or tent/outdoor structure rental company may be cited in addition to the individuals identified in the preceding sentence. b. The COAH is entitled to pursue all other criminal and civil remedies to which it is entitled under authority of statutes or other ordinances against a person, firm, or corporation that remains in violation of this chapter. SECTION 2. PUBLIC PURPOSE. The City Council finds that the SUP herein approved complies with all applicable rules and regulations set forth in the COAH’s Code of Ordinances and other law and is consistent with the COAH’s Comprehensive Master Plan. SECTION 3. INCORPORATING RECITALS. The City Council approves the recitals hereto and incorporates them herein as findings of fact. SECTION 4. REPEALING ORDINANCES IN CONFLICT AND SAVINGS CLAUSE. All ordinances or parts of ordinances in conflict herewith (including the Prior Entitlements) are hereby repealed to the extent of such conflict with all remaining portions not conflicting being saved from repeal herein. SECTION 5. SEVERABILITY. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional or illegal, such decision shall not affect the validity of the remaining sections of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared void. SECTION 6. REVOCATION OF SPECIFIC USE PERMIT. This SUP may be suspended, revoked, or modified by the City Council, after public hearing, notice and report by the Planning and Zoning Commission pursuant to Texas Local Government Code 211 to determine whether any condition, stipulation, or term of the approval of this SUP has been knowingly violated. In addition and without any public hearing or public action, this SUP may be revoked and terminated following written notice to The Argyle and a subsequent ninety (90) day cure period if: (i) the Property is no longer owned by Texas Biomed or any other philanthropic, charitable or non-profit entity supporting Texas Biomed; or (ii) the North Addition is not completed within twenty-four (24) months after the building permit is issued unless there are delays due to force majeure events, threatened or actual legal action, or other delays in the construction process beyond The Argyle’s control. SECTION 7. EFFECTIVE DATE. The Ordinance shall be effective immediately following approval by City Council. Attachment A

This situation poses a real problem and is a serious safety issue for the residents who live in this neighborhood. I could ignore this if, as in the past, I knew that it didn't happen that often. With the proposed expansion and the real possibility of this becoming a much more frequent occurence, this is now completely unsustainable. With the huge up ck on events as outlined in SUP, (112, an average of one event every 3 days) the neighborhood is going to be flooded with traffic, service and parking challenges that dwarf an already strained condi on. To handle all of this addi onal traffic, the Argyle is proposing one addi onal parking lot to the south of the Argyle (ne ng just 12 addi onal parking spaces) and an ill-defined bus and valet service to a very remote “leased lot” on the other side of the Olmos Basin. Now let’s imagine this: the streets around the Argyle, which traverse the Olmos Basin, are the most popular walking and biking corridors of the neighborhood. These roads are narrow, curvy, hilly and quiet. Now add buses, cars and alcohol to these pedestrian corridors, roads that can barely handle two cars going in different direc ons. The possibili es for casual es will be huge, and what were once lovely strolling streets are no longer. And imagine the confusion of Ubers and visitors arriving and depar ng among this very challenged valet system with the policing and management of this whole complex parking mess ul mately falling on the city. These plans are not taking us in a good direc on. The current ac vi es at the Argyle, with its lawn par es, traffic, parking and service vehicles are already a nuisance to the neighborhood and well beyond the quiet dining club that was permi ed in 1955. It is me to ask the Argyle to be a be er neighbor, to focus on fixing these current condi ons, and certainly not building a facility that will exacerbate those condi ons and change the neighborhood forever. Build it and they will come and keep on coming may be great business plan for the Argyle, but it is terrible for the neighborhood. These nearby blocks are a pleasant scene for generations of walkers, bicyclists, and spontaneous street-side chats between people ranging from the very old to the very young. Every large Argyle party leaves many cars on the street overnight, materially impacting residents’ use. Street parking overnight is not allowed for residents so why are Argyle guests allowed to do so? If we want to have a party of our own, personal guests must contend with current Argyle congestion. Imagine what it would be like with expanded volume. During these events it feels like living near a bar- restaurant, however, without access. The proposed ordinance would increase the number of people allowed from 9 parties of 300+ people to 117 parties of 250+ people. With greater crowd size and frequency of events comes more security risk. The guest numbers stated in the proposed permit will not fit into the parking scheme delineated, is below code, and will flood the streets with cars. Bus shuttles add congestion. The intention stated by The Argyle to discourage neighborhood parking is not enforceable, nor is the promise not to purchase additional properties for surface parking. Revelry of this proposed magnitude and the new development itself will cause concentric devaluation of property values in a neighborhood like ours. When I happily chose to live one block and two doors from The Argyle, it was a breathtaking site anchored by a fine historic house serenely floating in an almost rural landscape. Club functions were subordinated to those essential qualities, which the members and the neighbors cherished. The original appearance and configuration of the club enhanced the image of Alamo Heights and San Antonio as a gracious place. Each addition thus far has managed to hold onto its traditional heritage as intended by the founders. I believe that the present effort by Argyle leadership to transform the private facility into a very large party and event center is going to drastically erode the quality of life and reduce the safety of the area. Why do we have to bear the burden of this massive expansion of activities for an exclusive clientele? Please do not pass this ordinance. Thank you. Dallas is not that, and I am living in a residential neighborhood. Traffic and noise and people, lots of people with no regard for place and purpose of a place. I have pined for that sense of place, my Alamo Heights. To think that my elected officials - and yes, I vote - would turn a blind ear to the dozens of tax paying home owners like myself and my colleagues and friends throughout Alamo Heights to this expansion for the wealthy, gives me grave pause. Shame on them for not hearing our voice. We are Alamo Heights. Protect what has made Alamo Heights what it is today. A community. Not a luxury destination for visitors who have no concern for our unique and rare corner of the world. You have the power to do that still, right now. Turn down this Argyle expansion. So they obviously have plans to expand beyond the big remodel and new party rooms. The Argyle is not being honest and straightforward while telling the neighborhood one thing while planning future monster development on the back burner. For those who have chosen Old Alamo Heights...it is not only the beautiful oak trees...the wonderful location.... that is central to so much and yet so perfect for walking and biking..but the peacefulness.. the quiet ..the calm. ... where you can listen to to the chirping song of birds...see the eagles and hawks soar...have a oneness with nature.. This is in sharp contrast to the chaotic noisy car-filled areas now surrounding the Argyle and encroaching bit by bit ever further into the surrounding neighborhood....no beautiful walking there... walking around all the ugly Argyle cones further reminders of the destruction of our once calm neighborhood. Definitely not a place to ride, walk or jog and get in touch with your inner self and have quiet time for your thoughts....strangers constantly getting out of cars in front of neighbors lawns... constant bustle..constant deliveries in and out...guests in and out ...staff in and out day after day.. It is time that the Argyle becomes a good neighbor to the wonderful neighborhood where it is situated. With the huge uptick on events as outlined in the SUP, the neighborhood is going to be flooded with traffic, service and parking challenges that dwarf an already strained condition. To handle all of this additional traffic, the Argyle is proposing one additional parking lot to the south of the Argyle, and a bus and valet service to remote lots at the Episcopal Diocese, 281 underpass, and the Alamo Heights Swimming Pool. Now let’s imagine this: the streets connecting the Diocese and the Pool, which traverse the Olmos Basin, are the most popular walking and biking corridors of the neighborhood And these roads are narrow, curvy, hilly and quiet. Now add buses, cars and alcohol to these pedestrian corridors, roads that can barely handle two cars going in different directions, the possibilities for casualties will be huge, and, what were once lovely strolling streets are no longer. And imagine the confusion of Ubers and visitors arriving and departing among all of this ill-defined valet system with the policing and management of this whole complex parking mess ultimately falling on the city. These plans are not taking us in a good direction. The current activities at the Argyle, with its lawn parties, traffic, parking and service vehicles, are already a nuisance to the neighborhood and well beyond the quiet dining club that was permitted in 1955. It is time to ask the Argyle to be a better neighbor, to focus on fixing these current conditions, and certainly not building a facility that will exacerbate those conditions and change the neighborhood forever. Build it and they will come and keep on coming may be a great business plan for the Argyle, but it is terrible for the neighborhood. Hi Buddy, I have lived in a 100 plus year old centennial house since 1985. I have been going to the argyle since I was 11. It has historically operated as a small private dinner club. Our home located at 101 claiborne way is within earshot and traffic pattern of the argyle. For the first 20 years I lived here things went smoothly enough with the argyle as a small private dinner club. During the last 19 years things have gotten progressively noisier, more congested and less friendly to the argyle neighbors. Is Alamo heights leadership here to serve residents of Alamo heights or to allow the argyle to grow..causing more noise, more congestion and more risk? With the plan for expansion, the Alamo heights police force is going to have the added responsibility of monitoring illegal parking around the argyle, including all the side streets and overflow into nearby streets. The unsatisfactory parking proposals will only exacerbate the problem. The Alamo heights police will also need to be sending extra manpower to make sure celebrants at argyle events are not driving while intoxicated. Our homes will be subject to more people entering our neighborhood, which could lead to more break-ins and theft. One of the benefits of living near the nature trails, the little league fields and the swimming pool is that it allows all residents of Alamo heights to enjoy family fun and sport events together. Daytime events, which the argyle is proposing they will have more of, will increase traffic in and around these locales with pedestrians of all ages at risk of the increased vehicular traffic in these areas. From what I have gleaned by attending the hearings about the argyle expansion, the argyle has already broken promises and lost their variances. All the while nothing seems to stop these illegal activities. What is our recourse? We are counting on you to stand up for our neighborhood as the city council of Alamo heights.
