REFERAL FOR MEDIATION Reference to ADR and statutory requirement Section 89 and Order X Rule 1A of Code of Civil Procedure, 1908 require the court to direct the parties to opt for any of the five modes of alternative dispute resolution and to refer the case for Arbitration, Conciliation, Judicial Settlement, Lok Adalat or mediation. If the suitable method is mediation, the court shall refer the dispute to mediation and direct the parties to be present before the Mediation Centre with the counsel, if any. The accident has caused almost 40% of disability to him and the same was declared by the Government hospital. The victim filed the case for the compensation. The victim got the compensation but not in proper time. Consequently, the justice given was not adequate. The petitioner moved the top court after a Delhi high court order refused to grant him sufficient compensation for an accident, he had suffered in 1988. Such accidents, particularly fatal accidents, would always lead to filing of claims by the victims and/or kith and kin of victims, for compensation Bring about a mechanism which prevents delays in awarding compensation to them. In addition to which can function independently under the guidance of NALSA. Such a framework should be prepared within a period of two months. It should start functioning immediately thereafter at the given levels as suggested in this judgment. It referred to an earlier apex court judgement of 2017 in which the court had directed all the states to implement the Modified Claims Tribunal Agreed Procedure formulated by the Delhi High Court in December, 2014. All banks will appoint a Nodal officer and the list of Nodal Officers and their emails will be submitted to all tribunals. This is very detrimental to accident victims, as well as advocates, as it would minimise, if not eliminate, the role of advocates in such cases. The new mediation scheme has wide ramifications for the accident victims, past, present and future. The greatest drawback of the scheme is the direction to deposit the compensation, payable to the victims on successful mediation or otherwise, to be invested in annuity schemes, keeping it out of reach of the accident victims.
