Genocide in legal terms The international legal definition of the crime of genocide is found in Articles II and III of the 1948 Convention on the Prevention and Punishment of Genocide. Article II describes two elements of the crime of genocide:
“ 1) the mental element , meaning the " intent to destroy , in whole or in part , a national, ethnical , racial or religious group , as such", and ” Incumbent President of Armenia SERJ SARGSIAN : “ Before Khojaly Azerbaijanis thought that we (Armenians) are unable of killing civilians. In Khojaly we have broken this stereotype.” “ Sargsian account in other Words, suggesting that the killings may, at least in part, have been a deliberate act of mass killing as intimidation.” – concludes British journalist Thomas de Waal in his book on conflict.
2) the physical element of the killing members of the group. A crime must include both elements to be called "genocide." “ As soon as he had arrived at Khojaly in response to reports of fighting, he had begun piecing together the story of the MASSACRE that had just wound down, perhaps only an hour before his arrival”. At about 11.00 pm the night before, some 2.000 Armenian fighters had advanced through the high grass on three sides of Khojaly, forcing the residents out through the open side to the east. Daud Kheyrian “For the sake of cross”, Beirut 2007: “… the Armenian group “Gaflan” ... collected 100 dead bodies of Turks (Azerbaijanis) and burned them in a place located one kilometer from Khojaly to the West on March 2… Then they have burned dead bodies. It seemed to me that someone was crying in fire between dead bodies… ” Markar Melkonian:“My Brother’s Road”
Memorial Human rights Society: According to Burganski I, the cameraman of “GOLFSTREAM” association., who was in Khojaly on 26 February, the most of peaceful civilians were killed as a result of mortar bombardment, conducted by subdivisions of defensive garrison, but the reliability of the data given by Burganski is doubtful, as the assault conditions described by the cameraman don’t coincide with the information given by other sources. Human Rights Watch/Helsinki: " [Karabakh] Armenian forces and the troops of the 366th CIS regiment . . .deliberately disregarded this customary law restraint on attacks. Nagorno-Karabakh officials and fighters clearly expected the inhabitants of Khojaly to flee since they claim to have informed the town that a corridor would be left open to allow for their safe passage. . . the killing of fleeing combatants could not justify the foreseeable large number of civilian casualties.” WATCH-DOGS’ REFLECTIONS
